05-9685r 285 RESOLUTION NO. 9685 RESOLUTION AUTHORIZING A CONDITIONAL USE PERMIT FOR AUTO SALES AT 1201 EAST 66TH STREET WHEREAS, an application has been filed with the City of Richfield which re~uest approval of a Conditional Use Permit to allow auto sales at 1201 East 66t Street, legally described as: The north V2 of tracts A and G, Registered Land Survey #589. WHEREAS, the Planning Commission of the City of Richfield has recommended approval of this requested Conditional Use Permit at 1201 East 66th Street at its November 28,2005 meeting, and WHEREAS, this requested Conditional Use Permit at 1201 East 66th Street meets those requirements necessary for issuing a Conditional Use Permit as specified in Richfield's Zoning Code, Sections 526.27, Subdivision 11 and 546.05, Subdivision 6, except as explained in City Council Letter No. 234; and WHEREAS, the City has fully considered the request for approval of the Conditional Use Permit; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. A Conditional Use Permit is issued for an Auto Sales Lot, as described in City Council Letter No. 234, on the Subject Property legally described above. 2. The Conditional Use Permit at 1201 East 66th Street is subject to the following conditions in addition to those specified in Section 526.27, Subdivision 11 of the City's Zoning Code: . That the recipient of the Conditional Use Permit record this resolution with the County, pursuant to Minnesota Statutes Section 462.36, Subdivision 1 and Richfield Zoning Code 546.05, Subdivision 7. . That the four new parking stalls be marked in accordance with Richfield Parking Standards on file with the Public Works Department. . That no more than four vehicles are available for sale on the premises at one time. . That "for sale" vehicles be parked only in the new parking spaces, as shown on the approved Parking Plan. . That banners, wind devices and promotional display devices not attached to the building are prohibited. . Only vehicles with passenger license plates may be sold from the site. . That "for sale" vehicles must be clearly marked as "for sale". . That all landscaping be maintained and replaced as necessary in accordance with Richfield Landscape Standards and the approved Landscape Plan. 3. The conditional use permit shall remain in effect for so long as conditions regulating it are observed, and the Conditional Use Permit shall expire if normal operation of the use has been discontinued for 12 or more months, as required by the Zoning Ordinance, Section 546.05, Subd. 9.
