Planning Commission CITY OF MinutesRICHFIELD August 27, 2012 MEMBERS PRESENT: Chairperson Rick Jabs and Commissioners Robert Hall, Josh Root, Tom Rublein, Maureen Scaglia, Dennis Schuller and Gordon Vizecky MEMBERS ABSENT:Commissioner Dan Kitzberger STAFF PRESENT: John Stark, Community Development Director OTHERS PRESENT: None Chairperson Jabs called the meeting to order at 7:00 p.m. APPROVAL OF MINUTES M/Rublein, SNizecky to approve the minutes of the July 23, 2012 Regular Meeting and the August 6, 2012 annual bike/walking tour. Motion carried: 7-0 OPEN FORUM No members of the public spoke. PUBLIC HEARING(S) ITEM #1 12-CUP-07 — Consideration of a Conditional Use Permit to allow lighted ballfields and new buildings, bleachers and a backstop at 7001 Harriet Avenue South Richfield High School). Community Development Director (Director) Stark presented the staff report. Chairperson Jabs opened the public hearing. Commissioner Rublein inquired about the intensity of a typical streetlight as compared to the proposed ballfield lighting. Richfield Public School's (RPS) engineer, Craig August 27, 2012 Gallup answered that a typical streetlight emits approximately 3-4 foot candles of light in comparison to the 0.3 foot candles estimated to spill onto the adjacent residential properties from the proposed ballfield lighting). Commissioner Scaglia asked whether night games are anticipated. RPS Business Manager answered that there are no specific plans for night games at this point. The lights are being proposed because other improvements are being contemplated and it is more cost effective to add lights in conjunction with those improvements than to add them later if needed. Commissioner Scaglia asked if RPS intends on renting out the fields in the future. Mr. Schwartz said that this is a possibility and that the fields currently host American Legion baseball in addition to Richfield High School baseball. Commissioner Rublein asked whether the school district could use Donaldson Park which is lighted). Mr. Schwartz replied that this would be subject to City approval. Commissioner Rublein pointed out that it is logical to assume that the lights will be used in the future. Chairperson Jabs asked whether there is an hour at which the lights would be required to be turned off. Mr. Schwartz was not aware of any such requirement. Commissioners discussed the merits of adding a condition limiting the hours of lighting; it was the consensus that lighting at City Parks is extinguished no later than 11 p.m. Commissioner Hall asked if increased attendance is anticipated and, if so, asked how additional parking needs would be met. Mr. Schwartz replied that they are hoping for increased attendance, but have no immediate plans to add parking. Commissioner Hall asked how the impacts of the improvements would be mitigated or buffered (as is a requirement of a CUP). RPS Facilities Manager Russ George answered that the fact that the surface of the playing fields are 6 feet below grade lessens any impact. Commissioner Schuller sought information about the school district's decision making process for planning the improvements. Mr. Schwartz indicated that the project began with a grant application drafted by members of the high school's athletic department for ballfield improvements. M/Vizecky, S/Rublein to close the public hearing. Motion carried: 7-0 Commissioners continued discussing the application. Commissioner Rublein suggested that the item should be continued due to lack of information available from the applicant; Commissioner Hall agreed. Mr. Schwartz added that a delay would result in spring 2013 construction instead of fall 2012 and that the project must be completed by July 31, 2013 in order to meet grant requirements. 2 August 27, 2012 Chairperson Jabs stated that he does not believe that the impacts are mitigated because the level of impact (frequency and hours of field usage) is so uncertain. Mr. Schwartz responded by stating that there would not be any more Richfield High School games played in a season than is currently the case. M/Root, SNizeecky to recommend approval of the staff-recommended resolution. M/Hall, S/Scaglia to amend the motion to add a limit on the permitted hours of lighting. Motion carried: 7-0 The meeting was adjourned by unanimous consent at 8:01 p.m. Josh Root Acting Secretary 3 AGENDA SECTION: PUBLIC HEARING AGENDA ITEM# 1 REPORT# 15 CASE# 1111 PLANNING COMMISSION STAFF REPORT RICHFIELD PC MEETING DATE: OCTOBER 22, 2012 ITEM FOR PLANNING COMMISSION CONSIDERATION: Public hearing to consider an amendment to the City's Zoning Ordinance. The proposed change will clarify the way in which the height of a building with a gable, hip or gambrel roof is measured. This amendment does not constitute a change in policy. I.RECOMMENDED ACTION: Conduct and close a public hearing and by motion: Recommend approval of the attached ordinance amending Subsection 507.07, Subdivision 53 related to the definition of building height. II. BACKGROUND City staff continually monitors and notes areas of the Zoning Code that may require review. The proposed change does not constitute a policy change, but rather clarification of an existing rule. Building height is currently defined as follows: The vertical distance to the highest point of the roof for flat roofs; to the deck line for mansard roofs; and to the average height between eaves and the ridge for gable, hip and gambrel roofs, as measured from the average elevation of the lot adjoining the front building line." It has come to staff's attention that the definition does not specify which eave or eaves shall be used to calculate the height of gable, hip and gambrel roofs. Homes with multiple peaks at varying heights could potentially exceed the intended height limit. III. BASIS OF RECOMMENDATION A. POLICY The regulations of the Zoning Code are intended to promote harmonious relationships among land uses and to ensure that public and private lands ultimately are used for the purposes that are most appropriate and beneficial from the standpoint of the City as a whole. Ongoing review and periodic updating of the Code is necessary to ensure that regulations are serving their intended purposes. B. CRITICAL ISSUES There is an important balance that must be maintained to protect property and promote investment throughout the City. Simple errors can lead to misunderstandings and potentially unintended consequences if not corrected. C. FINANCIAL N/A D. Other Actions: Council: The recommendation of the Planning Commission will go to the City Council for two readings. AMENDMENT TO RICHFIELD CITY CODE SUBSECTION 507.07, SUBDIVISION 53 RELATED TO THE DEFINITION OF BUILDING HEIGHT THE CITY OF RICHFIELD DOES ORDAIN: Section 1 Subsection 507.07, Subdivision 53 of the Richfield City Code is amended to read as follows: Subd. 53. Debbie Goettel, Mayor ATTEST: Nancy Gibbs, City Clerk AGENDA SECTION: PUBLIC HEARING AGENDA ITEM# 2 REPORT# CASE# 12-ASP-03 11 PLANNING COMMISSION STAFF REPORT RICHFIELD PC MEETING DATE: OCTOBER 22, 2012 ITEM FOR PLANNING COMMISSION CONSIDERATION: Public hearing to consider a Site Plan Amendment that would allow construction of a 900 square foot building addition at 609 74th Street West. I.RECOMMENDED ACTION: Conduct and close a public hearing and by motion: Recommend approval of the attached resolution to permit a Site Plan Amendment for a building addition at 609 74th Street West. II. BACKGROUND Last year the City Council approved the rezoning of the property at 609 74th Street West from Multi-Family Residential (MR-2) to Service Office (SO) to allow for low- intensity business use. The building is now used as a sales and service office for Nichols Electronics, which sells and services electronic music boxes for ice cream trucks. No retail sales take place, or are permitted, at this location. The building also serves as the registered business office of the owner's real estate holding companies. Owner Mark Nichols is proposing a 900 square foot addition to the south side of the building. The building addition will be constructed in a portion of the existing parking lot and will eliminate five surplus parking spaces. Architecturally, the addition will be constructed to match the existing structure. III. BASIS OF RECOMMENDATION A. POLICY The existing eastern setback (adjacent to a duplex) shall be maintained at 20 feet minimum requirement is 5 feet). The rear setback (adjacent to Woodlawn Terrace Mobile Home Park) shall be reduced from 56.7 feet to 26.7 feet (minimum requirement is 5 feet). The expanded building requires 9 parking stalls; the proposal includes 16 parking stalls. The proposed building addition will not increase impervious surface because it will be constructed in an area that is currently used for parking. The site remains in compliance with all other Code requirements. In evaluating a site plan, the Planning Commission and Council shall consider its compliance with the seven criteria outlined in Subsection 547.13 of the City Code and further articulated in the attached document. B. CRITICAL ISSUES Staff recommends approval based on compliance with all criteria. The applicant is responsible for obtaining all required permits, compliance with all requirements detailed in the City's Administrative Review Committee Report and compliance with all other City and State regulations. Permits are required prior to the commencement of any work. C. FINANCIAL The required processing fee has been paid. D. LEGAL Notification: Notice of this public hearing was published in the Sun Current in accordance with State and Local requirements. Residents and property owners within 350 feet were notified by mail. IV. RESOLUTION GRANTING APPROVAL OF A SITE PLAN AMENDMENT FOR 609 74TH STREET WEST WHEREAS, an application has been filed with the City of Richfield which requests approval of site plan amendment for the parcel of land located at 609 74th Street West, legally described as: The west quarter of the north 5 acres of the Northwest Quarter of the Southwest Quarter of Section 34, Township 28, Range 24 except the west 175 feet thereof, Hennepin County, Minnesota WHEREAS, the requested site plan amendment has been reviewed by the City Council and meets City requirements; and WHEREAS, the proposed site plan will adequately serve the purpose for which it is proposed and will not have an adverse effect upon the public safety or general welfare; and WHEREAS, the City has fully considered the request for approval for the site plan amendment; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. All landscaping, including fences, must be continuously maintained and not be unsightly in appearance or in a state of disrepair; 2. All trash must be stored inside the building; 3. The applicant is responsible for obtaining all required permits, compliance with all requirements detailed in the City's Administrative Review Committee Report and compliance with all other City and State regulations. Debbie Goettel, Mayor ATTEST: Nancy Gibbs, City Clerk Site Plan Approval Requirements Subsection 547.13 a) Consistency with the various elements and objectives of the City's long range plans, including, but not limited to, the Comprehensive Plan; With the addition, the building will have a gross floor area of 2,038 square feet and continued use for a low-intensity service business is planned. This is consistent with the Neighborhood Commercial designation. b) Consistency with the purposes of the Zoning Code; The proposal is in keeping with the purpose of the Zoning Code and the Service Office District. This District is intended to provide locations for low-intensity, small office businesses in a residential neighborhood setting. c) Preservation of the site in its natural state, insofar as practicable, by minimizing tree and soil removal, and designing any grade changes so as to be in keeping with the general appearance of neighboring developed or developing areas; The building addition will be constructed entirely upon area that is currently used for parking. All current landscaping shall remain intact and no grade changes are proposed. d) Creation of a harmonious relationship of buildings and open spaces with the terrain and with existing and future buildings having a visual relationship to the proposed development; The building addition will extend along the existing eastern setback and the exterior will be constructed to match the existing façade. Little visual impact is anticipated from any direction. e) Creation of a functional and harmonious design for structures and site features including: i. Creation of an internal sense of order for the various functions and buildings on the site and provision of a desirable environment for occupants, visitors and the general community; ii.Appropriateness of the amount and arrangement of open space and landscaping to the design and function of the development; iii. Appropriateness of the materials, textures, colors and details of construction as an expression of the design concept of the project and the compatibility of the same with the adjacent and neighboring structures and functions; and iv. Adequacy of vehicular, cycling and pedestrian circulation, including walkways, interior drives and parking, in terms of location and number of access points to the public streets, width of interior drives and access points, general interior circulation, separation of pedestrian, cycling and vehicular traffic and arrangement and amount of parking so as to be safe, convenient and, insofar as practicable, compatible with the design of proposed buildings, structures and neighboring properties. A southern extension of the building will have little to no impact on the site or the surrounding neighborhood. Selected materials will match the existing building and parking shall remain in excess of requirements. There will be no changes to the amount of impervious surface or to the existing landscaping. f) Creation of an energy-conserving design through design location, orientation and elevation of structures, the use and location of glass in structures, and the use of landscape materials and site grading; Given that the proposal is an addition to an existing structure, there is limited opportunity to address issues of building orientation, etc. Open space requirements are exceeded. g) Protection of adjacent and neighboring properties through reasonable provisions for such matters as surface water drainage, sound and sight buffers, preservation of views, light and air, and those aspects of design, not adequately covered by other regulations, which may have substantial effects on neighboring land uses; No changes to surface water drainage, sound and/or sight impacts, views, etc. are anticipated.
