05-9688r 288 RESOLUTION NO. 9688 RESOLUTION ESTABLISHING JUST COMPENSATION AND AUTHORIZING PURCHASE OF REAL PROPERTY LOCATED AT 6601,6609,6615,6621,6627,6633, 6639, AND 6645 17TH AVENUE WHEREAS, on September 27, 2005, the City Council (City) approved an Agreement with the Metropolitan Airports Commission (MAC) to outline the procedures and conditions to be followed in acquiring eight residential properties along 17th Avenue; WHEREAS, the City has a plan for the purchase of properties along 17th Avenue, south of East 66th Street; and WHEREAS, the real property described in Exhibit A is identified for purchase by the City; and WHEREAS, the real property described in Exhibit B is identified for purchase by the MAC; and WHEREAS, Permanent Improvement Revolving funds from the City are available on an interim basis for the purchase of the real property and related expenses described in Exhibit A; and WHEREAS, funds from the MAC are available to the City for the purchase of the real property and related expenses described in Exhibit B; and WHEREAS, the City is authorized by Minnesota Statutes to acquire real property within its corporate boundaries; and WHEREAS, the City has caused appraisals for the subject property to be made by a qualified independent professional appraiser to determine fair market value of real estate; and WHEREAS, a qualified review appraiser has certified the appraisal reports identified in Exhibit B, in accordance with the aforementioned Agreement, as being in conformity with appraisal standards; and WHEREAS, the fair market value of the real properties are identified in Exhibit C. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Minnesota as follows: 1. That just compensation for the real properties identified in Exhibit C is approved. 2. That the City's consultant is authorized to present offers of said amounts to the respective property owners. 3. That the City's consultant is authorized to undertake all other necessary actions to purchase said property on behalf of the City.
