05-9597r 197 RESOLUTION NO. 9597 RESOLUTION AMENDING RESOLUTION NUMBER 9483 AUTHORIZING A CONDITIONAL USE PERMIT FOR TWO-FAMILY DWELLING AT 7141 PORTLAND AVENUE WHEREAS, the purpose of this resolution is to correct an incomplete legal description contained in Resolution No. 9483, adopted by the Richfield City Council on June 22, 2004, and WHEREAS, an application has been filed with the City of Richfield which request approval of a conditional use permit to allow a two-family dwelling at 7141 Portland Avenue, legally described as: The North 87 % feet of the South 175 feet of the West 1/8 of Northwest % of the Northwest % of Section 35, Township 28, Range 24, except he West 33 feet thereof, according to the United Stead government survey thereof and situated in Hennepin County. WHEREAS, the Planning Commission of the City of Richfield has recommended approval of this requested conditional use permit at 7141 Portland Avenue at its May 24, 2004 meeting, and WHEREAS, this requested conditional use permit at 7141 Portland Avenue meets those requirements necessary for issuing a conditional use permit as specified in Richfield's Zoning Code, section 546.05, subd.6, and WHEREAS, the City has fully considered the request for approval of the conditional use permit; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. A conditional use permit is issued for a two-family dwelling, as described in City Council Staff Report No. 42 ,on the Subject Property legally described above. 2. This conditional use permit at 7141 Portland Avenue is subject to the following conditions in Section 521.07 Subdivisions 5 of the City's Zoning Ordinance. 3. The conditional use permit shall remain in effect for so long as conditions regulating it are observeq, and the conditional use permit shall expire if normal operation of the use has been discontinued for 12 or more months, as required by the Zoning Ordinance, Section 546.05, Subd. 9.
