05-9585r 185 RESOLUTION NO. 9585 RESOLUTION AUTHORIZING AN AMENDMENT TO A CONDITIONAL USE PERMIT 6600 Nicollet Avenue WHEREAS, an application has been filed with the City of Richfield which requests approval of an amendment to a Conditional Use Permit for a private high school on land generally located at 6600 Nicollet Avenue, legally described as: The north % of the northeast % of the southwest % of section 27, township 28, range 24, excluding roads and excluding the west 25 feet thereof. WHEREAS, the Planning Commission of the City of Richfield has recommended approval of this requested amendment to a Conditional Use Permit at 6600 Nicollet Avenue at its January 10, 2005 meeting; and WHEREAS, this requested amendment to a Conditional Use Permit at 6600 Nicollet Avenue meets those requirements necessary for issuing a CUP as specified in Richfield's Zoning Code, section 546.05, subd.6; and WHEREAS, the City has fully considered the request for approval of the amendment to the Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. An amendment to the Conditional Use Permit is issued for the expansion of the Seasonal Sports Facility (StarDome) hours to 12:30 a.m. daily at a private high school, as described in City Staff Report 34, on the Subject Property legally described above. 2. The amended Conditional Use Permit shall remain in effect for so long as conditions regulating it are observed, and the amended Conditional Use Permit shall expire if normal operation of the use has been discontinued for 12 or more months, as required by the Zoning Ordinance, Section 546.05, Subd.9 Adopted by the City Council of the Cit...y of ~...i..~~!i;.ld, M.in. nr~ta \his ~.. h day of February, 2005.
