Planning Commission Minutes November 25, 2013 MEMBERS PRESENT: Chairperson Rick Jabs and Commissioners Susan Rosenberg, Dennis Schuller, Tom Rublein, and Dan Kitzberger MEMBERS ABSENT:Commissioners Josh Root and Gordon Vizecky STAFF PRESENT: Melissa Poehlman, City Planner Matt Brillhart, Planning Technician OTHERS PRESENT: Beth Pfeifer, The Cornerstone Group Terese Reiling, Colliers International Chairperson Jabs called the meeting to order at 7:01 p.m. APPROVAL OF MINUTES M/Rublein, S/Kitzberger to approve the minutes of the October 28, 2013 regular meeting. Motion carried: 5-0 OPEN FORUM No members of the public spoke. PUBLIC HEARING(S) ITEM #1 Consider an amendment to the Planned Unit Development, Conditional Use Permit and Final Development Plan for 6330 and 6400 Lyndale Avenue that would increase allowable restaurant space at the future Lyndale Gardens redevelopment site. City Planner Melissa Poehlman (Poehlman) presented the staff report, recommending approval of an amendment that would allow up to 7,000 square feet of restaurant space. November 25, 2013 In response to a question from Chairperson Jabs, Poehlman stated that the rationale for recommending 7,000 square feet of restaurant space was based on the anticipated size of a restaurant tenant and how the applicant had tentatively divided their tenant spaces. Beth Pfeifer of Cornerstone Group stated that they have a letter of intent from a potential restaurant tenant. She stated that they don't necessarily anticipate that the entire 10,000 square feet of space will be restaurant, but they want the flexibility. She stated that a coffee or ice cream shop would likely have peak parking demand at different hours of the day than a restaurant tenant. Commissioner Rublein stated that it was difficult to assess the risk without more specificity. Pfeifer displayed the site plan of the development and stated that The Cornerstone Group owned an additional parcel "Lot 4" that could be developed or used for parking in the future. In response to a question from Chairperson Jabs, Poehlman stated that the commission would have to base their decision on the proposal in front of them, not including potential future parking. In response to a question from Commissioner Rosenberg, Pfeifer stated that there would not be pedestrian access through Lakewinds Co-op, but there would be pedestrian access through the site, including the public sidewalk on Lyndale. Pfeifer stated that valet parking options would also be explored. In response to questions from Commissioner Rublein, Poehlman stated that restaurant seating/dwell times are accounted for in the Institute of Transportation Engineers (ITE) parking generation standards. Pfeifer stated that the restaurant would be seeking a liquor license. She stated that the City views all restaurants the same, and the request for 10,000 square feet was more about attracting a coffee or ice cream shop in addition to the restaurant. Terese Reiling of Colliers International reiterated Pfeifer's statement that the request for 10,000 square feet was to gain flexibility to attract additional tenants, not necessarily to have 10,000 square feet of sit down restaurant space. She noted that coffee sales peak before 11:00 am and this would match well with a restaurant with peak demand in the evening. In response to questions from Commissioner Rublein, Pfeifer stated that "Lot 4" would be sodded in the interim and not developed as permanent parking. It may be striped for overFlow/valet parking for events in the interim, could be a parking ramp or other development in the long term. Poehlman stated that staff was trying to strike a balance between community expectations and industry standards. In response to a question from Commissioner Schuller, Pfeifer stated that they had looked into other shared parking arrangements in the area to accommodate parking demand. 2 November 25, 2013 M/Rublein, S/Kitzberger to close the public hearing. Motion carried: 5-0 Chairperson Jabs stated that he was comfortable going with the staff recommendation. Commissioner Rublein stated that we was sensitive to the idea that the applicant was seeking flexibility with the request for 10,000 square feet, but he was more comfortable with approving 7,000 square feet for now. Commissioner Schuller stated that it was possible that "Lot 4" could be sold to another property owner in the future. M/Rublein, S/Rosenberg to recommend approval of an amendment to the Planned Unit Development and Conditional Use Permit to allow up to 7,000 square feet of restaurant space. CITY PLANNER'S REPORT 3 November 25, 2013 Poehlman informed commissioners that a joint study session with the City Council will be held on November 26t" to discuss Holy Angels' campus master plan. I.RECOMMENDED ACTION: By motion: Recommend approval of the attached resolution granting approval of a Site Plan that will allow a daycare and pre-school facility servin u to 38 children at 6949 Nicollet Avenue. II. BACKGROUND Rayito de Sol daycare and pre-school is currently operating out of space in Richfield High School, serving 38 children. The space they are currently leasing will no longer be available and they are seeking a more visible and convenient location. They have applied for a permit from the state to operate a daycare and pre-school facility serving up to 38 children at 6949 Nicollet Avenue. A change in the use of a building requires Site Plan approval. This building was previously used as a retail bakery outlet. III. BASIS OF RECOMMENDATION A. PoLicY A change in the use of a building requires Site Plan approval. Daycare uses require one parking space per five enrolled persons. The proposed center will serve a maximum of 38 persons and thereby requires eight parking stalls. The proposed site plan includes nine parking stalls and at least one bicycle parking space. An accessible parking space and loading area must be striped in accordance with ADA requirements. The applicant proposes to relocate the accessible parking space to the front of the building and modify the front stoop accordingly. The site is legally nonconforming with regards to impervious surface coverage. The site is currently 88 percent impervious. The maximum allowed in the C-1 zoning district is 80 percent. There are opportunities to add pervious surFace by strategically replacing portions of the parking lot and existing trash enclosure area with landscaping. The applicant has indicated that they intend to add an outdoor play area, which could potentially bring the site into compliance with this requirement. The applicant will work with staff as their outdoor play area plans come into focus. If an outdoor play area is not added within one year of approval, the applicant will be required to replace the striped parking island with landscaping and/or add additional landscaping to meet requirements. The site requires significant landscaping improvements to come into compliance with the zoning code. At a minimum, a mixture of trees and shrubs shall be planted along the street edge of all parking lots at the rate of one overstory tree for every 40 feet of street frontage (on average) plus 25 percent of the ground covered by shrubs and/or perennials. The view to the parking lot should be screened to a height of three to four feet. These requirements may be met through boulevard plantings under a permit from the Public Works department. Final landscaping plans must be approved by staff. The City will retain a landscape escrow to ensure that improvements to site are made within one year of approval. In evaluating a site plan, the Planning Commission and Council shall consider its compliance with the seven criteria outlined in Subsection 547.13 of the City Code and further articulated in the attached document. B. C TICaL IssuEs Staff recommends approval based on compliance with all criteria. The applicant is responsible for obtaining all required permits, compliance with all requirements detailed in the City's Administrative Review Committee Report and compliance with all other City and State regulations. Permits are required prior to the commencement of any work. C. FnvANCInL The required processing fee has been paid. D. LE AL Notification: Properties within 350 feet were notified by mail. Due to staff error, notice of this meeting was not published in the Sun Current in accordance with State and Local requirements. Therefore, an official public hearing will be held in concurrence with the City Council meeting scheduled for January 14, 2014. IV. ALTERNATIVE RECOMMENDATION S Recommend denial of the proposed Site Plan and change in use with a finding that the proposal does not meet Code requirements. V. RESOLUTION GRANTING APPROVAL OF A SITE PLAN TO ALLOW A COMMERCIAL DAYCARE AND PRE-SCHOOL FACILITY AT 6949 NICOLLET AVENUE WHEREAS, an application has been filed with the City of Richfield which requests approval of site plan to allow a commercial daycare and pre-school facility serving up to 38 persons for the parcel of land located at 6949 Nicollet Avenue and legally described in the attached Exhibit A; and WHEREAS, the requested site plan has been reviewed by the City Council and meets City requirements; and WHEREAS, the proposed site plan will adequately serve the purpose for which it is proposed and will not have an adverse effect upon the public safety or general welfare; and WHEREAS, the City has fully considered the request for approval for the site plan. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. The City Council adopts as its Findings of Fact the WHEREAS clauses set forth above. 2. A site plan for a commercial daycare and pre-school facility serving up to 38 persons as described in City Council Report No. , on the Subject Property legally described above is approved. 3. The approved site plan is subject to the following conditions: Plans to reduce existing impervious surFace in order to meet or approach current standards must be in place within one year of the date of this approval. All improvements must be complete within 18 months. Required plantings screening the parking lot must be continuously maintained; All trash must be stored inside the building; Parking lot must be re-striped in accordance with the approved plan, including one accessible parking space and loading area and at least one bicycle parking space; All required parking must be available year-round. Required parking may not be used for the storage of snow or other items/equipment. The applicant is responsible for obtaining all required permits, compliance with all requirements detailed in the City's Administrative Review Committee Report and compliance with all other City and State regulations. Permits are required prior to the commencement of any work; Prior to the issuance of an occupancy permit the developer must submit a surety equal to 125% of the value of any improvements not yet complete. This approval shall expire one year following the date of approval unless the use has commenced or a building permit has been obtained and construction begun.
