Motion carried: 7-0 OPEN FORUM No members of the public spoke. PUBLIC HEARING(S) ITEM #1 PC Letter No. 5 — Consideration of amendments to the City's Zoning Ordinance. The proposed ordinance would allow the following in the Single-Family Residential Districts; 1) construction of up to two-story accessory garages (with conditions), and 2) construction of accessory dwelling units. City Planner Melissa Poehlman presented the staff report. In response to a question from Commissioner Vrieze Daniels, Poehlman provided clarified Subsection 514.05, Subdivision 8(I); that the "replaced" garage space must be in a structure. February 23, 2015 In response to Commissioner Hayford Oleary, Poehlman clarified how parking spaces are defined and counted. M/Vizecky, S/Rosenberg to close the public hearing. Motion carried: 7-0 Commissioner Vizecky stated his strong support for the ordinance amendment, though he had concerns with the limitations of gross floor area. Commissioner Hayford Oleary stated his strong support for the ordinance amendment, with reservations about the requirement to replace parking spaces in a garage. M/Standfuss, S/Rosenberg to recommend approval of the amendments to the City's Zoning Ordinance. Motion carried: 7-0 ITEM #2 PC Letter No. 6 — Consider amendments to the City's Zoning Ordinance. The proposed ordinance would prohibit recreational marijuana sales outlets and marijuana production, and establish conditions related to the location and operation of medical marijuana dispensaries. Poehlman presented the staff report. In response to questions from Commissioner Rosenberg, Poehlman stated that the City had received inquiries for this use prior to the moratorium. Poehlman confirmed that all of the potential locations identified on the map were in shopping centers and met the buffer requirements. Commissioner Vizecky expressed concern that the ordinance would actively regulate a controlled substance that was not substantially different than other medicines currently available in pharmacies. Poehlman stated that the state statue did not permit distribution of medical marijuana through pharmacies, and that distinction created the need for separate regulation in the zoning code. M/Vizecky, S/Rosenberg to close the public hearing. Motion carried: 7-0 M/Rosenberg, S/Standfuss to recommend approval of the amendments to the City's Zoning Ordinance. I.RECOMMENDED ACTION: Conduct and close a public hearing and by motion: 1) Recommend approval or denial of a Comprehensive Plan Amendment to change the designation of 6244 Cedar Avenue from Public/Quasi-Public" to "Community Commercial". 2) Recommend approval or denial of a Conditional Use Permit and Variance to allow an auto body repair business at 6244 Cedar Avenue. II. BACKGROUND The City's Comprehensive Plan guides the property at 6244 Cedar Avenue for Public/Quasi-Public" use. For many years, the site was owned and operated by Qwest now Centuryl-ink) and this designation was consistent with use as a public utility. In 2011, Qwest sold the property to the owners of cleaning service Zerorez. At the time of purchase, the proposed use of the site, primarily for the parking of service vehicles which technicians would drive to client locations each day, was found to be substantially similar to Qwest's use of the property and no land use approvals were required. Since this time, Zerorez's business has substantially expanded and the site has become overcrowded. Upon recent inspection, the City has found numerous Code violations. The applicant is proposing to acquire this property for use as an auto body repair facility. The proposed change in use of the property requires that the applicant apply for a Comprehensive Plan amendment to change the designation of the property from Public/Quasi-Public" to "Community Commercial" and a Conditional Use Permit for auto body repair in the General Business (C-2) Zoning District. The applicant is also requesting variances to allow taller screening materials in what is considered the front yard of this property and a reduced buffer yard where the property is adjacent to a public utility building. III. BASIS OF RECOMMENDATION A. POLICY Comprehensive Plan Amendment: The Comprehensive Plan is a vision and guide for future land use decisions in the City. The plan guides 6244 Cedar Avenue as "Public/Quasi-Public," which includes civic, county and state facilities; religious facilities; schools and other similar non-profit uses. For the past four years the site has been used for commercial purposes. The Cedar Corridor Master Plan identifies this parcel and the CenterPoint Energy parcel to the north as parkland, but the parcels are not specifically discussed and therefore the intent of the Plan is somewhat unclear. Amending the City's Comprehensive Plan is a question of community character, and the factors to be considered in that decision are qualitative, rather than quantitative. There has been renewed interest in development within the Cedar Corridor over the past six months and the Council has discussed possibly revisiting the 10 year old Cedar Corridor Master Plan. Whether or not this property should be part of that study or if this particular change is appropriate and desired at this time are decisions that should be made by the appointed and elected leaders of the community, rather than by city staff. Conditional Use Permit: In the General Business (C-2) zoning district, auto mechanical or body repair shops are a conditionally permitted use. A full discussion of all requirements can be found as an attachment to this report. The following is a discussion of items of specific importance and/or requests for deviations from requirements. If an auto body repair site abuts a residentially zoned lot, a buffer yard of not less than 25 feet in width and 75 percent all-season opacity from the ground to a height of 6 feet is required to separate all aspects of such use from abutting residential parcels. The Council may reduce this requirement to not less than 15 feet if significant additional landscaping and fencing, with 100 percent all-season opacity, is provided to screen the auto mechanical or body repair shop use. Taft Park (like all parks in the City) is a residentially zoned property. Code regulations state that this requirement applies to all aspects of the use; however, staff believes that it is intended to separate all aspects that are unique to this type of use (e.g. damaged vehicles) as opposed to the building or general parking lot itself. The applicant is proposing a heavily landscaped 20-foot buffer with 100 percent opacity along the western edge of the south parking lot. A cedar fence has also been shown on the plans as an optional addition if the Planning Commission and/or Council feel it is necessary. A 6-foot cedar fence will be installed within the northwest corner of the south parking lot in order to screen damaged vehicles from the south and east. Staff recommends that the cedar fence be installed on all sides of the damaged vehicle area. Staff also recommends that the landscaping alone be allowed to suffice for the remainder of that buffer yard, rather than requiring the fence to extend to the southern property line. The ground equipment for the telecommunication tower was required to be screened as a condition of approval. Staff has sent a notice to the property owner indicating that the required landscaping must be installed. o Staff recommends that the Planning Commission and Council approve a landscape plan that would include the normal parking lot screening along the residential edge of the northern parking lot since this lot will not be used for the storage or parking of vehicles awaiting service. A 15-foot buffer is required to separate the use from all abutting parcels. o The applicant is requesting a variance to this requirement. The north parking lot is separated from the abutting CenterPoint Energy parcel by a 10-foot wide heavily landscaped buffer. A block utility building, with no permanent staff is located on this CenterPoint property. Staff believes that the requested variance is reasonable and that the existing buffer meets the intent of the regulation. Vehicles awaiting repair must be stored in appropriately designed and screened areas approved by the City. o The applicant has proposed a cedar fence at the northwest corner of the south parking lot to surround the area in which damaged vehicles will be stored. Additional damaged vehicles shall be stored inside the building. The front lot line of a property is defined by the Zoning Code as the shorter of the two lot lines. In this case, the front yard is along 63rd Street. Fencing and/or landscaping in the front yard cannot exceed four feet in height. o The proposed fence surrounding the damaged vehicles and portions of the proposed landscape buffer will exceed four feet in height (as required in order to provide the adequate screening). The applicant is requesting a variance from this requirement. Staff believes that the requested variance is reasonable due to the unique siting of the existing building on this lot. The Council must also find that the eight general requirements to grant a CUP are met. A full discussion of these requirements can be found in the attached document, but two key considerations are as follows: 1) The proposed use is consistent with the goals, policies, and objectives of the City's Comprehensive Plan; and 2) There is a public need for such use at the proposed location. B. CRITICAL ISSUES Comprehensive Plan amendments require a four-fifths majority vote by the City Council. Amendments must also be approved by the Metropolitan Council. If the proposed applications are approved, a final landscape plan that includes additional and modified parking lot screening must be approved by both Community Development and the Public Works Department prior to installation. Staff recommends that fencing be required on a minimum of three sides (west, south, east) of the damaged vehicle storage area. An easement for street right-of-way (Cedar Avenue) must be recorded prior to occupancy. There are a number of current Code violations that will need to be addressed whether or not this particular application is approved, not limited to the unauthorized striping of the street for parking. C. FINANCIAL The required processing fees have been paid. D. LEGAL Notification: Notice of this public hearing was published in the Sun Current in accordance with State and Local requirements. Properties within 350 feet were notified by mail. Notification of the proposed amendment to the Comprehensive Plan was also sent to the Metropolitan Airports Commission in accordance with Metropolitan Council requirements for the notification of adjacent government jurisdictions. City Council consideration is scheduled for April 14, 2015. If the Council adopts the recommended changes, they will be submitted to the Metropolitan Council for review. IV. ALTERNATIVE RECOMMENDATION(S) Recommend denial of the Comprehensive Plan amendment, CUP and variances. V. RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND VARIANCES FOR AN AUTO BODY REPAIR BUSINESS AT 6244 CEDAR AVENUE WHEREAS, an application has been filed with the City of Richfield which requests approval of a conditional use permit and variances to allow an auto body repair business at property commonly known as 6244 Cedar Avenue and legally described in the attached Exhibit A; and WHEREAS, the Planning Commission of the City of Richfield held a public hearing and recommended approval of the requested conditional use permit and variances at its March 23, 2015 meeting; and WHEREAS, notice of the public hearing was published in the Sun-Current and mailed to properties within 350 feet of the subject property on March 10, 2015; and WHEREAS, the requested conditional use permit meets the requirements necessary for issuing a conditional use permit as specified in Richfield's Zoning Code, Subsection 547.09 and as detailed in City Council Staff Report No.and WHEREAS, the Zoning Code states that a minimum 15-foot buffer is required to separate all aspects of an auto body repair shop from adjacent parcels, Subsection 534.07, Subd. 12(c); and WHEREAS, the Zoning Code states that the maximum height of a fence, wall or hedge in the front yard is four feet, Subsection 509.15, Subd. 3(a); and WHEREAS, Minnesota Statutes Section 462.357, Subdivision 6, provides for the granting of variances to the literal provisions of the zoning regulations in instances where their enforcement would cause "practical difficulty" to the owners of the property under consideration; and WHEREAS, based on the findings below, the Richfield City Council approves the requested variance from Richfield Zoning Code Subsections 534.07, Subd. 12(c); and 509.15, Subd. 3(a); and WHEREAS, the City has fully considered the request for approval of the conditional use permit; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. The City Council makes the following general findings: a. The Property is zoned General Business (C-2). b. The Zoning Code states that a minimum 15-foot buffer is required to separate all aspects of an auto body repair shop from adjacent parcels. The proposed buffer is 10 feet. A variance from Subsection 534.07, Subd. 12(c) is required. c. The Zoning Code states that the maximum height of a fence, wall or hedge in the front yard is four feet. The proposed fence is six feet and the proposed final height of screening hedges and or trees could be in excess of six feet once fully grown. A variance from Subsection 509.15, Subd. 3(a) is necessary. 2. With respect to the application for variances from the above-listed requirements, the City Council makes the following findings: a. Strict enforcement of Richfield Zoning Code Subsection 534.07, Subd. 12(c) would cause a practical difficulty. The existing 10-foot buffer is substantial and nearly 100 percent opaque year round. The adjacent parcel is home to a seldom-visited utility building. Requiring the property owner to remove a row of parking in order to add five additional feet at this boundary would serve no purpose and only hurt the property owner. Strict enforcement of Richfield Zoning Code Subsection 509.15, Subd. 3(a) would prohibit use of the site for an auto body repair shop and likely any new use that would want to utilize the interior vehicle space. Requiring the applicant to store vehicles on the north side of the building, away from the access doors, would be impractical and likely create an ongoing enforcement issue. b. Unique circumstances affect the Property that were not created by the applicant. The adjoining parcel is owned by a public utility company and the existing structure is not regularly accessed by either employees or the public. Additional buffering is unnecessary. In regard to the fence height, the existing building is situated such that the "front" faces Cedar Avenue and parking lots are located on either end of the building. This unusual layout is no fault of the applicant. c. Granting the requested variance will not alter the character of the neighborhood. The existing buffer is substantial and there are no employees or occupants of the adjacent parcel who would notice if an additional five-feet were to be added on the southern side of the existing landscaping. A six-foot fence and/or landscaping wall is required to meet screening requirements for the proposed use. The proposed screening is attractive and reasonable. No adverse impacts are anticipated. d. The variances requested are the minimum necessary to alleviate the practical difficulties. e. The proposed variances do not conflict with the purpose or intent of the Ordinance or Comprehensive Plan. 3.Based on the above findings, a variance is hereby approved to permit a 10-foot landscaped buffer on the north side of the Subject Property and a six-foot tall fence and/or hedges on the south side of the property in order to meet screening requirements. 4. A conditional use permit is issued to allow an auto body repair business, as described in City Council Letter No. on the Subject Property legally described above. 5. This conditional use permit is subject to the following conditions in addition to those specified in Section 547.09 of the City's Zoning Ordinance: A recorded copy of the approved resolution must be submitted to the City prior to the issuance of a building permit. Damaged vehicles must be stored inside the building or inside the proposed fenced area only. No damaged vehicles are permitted in the north parking lot. Fencing to screen damaged vehicles must completely screen the vehicles from all sides. Landscaping plans must be approved by the Community Development and Public Works Departments prior to installation. Landscaping in the boulevard will require a Boulevard Feature Permit and trees will not be permitted within the 63rd Street right-of-way due to the location of a City water main. Trees must be minimum of 10-feet from existing watermain and sight triangles at driveway must be maintained. Parking lot landscape screening is required. Screening of monopole ground equipment in accordance with previously approved plans must be installed prior to occupancy. The applicant shall be responsible for continued maintenance of landscaping in keeping with the approved plans. Separate sign permits are required. A utility plan must be submitted and approved by the Public Works Director prior to the issuance of a building permit. All new utility service must be underground. All new utilities, including roof-top equipment, must be screened in accordance with City Code requirements. A screening plan is required prior to installation. Parking lot striping on Cedar Avenue must be removed and work approved by the Public Works Director prior to building permit approval. The applicant is responsible for obtaining all required permits, compliance with all requirements detailed in the City's Administrative Review Committee Report dated February 6, 2015, and compliance with all other City and State regulations; Prior to the issuance of an occupancy permit the developer must submit a surety equal to 125% of the value of any improvements and/or requirements not yet complete. This surety shall be provided in the manner specific by the Zoning Code. 6. This conditional use permit and these variances shall expire one year after issuance unless 1) the use for which the permit was granted has commenced; or 2) Building permits have been issued and substantial work performed; or 3) Upon written request of the applicant, the Council extends the expiration date for an additional period not to exceed one year. Expiration is governed by the City Zoning Ordinance, Section 547.09, Subdivision 9. 7. This conditional use permit shall remain in effect for so long as conditions regulating it are observed, and the conditional use permit shall expire if normal operation of the use has been discontinued for 12 or more months, as required by the City's Zoning Ordinance, Section 547.09, Subd. 10. Torrens Property, Certificate of Title No. 13439281) A-1 Code Requirements / Required Findings Part 1 — Auto mechanical or body repair shops in General Business (C-2) District: The findings necessary to approve said business in the C-2 District are as follows (534.07, Subd. 12). 1. The use site shall not be located within 300 feet of the grounds of a school, church or hospital. This requirement is met. 2. If the use site abuts a residentially zoned lot, a buffer of not less than 25 feet in width and 75 percent all-season opacity from the ground to a height of 6 feet shall be provided to separate all aspects of such use from abutting residential parcels. The Council may reduce this requirement to not less than 15 feet if significant additional landscaping and fencing, with 100 percent all- season opacity, is provided to screen the auto mechanical or body repair shop use. The applicant has provided a plan that provides planting that are anticipated to fill in to 100 percent opacity within 1-2 years of growth. The applicant has included an option to install a cedar fence along this entire border as well. Staff recommends that the cedar fencing be required on all sides of the damaged vehicle storage area, but that the landscaping proposal be found sufficient for the remaining residential edge. Along the edge of the north parking lot where adjacent to the Park, staff recommends standard parking lot screening and a prohibition against the storing of damaged vehicles. 3. A buffer yard of not less than 15 feet in width shall be provided to separate all aspects of such use from any abutting parcel. The applicant has requested a variance to this requirement along the northern property line. A full discussion of this request can be found in Part 3 below. 4. Vehicles that are inoperable shall not be stored on the premises, except in appropriately designed and screened areas as approved by the City. In accordance with Section 1320 of the City Code, inoperable vehicles cannot be stored on any property for more than 96 hours. The applicant will be required to comply with all applicable storage regulations. 5. Vehicles that are waiting for repair shall be stored in appropriately designed and screened areas as approved by the City. The applicant is proposing to store damaged vehicles inside the building and in a screened area in the northwest corner of the south parking lot. Staff recommends that the cedar fencing be required on all sides of the damaged vehicle parking area. 6. If the use is not located on a county road or state highway, it shall not be operated between the hours of 11:00 pm and 6:00 am. Proposed hours of operation are Monday-Friday 7:00 am — 6:00 pm and Saturday 9:00 am — 12 pm. 7. All repair, assembly, disassembly and maintenance of vehicles shall occur within an enclosed building, except minor maintenance such as tire inflation or adding oil or windshield wiper fluid. The applicant will be required to comply with operational regulations. Part 2 — Conditional Use Permit: The findings necessary to issue a Conditional Use Permit (CUP) are as follows (547.09, Subd. 6): 1. The proposed use is consistent with the goals, policies, and objectives of the City's Comprehensive Plan. This property is "Public/Quasi-Public" use. The Council must find that a change to "Community Commercial" is appropriate in order to meet this requirement. 2. The proposed use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. The purpose of the Zoning Code is to protect and promote the public health, safety, comfort, aesthetics, economic viability, and general welfare of the City. The purpose of the General Business (C-2) District is to allow a wide variety of commercial businesses that are attractive and compatible with nearby residential properties. The proposal is consistent with these purposes. 3. The proposed use is consistent with any officially adopted redevelopment plans or urban design guidelines. The 2004 Cedar Corridor Master Plan identifies this parcel and the current CenterPoint Energy to the north as part of Taft Park; however, the parcels are not directly discussed. The specific intent of the Plan is unclear. 4. The proposed use is or will be in compliance with the performance standards specified in Section 544 of this code. The proposed development will either maintain the status quo or improve compliance with performance standards requirements. 5. The proposed use will not have undue adverse impacts on governmental facilities, utilities, services, or existing or proposed improvements. The City's Public Works and Engineering Departments have reviewed the proposal and do not anticipate any issues that cannot be addressed through the stipulations of approval. 6. The use will not have undue adverse impacts on the public health, safety, or welfare. Adequate provisions have been made to protect the public health, safety and welfare. 7. There is a public need for such use at the proposed location. This is a question of policy and whether or not community leaders feel that a Comprehensive Plan change is appropriate. 8. The proposed use meets or will meet all the specific conditions set by this code for the granting of such conditional use permit. This requirement can be met, if the Comprehensive Plan amendment is approved. Part 3 -Variances: The findings necessary to approve a variance are as follows Subd. 547.11): 1. There are "practical difficulties"that prevent the property owner from using the property in a reasonable manner. 2. There are usual or unique circumstances that apply to the property which were not created by the applicant and do not apply generally to other properties in the same zone or vicinity. 3. The variance would not alter the character of the neighborhood or the locality. 4. The variance is the minimum necessary to alleviate the practical difficulty. 5. The variance is in harmony with the general purpose and intent of the ordinance and consistent with the Comprehensive Plan. Reduced buffer yard The applicant has requested a variance to reduce the required buffer yard from 15 feet to 10 feet along the northern property line. Criteria 1: There is an existing heavily-landscaped 10-foot buffer along the northern edge of the property. The property to the north is the location of a CenterPoint Energy utility building at which no employees are present on a daily basis. The existing buffer meets the intent of the ordinance and removal of an entire row of parking to gain an additional five feet would be unreasonable. Criteria 2: The intent of the setback regulation is to protect neighbors from noise and unsightly views of cars awaiting repair. In this case, the adjacent parcel is the location of an infrequently visited utility building. Criteria 3: The proposed variance is not expected to have any impact on the character of the neighborhood. Criteria 4: The proposed variance is the minimum necessary. Criteria 5: The proposed reduction does not conflict with the purpose and/or intent of the Comprehensive Plan or the Ordinance. Height of fencing and/or landscaping in the front yard The applicant has requested a variance to allow a fence and landscaping that exceeds four feet in height in the front yard of a property. For a corner lot, the Zoning Code defines the front lot line as the shorter lot line abutting a street. In this case, the front lot line and therefore front yard are adjacent to 63rd Street. Proposed fencing will not exceed six feet. Criteria 1: The existing vehicle entrances to the building are from the south parking lot, which in this case happens to be the front yard. It would be impractical and inefficient to require the applicant to store damaged vehicles in a yard that is not adjacent to the vehicle entry doors. Criteria 2: The existing building is situated such that the "front" faces Cedar Avenue and parking lots are located on either end of the building. This somewhat unusual layout is no fault of the applicant. A layman looking at the building would assume that the front was the side facing Cedar Avenue. Criteria 3: The proposed variance is not expected to have a negative impact on the character of the neighborhood. Screening, both the proposed fencing and landscaping, will help to protect adjacent parcels and is expected to be an improvement. Criteria 4: The proposed variance is the minimum necessary to accommodate an auto body repair business at this location. Criteria 5: The proposed height variance does not conflict with the purpose and/or intent of the Comprehensive Plan or the Ordinance. II.RECOMMENDED ACTION: I Conduct and close a public hearing and by motion: 1) Recommend approval of the attached ordinance amending the Richfield City Code to allow accessory school-based health centers as a conditional use; and 2) Recommend approval of an amendment to a conditional use permit at 7001 Harriet Avenue (Richfield High School) to allow a school-based health center. II. BACKGROUND Richfield Public Schools has requested a text amendment to the Zoning Code that would allow school-based health centers within public and/or private schools. The Richfield School District is proposing to develop such a center at Richfield High School. The purpose of the Health Center is to improve student access to affordable health care services. Primary health care along with dental, vision and mental health services would be provided. According to the attached "Case Statement" provided by the applicant, school-based health centers are considered one of the most effective and efficient ways to provide needed health care to children. A similar school-based health center operates in Brooklyn Center. Summary of proposed Ordinance The proposed text amendment would conditionally permit school-based health centers as an accessory or subordinate use to existing schools. Proposed conditions are as follows: The health center must primarily serve students; In residential districts, hours of operation may not extend beyond the regular operational hours of the school by more than one hour in the morning or 6:00 p.m. in the evening; Total square footage of the health center may not exceed 3,000 square feet or 10 percent of the total building square footage, whichever is less; Designated parking equal to staff plus one per exam room must be provided and designated for clinic use; Because of the focus on students and the associated sharing of parking, signage shall be limited to directional and identification signs. The maximum sign area and height shall also be limited as follows: In residential zones — sign area and height may not exceed the limits set for the MR-2 and MR-3 Zoning Districts per Subsection 549.23 and total square footage of all freestanding signage for the property shall remain limited to 100 square feet. In commercial and mixed use zones — sign area and height may not exceed limits set for nonresidential uses per Subsection 549.23. Total square footage of freestanding signs shall be governed by the underlying zoning district. The proposed 2,200 square-foot health center and site plan meet the proposed conditions. Nine additional parking stalls shall be added to the parking lot immediately adjacent to the health center and shall be signed accordingly. City staff is interested in continuing to discuss the location of the proposed additional parking with School District representatives, as we believe that the existing lot could potentially be reconfigured to accommodate the additional stalls without paving a new area. Five staff members are anticipated during peak periods and anticipated hours of operation are from noon — 6:00 p.m. All preliminary plans have been reviewed by the City's Administrative Review Committee. III. BASIS OF RECOMMENDATION A. POLICY A full discussion of all requirements necessary for the issuance of a conditional use permit has been provided as an attachment to this report. Ongoing review and periodic updating of the Code is necessary to ensure that regulations address emerging uses and trends. The health center must primarily serve students. The applicant has indicated that student-health will be the focus of the health center and the primary clients. 2. Hours of operation may not extend beyond the regular operational hours of the school by more than one hour in the morning or 6:00 p.m. in the evening. Anticipated hours of operation are from 12:00 p.m. — 6:00 p.m. 3. Total square footage of the health center may not exceed 3,000 square feet or 10 percent of the total building square footage, whichever is less. Total square footage is expected to be approximately 2,200 square feet which is less than 10 percent of the total building square footage (445,790 sq.ft.). 4. Designated parking equal to staff plus one per exam room must be provided and designated for clinic use. The proposal includes four exam rooms and a peak staffing level of five people; nine dedicated parking stalls are required and have been provided in the proposed site plan. 5. Maximum sign area and height shall not exceed the limits set for residential uses in the MR-2 and MR-3 Districts and total square footage of freestanding signs shall be limited to 100 square feet. The applicant is aware of sign conditions. Part 2 — Conditional Use Permit: The findings necessary to issue a Conditional Use Permit (CUP) are as follows (547.09, Subd. 6): 1. The proposed use is consistent with the goals, policies, and objectives of the City's Comprehensive Plan. This property is guided for Public / Quasi-Public use which accommodates schools, churches and other institutional uses. 2. The purpose of the Single-Family Residential (R) District regulations is to protect and preserve the residential character of single-family neighborhoods. Limitations on hours of operation, size and signage serve to means by which to achieve this goal. 3. The proposed use is consistent with any officially adopted redevelopment plans or urban design guidelines. NA 4. The Richfield SBHC Advisory Group has explored the Health Resource Center at Brooklyn Center Schools as a model for replication. The Brooklyn Center Health Resource Center(HRC) has been successful at raising necessary funds for clinic operations and overhead costs. Efforts are being explored to garner similar partnerships and resources to support efforts in Richfield. One unique consideration for sustainability is that as a result of services provided at the Brooklyn Center HRC, families are choosing to enroll and remain in the school district as a result of the accessible and affordable care provided in the HRC. I.RECOMMENDED ACTION: Conduct and close a public hearing and by motion: 1) Recommend approval of a Comprehensive Plan amendment changing the designation of 1400, 1420 and 1500-78th Street East and 7711-14th Avenue from High-Density Residential/Office to Regional Commercial; and 2) Recommend approval of the rezoning of 1400, 1420 and 1500-78th Street E and 7711-14th Avenue from Mixed Use — Community (MU- C) to Planned Mixed Use (PMU); and 3) Recommend approval of a Planned Unit Development, Conditional Use Permit and Final Development Plan to construct a multi-story automobile dealership and parking ramp at 1400, 1420 and 1500- 78th Street E and 7711-14th Avenue. II. BACKGROUND The properties located at 1400, 1420 and 1500-78th Street East and 7711-14th Avenue currently include tenants 2nd Wind Exercise Equipment and Ace Rent-A-Car; the other properties (formerly Airport Bowl and The Backyard Bar & Grill) have both been vacant for more than five years and have fallen into disrepair. The Comprehensive Plan currently guides these properties for High-Density Residential/Office use and the associated zoning is Mixed Use — Community. Prior to the adoption of the 1-494 Corridor Plan in 2005, these properties were guided for Regional Commercial/Office use and zoned General Business (C-2). As part of the 2005 corridor planning study, market consultants suggested that retail alone in Richfield's 1-494 Corridor would be difficult to sustain due to competition from the Mall of America, Southdale Mall and existing businesses on the south side of the Interstate. Sites designated as Regional Commercial/Office were reduced to those in areas near existing or anticipated major transportation access points (Penn Avenue, Lyndale Avenue, Portland Avenue, and immediately adjacent to an anticipated 77th Street underpass). The properties in question are one block east of a regionally-guided area. International Autos Group has entered into a Purchase Agreement these four properties in order to combine them, demolish the existing structures and construct a new $13 million three-story Audi car dealership and associated parking ramp. The proposed project includes buildings that provide attractive views from both 77th Street and the freeway. Building siting and design meet the requirements of the Mixed Use Districts which include buildings that front on and provide direct access from 77th Street, avoid large blank walls, and utilize high-quality building materials. The proposal also addresses the significant pedestrian and landscaping desires expressed by the Code and Comprehensive Plan through the inclusion of quasi-public amenities. Sidewalks, including a lighted, decorative pedestrian path, will be provided on all four sides and a more than 11,000 square-foot plaza and landscaped area will be constructed along 77th Street. The proposal will more than double the pervious area and will exceed minimum requirements — a rare occurrence for a commercial development. The applicant has requested a phased approach to their build-out in order to better evaluate the size of the parking ramp. At a minimum, the applicant will construct a two-story ramp; however, based on inventory and service needs, this could be increased to four stories. The applicant anticipates creating between 60 and 100 new, high-paying jobs. III. BASIS OF RECOMMENDATION A. POLICY In 2005, the City adopted an 1-494 Corridor Master Plan which has since been incorporated into the City's Comprehensive Plan. The intent of the 1-494 Corridor study and resulting plan was to help ensure the continued investment in and future vitality of this area. It was meant to establish guiding principles that would help create an attractive, dense, walkable and green edge along the City's southern boundary. Regulations were intended to provide for, and take advantage of, opportunities that the visibility along the Interstate could provide - advantages related to an increased and diversified tax base and increased employment opportunity. Regional Commercial designations were limited due to a perceived saturation of the retail market in this area. A car dealership is a unique type of regional retail to which these same rules may not be applicable. State Law and specific franchise requirements largely dictate the location of dealerships and dealerships are a definitive example of"destination retail." While this area was seen as marginal for typical regional retail and therefore guided for housing and office use, the destination component of the proposed use makes regional commercial development possible. Additionally, the City has received a preliminary pledge of funding and is moving forward with a plan to construct the long-awaited 77th Street underpass. This increased access and the potential regional traffic that could now travel along this section of roadway makes it reasonable to reconsider the designation of properties in this area. The Mixed Use Zoning Districts and associated regulations were created to implement the Master Plan vision. These properties are currently zoned Mixed Use — Community and would not allow automobile sales. The applicant has requested a change in zoning to a Planned Unit Development District — Planned Mixed Use —which would be in keeping with the requested Comprehensive Plan amendment. Planned Unit Developments are intended to encourage the efficient use of land and resources and to encourage innovation in planning and building. In exchange for these efficiencies and superior design, flexibility in the application of dimensional requirements is available. There are a number of different sets of review criteria that apply to this proposal. A full discussion of all requirements is included as an attachment to this report. The following variations from standard requirements are requested: Building coverage — Without the multi-story parking ramp, the proposal offers building coverage of 29 percent of the site. Minimum required building coverage in the Mixed Use — Regional District is 50 percent. Building coverage would increase to an estimated 44 percent upon construction of the parking ramp (assumes 24,300 sq.ft. footprint). The applicant could construct a two-story ramp now; however, would prefer to wait and assess their needs once open for business. The applicant has indicated that a ramp would be constructed within five years and is open to a stipulation requiring as much. Current combined building coverage is less than 18 percent. Setbacks — The main building exceeds the maximum side setback along 14th Avenue; however, the proposed design nicely separates parking lots such that there are no huge expanses of pavement. The site design significantly improves compliance with all setback regulations from current conditions. The 15-foot buffer yard requirement adjacent to the apartments to the east is met. Due to the location of a large storm sewer pipe, the buildings cannot be flipped such that this larger setback would abut the apartment building property. A 15-foot landscape buffer is required along 1-494. The proposed buffer yard within the applicant's property boundary ranges from approximately five feet to eight feet; however, there is an extremely large boulevard along this southern edge. Over 18 feet of grass currently exist between the property line and the sidewalk on 78th Street. The applicant has proposed to expand their landscaping into this large boulevard area. Mn-DOT has reviewed preliminary plans and no issues are anticipated. Sign height— The applicant is proposing one freestanding sign along 1- 494 that would exceed the 27-foot District maximum. The proposed sign would be 33-feet tall and is requested in order to be better proportioned with the 48-foot high building facades. This increase is less than that which was approved for the Honda dealership. Lighting — The proposed lighting exceeds City maximums; however, it is significantly lower than typical auto dealership lighting and is similar to that which was approved for Honda. The photometric plan shows that no light from the dealership will spill over to the north side of 77th Street. Decorative pedestrian lighting along the path on the east side of the site pushes light levels over the 1 footcandle limit at the shared residential property line. The applicant is willing to remove pathway lighting; however, Public Safety recommends its installation. The applicant intends to install dimmable fixtures that can further lower light levels if they become a nuisance. Staff recommends that a stipulation of approval require the lights to be dimmed to meet City standards between the hours of 10 p.m. and 7 a.m. daily. Fixture selection will continue to be evaluated by staff and only full cut-off fixtures shall be permitted for non-decorative lighting. Shadows — There are no specific requirements related to solar access for multi-family properties; however, in the interests of full disclosure, staff has asked the applicant to submit a shadow study for the summer and winter solstice. The parking structure will increase shadows significantly over a portion of the apartment parcel. It should be noted; however, that the apartments do not have windows facing west. B. CRITICAL ISSUES The Comprehensive Plan is an expression of the Community's vision for the future. The guide for the 1-494 Corridor reflects the Community's desires for an urban, dense, walkable area with a variety of uses. Specific property designations were based on the market conditions in 2005 and anticipated future conditions. Regional retail was not identified as an undesirable use, but rather was not seen as a viable option in this location. Staff believes that a regional commercial development is compatible with the City's vision for this area and would not be detrimental to future redevelopment. Comprehensive Plan amendments require a four-fifths majority vote by the City Council. Amendments must also be approved by the Metropolitan Council. Most of the requested Zoning Code deviations are minor and relate specifically to the proposed use and particulars of the site. The delayed construction of the multi-story parking ramp is a key consideration for the Commission and Council. Staff recommends approval of the delayed construction (maximum of five years) so that the applicant can fully evaluate future needs. This approval should be conditioned upon the applicant entering into a separate contract with the City which details the timing and potential penalties for non-compliance. Additionally, the applicant will be required to return to the City for an amendment to the Planned Unit Development prior to construction of the parking structure. The proposed multi-story buildings and their architectural design, in addition to the new quasi-public plaza, and 77th Street and 1-494 landscaping will create a site with vastly improved presence from 77th Street and from 1-494. Estimated cost to develop the campus as proposed is $13 million. The proposed project will create 60-100 new, high-paying jobs in the community. Hours of operation: Monday— Friday: 7 a.m. to 8 p.m.; Saturday: 7 a.m. to 6 p.m. Anticipated construction schedule: Phase One: Summer 2015 — Summer 2016; Phase Two: Begin 3-5 years C. RESOLUTION AMENDING THE CITY'S COMPREHENSIVE PLAN CHANGING THE DESIGNATION OF 1400, 1420 AND 1500 — 78TH STREET EAST AND 7711 — 14TH AVENUE TO "REGIONAL COMMERCIAL" WHEREAS, the City's Comprehensive Plan provides a Guide Plan establishing particular planning needs for specific segments of the City; and WHEREAS, the Comprehensive Plan designates 1400, 1420 and 1500 — 78th Street East and 7711 — 14th Avenue as "High-Density Residential/Office;" and WHEREAS, the 1-494 Corridor Plan was prepared based on the market conditions of 2005 and the City and consultants predictions for the future; and WHEREAS, the demand and viability of "Regional Retail" adjacent to the Mall of America and other similar large regional retail destinations was expected to limit the viability of these uses in areas without excellent transportation access; and WHEREAS, current market conditions have changed, a regional transportation connection via the 77th Street underpass is moving forward, and the proposed use is a particular type of destination retail that is less influenced by the proximity of regional malls and similar developments; and WHEREAS, the City has reviewed the Guide Plan classification and determined that it would be appropriate to designate 1400, 1420 and 1500 — 78th Street East and 7711 — 14th Avenue as "Regional Commercial;" and WHEREAS, the Planning Commission conducted a public hearing on March 23, 2015 concerning modifying the Guide Plan and recommended approval of the modifications; and WHEREAS, the City Council considered the amendment on April 28, 2015; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Minnesota that the City's Comprehensive Plan is hereby amended to designate 1400, 1420 and 1500 — 78th Street East and 7711 — 14th Avenue as "Regional Commercial" and is contingent upon the following: 1. RESOLUTION APPROVING A FINAL DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT FOR A PLANNED UNIT DEVELOPMENT AT 1400 — 78TH STREET EAST, 1420 — 78TH STREET EAST, 1500 — 78TH STREET EAST AND 7711 — 14TH AVENUE WHEREAS, an application has been filed with the City of Richfield which requests approval of a final development plan and conditional use permit for a planned unit development to allow construction of a three-story automobile dealership and parking ramp at 1400 — 78th Street East, 1420 — 78th Street East, 1500 — 78th Street East, and 7711 — 14th Avenue, property legally described in the attached Exhibit A; and WHEREAS, the Planning Commission of the City of Richfield held a public hearing and recommended approval of the requested final development plan and conditional use permit at its March 23, 2015 meeting; and WHEREAS, notice of the public hearing was mailed to properties within 350 feet of the subject property on March 10, 2015 and published in the Sun-Current on March 12, 2015 and; and WHEREAS, the requested final development plan and conditional use permit meets those requirements necessary for approving a planned unit development as specified in Richfield's Zoning Code, Section 542.09, Subd. 3 and as detailed in City Council Staff Report No. and WHEREAS, the request meets those requirements necessary for approving a conditional use permit as specified in Richfield's Zoning Code, Section 547.09, Subd. 6 and as detailed in City Council Staff Report No. and WHEREAS, the City has fully considered the request for approval of a planned unit development, final development plan and conditional use permit; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. The City Council adopts as its Findings of Fact the WHEREAS clauses set forth above. 2. A planned unit development, final development plan and conditional use permit are approved for an automobile dealership as described in City Council Report No. , on the Subject Property legally described in Exhibit A. 3. The approved planned unit development, final development plan and conditional use permit are subject to the following conditions: A recorded copy of the approved resolution must be submitted to the City prior to the issuance of a building permit. The property must be platted and the plat recorded prior the issuance of a certificate of occupancy. The property owner must return to the City for approval of a minimum two- story parking ramp within four years of this approval. Construction of said ramp must be complete within five years of this approval. The property owner must negotiate and execute a separate agreement detailing the specific terms and penalties associated this requirement. This agreement must be executed prior to the issuance of a certificate of occupancy. Separate sign permits are required. This resolution constitutes approval of a height (33 ft.) variation only. This variation is for one freestanding sign along 1-494. Light levels may not exceed those proposed in approved plans. Lights must be dimmed to meet City standards between the hours of 10 p.m. and 7 a.m. daily. All new utility service must be underground. All utilities must be screened from public view. Final 77th Street pedestrian lighting plan must be approved by the Public Works Director. A Maintenance Agreement related to lighting must be recorded prior to the issuance of a Certificate of Occupancy. Entire sidewalk along 78th Street must be replaced with new 6-foot walk. Final landscaping plans must be approved by the Directors of Public Works, Community Development and Mn-DOT (where applicable). Full site irrigation, including boulevards, is required. The property owner is responsible for the ongoing maintenance and tending of all landscaping in accordance with approved plans. A Construction and Maintenance Agreement must be recorded prior to the issuance of a final Certificate of Occupancy. The applicant is responsible for obtaining all required permits, compliance with all requirements detailed in the City's Administrative Review Committee Report dated February 26, 2015 and compliance with all other City and State regulations. Minnesota Department of Transportation review required. Applicant must obtain all required permits for work in State right-of-way. Final stormwater management plan must be approved by Public Works Director. Infiltration not allowed in high-vulnerability wellhead protection area. Prior to the issuance of an occupancy permit the developer must submit a surety equal to 125% of the value of any improvements not yet complete. As-builts or $7,500 cash escrow must be submitted to the Public Works Department prior to issuance of a final certificate of occupancy. 4.The approved planned unit development, final development plan and conditional use permit shall expire one year from issuance unless the use for which the permit was granted has commenced, substantial work has been completed or upon written request by the developer, the Council extends the expiration date for an additional period of up to one year, as required by the Zoning Ordinance, Section 547.09, Subd. 9. 5.The approved planned unit development, final development plan and conditional use permit shall remain in effect for so long as conditions regulating it are observed, and the conditional use permit shall expire if normal operation of the use has been discontinued for 12 or more months, as required by the Zoning Ordinance, Section 547.09, Subd. 10. Required Findings Part 1: Development proposals in the Mixed Use Districts shall be reviewed for compliance with the following (537.01, Subd.2): 1. Consistency with the elements and objectives of the City's development guides, including the Comprehensive Plan and any redevelopment plans established for the area. The applicant has applied for an amendment to the Comprehensive Plan that would change the designation of the property from High-Density Housing/Office to Regional Commercial. The intent of the 1-494 Corridor study and resulting plan was to help ensure the continued investment in and future vitality of this area. It was meant to establish guiding principles that would help create an attractive, dense, walkable and green edge along the City's southern boundary. Regulations were intended to provide for and take advantage of opportunities that the visibility along the Interstate could provide - advantages related to an increased and diversified tax base and increased employment opportunity. Regional Commercial designations were limited due to a perceived saturation of the retail market in this area. While this area was seen as marginal for typical regional retail and therefore guided for housing and office use, the destination component of the proposed use makes regional commercial development possible. Additionally, the City has received funding and is moving forward with a plan to construct the long-awaited 77th Street underpass. This increased access and the potential regional traffic that could now travel along this section of roadway makes it reasonable to reconsider the designation of properties in this area and change the guiding of these properties. 2. Consistency with the regulations of the Mixed Use Districts as described by Section 537 of the Code. The proposed development meets the intent of the Mixed Use District regulations. There are both general Mixed Use District regulations and specific criteria that apply to automobile sales businesses and auto-mechanical shops. The proposal deviates from regulations as follows: Building coverage —Without the multi-story parking ramp, the proposal offers building coverage of 29 percent of the site. Minimum required building coverage in the Mixed Use — Regional District is 50 percent. Building coverage would increase to an estimated 44 percent upon construction of the parking ramp assumes 24,300 sq.ft. footprint). The applicant could construct a two-story ramp now; however, would prefer to wait and assess their needs once open for business. The applicant has indicated that a ramp would be constructed within five years and is open to a stipulation requiring as much. Current combined building coverage is less than 18 percent. Setbacks — The main building exceeds the maximum side setback along 14th Avenue; however, the proposed design nicely separates parking lots such that there are no huge expanses of pavement. The site design significantly improves compliance with all setback regulations from current conditions. The 15-foot buffer yard requirement adjacent to the apartments to the east is met. A 15-foot landscape buffer is required along 1-494. The proposed buffer yard within the applicant's property boundary ranges from approximately five feet to eight feet; however, there is an extremely large boulevard along this southern edge. Over 18 feet of grass currently exist between the property line and the sidewalk on 78th Street. The applicant has proposed to expand their landscaping into this large boulevard area. Mn-DOT has reviewed preliminary plans and no issues are anticipated. 3. Creation of a design for structures and site features which promotes the following: i.An internal sense of order among the buildings and uses. The location of buildings, drives, amenities and walkways provide a safe and accessible site that will adequately serve everything from large tractor- trailer delivery trucks to pedestrians. ii.The adequacy of vehicular and pedestrian circulation, including walkways, interior drives and parking in terms of location and number of access points to the public streets, width or interior drives and access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking. See above (i). iii. Energy conservation through the design of structures and the use of landscape materials and site grading. The proposal includes a number of sustainable elements including the specific heating and cooling system that will be used, greatly increased pervious areas and high-efficiency lighting. iv. The minimization of adverse environmental effects on persons using the development and adjacent properties. The proposal includes improved buffering and landscaping along property boundaries, a quasi- public plaza and walkway in addition to removing a number of blighted buildings. Part 2: The following findings are necessary for approval of a PUD application 542.09 Subd. 3): 1. The proposed development conforms to the goals and objectives of the City's Comprehensive Plan and any applicable redevelopment plans. See above — Part 1, #1. 2. The proposed development is designed in such a manner as to form a desirable and unified environment within its own boundaries. See above — Part 1, #3. 3. The development is in substantial conformance with the purpose and intent of the guiding district, and departures from the guiding district regulations are justified by the design of the development. The development is in substantial compliance with the intent of the guiding Mixed Use Districts. Minor deviations from Mixed Use and Performance Standard regulations have been allowed in exchange for superior quasi-public amenities and to accommodate project staging needs. All deviations are consistent with the intent of the MU District regulations. 4. The development will not create an excessive burden on parks, schools, streets or other public facilities and utilities that serve or area proposed to serve the development. The City's Public Works, Engineering and Recreation Departments have reviewed the proposal and do not anticipate any issues. 5. The development will not have undue adverse impacts on neighboring properties. Site improvements are expected to improve overall conditions in this area. Upon construction of the multi-story parking ramp, shadows will be cast onto the property to the east. The Code does not provide specific protections for multi-family developments in regard to solar access and the buildings are oriented such that no windows face the east. The overall impact of the project is expected to be positive. 6. The terms and conditions proposed to maintain the integrity of the plan are sufficient to protect the public interest. The final development plan, which establishes the terms and conditions of the development, meets this requirement. Part 3: All uses are conditional uses in the PMU District. The findings necessary to issue a Conditional Use Permit (CUP) are as follows (Subd. 547.09, Subd. 6): 1. The proposed use is consistent with the goals, policies, and objectives of the City's Comprehensive Plan. See above — Part 1, #1. 2. The proposed use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. The use is consistent with the intent of the Planned Mixed Use District and the underlying Mixed Use Districts. The proposal provides a destination oriented commercial" use at what will be a significantly increased level of density/intensity. The site plan includes pedestrian-oriented building siting, improved landscaping, and attractive public and private spaces with a pedestrian and bicycle friendly character. 3. The proposed use is consistent with any officially adopted redevelopment plans or urban design guidelines. The proposal includes additional pedestrian lighting called for as part of the 77th Street Corridor. 4. The proposed use is or will be in compliance with the performance standards specified in Section 544 of this code. The proposed development is in substantial compliance with City performance standards. Deviation from Code requirements is requested as follows: Sign height— The applicant is proposing one freestanding sign along 1-494 that would exceed the 27-foot District maximum. The proposed sign would be 33-feet tall and is requested in order to be better proportioned with the 48-foot high building facades. This increase is less than that which was approved for the Honda dealership. Lighting - The proposed lighting exceeds City maximums; however, it is significantly lower than typical auto dealership lighting and is similar to that which was approved for Honda. The photometric plan shows that no light from the dealership will spill over to the north side of 77th Street. Decorative pedestrian lighting along the path on the east side of the site pushes light levels over the 1 footcandle limit at the shared residential property line. The applicant is willing to remove pathway lighting; however, Public Safety recommends its installation. The applicant intends to install dimmable fixtures that can further lower light levels if they become a nuisance. Staff recommends that a stipulation of approval require the lights to be dimmed to meet City standards between the hours of 10 p.m. and 7 a.m. daily. Fixture selection will continue to be evaluated by staff and only full cut-off fixtures shall be permitted for non-decorative lighting. 5. The proposed use will not have undue adverse impacts on governmental facilities, utilities, services, or existing or proposed improvements. The City's Public Works and Engineering Departments have reviewed the proposal and do not anticipate any adverse impacts. 6. The use will not have undue adverse impacts on the public health, safety, or welfare. Adequate provisions have been made to protect the public health, safety and welfare. 7. There is a public need for such use at the proposed location. The City's long-term plans call for dense, walkable, well-landscaped development along the 1-494 Corridor. The existing sites have a significant amount of deferred maintenance and it would be a benefit to the City to redevelop this area. 8. The proposed use meets or will meet all the specific conditions set by this code for the granting of such conditional use permit. This requirement is met. The four properties will be re-plated as one lot consisting of 163,135 square feet after additional ROW is dedicated to the city. There is a 20' wide stoim sewer easement extending the entire length of the property in the north south direction. The easement is located east of the center line of the new lot. Proposed Uses and Phases: The proposed uses include a new automobile dealership with new and pre-owned vehicle sales and service. There will be an urban plaza with a water feature and a variety of seating and tables. The plaza will be accessed from 77t' Street E as well as a new pathway connecting 78th Street E to the plaza and 77th Street. Three parking spaces with public charging stations for electric vehicles (EV) also provided. 1 Audi Terminal- Richfield Narrative Revised March 9, 2015 Phase One of this project will include constructing a new three story 94,623 square foot automobile dealership building on the west side of the lot. The urban plaza and the public EV charging stations will also be completed as part of Phase One. Phase One will start construction in the summer of 2015 with approval and will complete in the late spring of 2016. Phase Two will add a parking structure with a minimum of 48,600 square foot and two stories on the east portion of the site. This parking facility may have more than two stories and additional service stalls as the business needs are evaluated. Construction of Phase Two is planned for 3 to 5 years after Phase One. Zoning& Comprehensive Plan: The property is currently guided for High Density Res/Office. The applicant is requesting that the Comprehensive Plan be amended to a Regional Commercial designation. This is consistent with the Regional Commercial about one-half block to the east. It is also consistent with the expected extension of 77th Street under Cedar Avenue. The current zoning for the properties is Mixed Use—Community. The applicant is requesting the zoning be changed to Planned Mixed Use. The green space on the site exceeds the 15% standard at more than 17% including the pervious Urban Plaza. The green space alone is 11.57% of the site. The pathway lighting along the path on the east side of the property can be omitted or dimmed as desired to minimize spill to the adjacent property. I.RECOMMENDED ACTION: By motion: Approve the attached resolution finding that the acquisition and disposition of 6333 16th Avenue and 6401 16th Avenue by the Housing and Redevelopment Authority for eventual redevelopment as multi-family residential is consistent with the Richfield Comprehensive Plan. II. BACKGROUND The property located at 6333 16th Avenue is a vacant property currently listed for sale. The owner of the property at 6401 16th Avenue has approached the Housing & Redevelopment Authority (HRA) to purchase the property. Both properties are located in the Cedar Point redevelopment area and are zoned MR-3, high-density residential. The HRA has submitted a purchase offer to the owner of 6401 16th Avenue. The HRA has also made an offer on 6333 16th Avenue and is waiting to hear from the property owner. There may be sufficient funds to acquire additional properties in this area; which would also come before the Planning Commission for a similar "Finding of Consistency." Once acquired, the HRA plans to retain ownership of the properties until a future date when redevelopment of the area to high-density multiple family housing occurs. III. BASIS OF RECOMMENDATION A. POLICY 6333 16th Avenue and 6401 16th Avenue are currently zoned MR-3 (High-density residential). In 2004 the City completed a redevelopment master plan for the Cedar Avenue Corridor calling for a mixture of multi-family, housing, office and retail development. The Comprehensive Plan incorporates the master plan and 6333 16th Avenue and 6401 16th Avenue are both located within the Plan area. The 2008-2018 Comprehensive Plan identifies the parcels as high-density residential. B. CRITICAL ISSUES The houses are both available for purchase. The HRA approved the purchase of 6333 and 6401 16th Avenue on March 16, 2015. The City's purchases require a finding of consistency with the Comprehensive Plan by the Planning Commission. The purchase of these properties is consistent with the 2008 Comprehensive Plan. The construction of a high density multi-family residential will be consistent with the 2008 Comprehensive Plan. The properties are located within the area impacted by noise generated from the new north/south runway built at the adjacent airport. The master plan and the Comprehensive Plan seek to mitigate the impact of the runway through the redevelopment of single family housing to land uses that are less impacted by the runway. C. FINANCIAL The HRA has development funds that provide sufficient funding to purchase 6333 and 6401 16th Avenue. D. LEGAL Chapter 462 of the Minnesota State Statutes requires that whenever any public agency buys or sells property within the City, the Planning Commission must review the proposed use of the site for consistency with the Richfield Comprehensive Plan. IV. ALTERNATIVE RECOMMENDATION(S) Make a finding that the acquisition and disposition of 6333 16th Avenue is not consistent with the 2008 Richfield Comprehensive Plan. Make a finding that the acquisition and disposition of 6401 16th Avenue is not consistent with the 2008 Richfield Comprehensive Plan. V. RESOLUTION OF THE RICHFIELD PLANNING COMMISSION FINDING THAT THE ACQUISITION AND DISPOSITION OF PROPERTY FOR FUTURE REDEVELOPMENT AS MULTI-FAMILY RESIDENTIAL IS IN CONFORMANCE WITH THE COMPREHENSIVE PLAN WHEREAS, the Planning Commission has reviewed the Comprehensive Plan regarding the acquisition and disposition of property located at 6333 16th Avenue and 6401 16th Avenue and legally described as follows: 6333 16th: Lot 6, Block 1, Iversons 2nd Addition 6401 16th: Lot 1, Block 2, Iversons 2nd Addition WHEREAS, the Planning Commission has found that the acquisition and disposition of the property for future redevelopment as high density, multi-family residential purposes would be consistent with the Richfield Comprehensive Plan; NOW, THEREFORE BE IT RESOLVED, that the Planning Commission finds that the acquisition and disposition of the above described property, for high density, multi-family residential use, is in conformance with the Richfield Comprehensive Plan.
