Issue Statement:
Public hearing of an ordinance to vacate a portion of public
right-of-way on the northwest corner of 67th Street and Sheridan
Avenue.
Background:
The property owner of 6644 Sheridan Avenue has requested
that the city vacate a portion of the unimproved right-of-way
at the northwest corner of 67th Street and Sheridan Avenue.
The property owner wishes to add on to the front of the existing
dwelling on the site but cannot do so without obtaining a
variance to the city's front yard setback requirement of
30 feet because of the unusual way in which the property
was platted. In this particular subdivision (Tingdale Brothers
Lincoln Hills Addition) all the corner lots are not rectangular
and have a curve adjacent to the intersection. This has
resulted in there being an extra amount of boulevard area
adjacent to the intersection when compared to a majority
of the residential intersections in the city. The new addition
would have a setback of approximately 10 feet from the "current"
right-of-way line.
The property owner does not wish to apply for a variance
because of the expense involved and as an alternative, has
requested the vacation of the extra right-of-way area. If
a normal right-of-way line had been draw, no variance would
be required.
The City Council on February 23, 1987 gave first reading
to the ordinance and has referred the matter to the Planning
Commission for review.
Recommendation:
It is recommended that the Planning Commission find the ordinance
vacating a portion of the right-of-way consistent with the
Comprehensive Plan and that the right-of-way to be vacated
serves no necessary public purpose. It is further recommended
that the commission recommend that the council pass the ordinance
necessary to vacate the portion of right-of-way as requested.
Basis of Recommendation:
The right-of-way to he vacated is not needed. There will be
sufficient Coulevard area maintained to provide for sufficient
snow storage and other purposes. The street itself would
continue to exist as shown in the Comprehensive Plan. The
process Ceing followed and the actions recommended are consistent
with the process for vacating streets outlined in ordinance
12.04.
Alternative Recommendation:
The alternative recommendation would be to deny the ordinance
vacating the street and require the property owner to go throughthevarianceprocess.
Decision Mode:
A public hearing is scheduled before the Planning Commission on
Tuesday, March 5, 1987 at 7:30 PM. The hearing will take place
at the Council Chambers, Richfield City Hall. Mailed notice of
the hearing has Been provided to property owners within 350 feet.

AN ORDINANCE PROVIDING FOR
THE VACATION OF A PORTION OF
WEST 67TH STREET AND SHERIDAN AVENUE
CITY OF RICHFIELD DOES ORDAIN:
Section 1. The following described public street is hereby vacated:
Those portions of West 67th Street and Sheridan Avenue bounded on the
east by the following described LINE A, on the south b;r the following
described LINE B, and on the northwest by the southeasterly lot line
of Lot 14, Block 4, Tingdale Brothers Lincoln Hills:
LINE A: Commencing at the northeast corner of said Lot 14, thence
southerly along the easterly lot line of said Lot 14 a distance of
3.7 feet, thence continuing southerly along an extension of the
aforesaid portion of said easterly lot line to the point of
intersection with LINE B and there terminating.
LINE B: Commencing at the southwest corner of said Lot 14, thence
easterly along the southerly lot line of said Lot 14 and distance of
81.3 feet, thence continuing easterly. along an extension of the
aforesaid portion of said southerly lot line to the point of
intersection with LINE A and there terminating.
Section 2. This street vacation shall not effect, destroy, or interfere with
the right of any person, corporation or municipality owning or having control
of any utility located within the vacated right-of-way to operate, repair,
maintain, reconstruct or remove any public utility facilities upon or within
the vacated right-of-way.

Issue Statement•
Consideration of a resolution to extend the interim ordinance
which restricts the issuance of building permits in the ILN
Redevelopment area an additional 6 months.
Background:
On March 2, 1987, the Planning Commission, City Council and
HRA discussed a strategy for the ILN area to protect and
carry out the redevelopment plan which resulted from an extensive
public planning effort. This strategy involves three actions:
1. Extension of the interim ordinance which restricts
the issuance of building permits in the area.
2. Development and implementation of a new zoning district
which would require that new development meet minimum
standards for lot size and floor area ratios. Height
restrictions to prevent shadows on single family
and two family dwellings would also be included.
3. Preparation and distribution of a request for development
proposals to identify and select a developer or
developers to redevelop designated areas south of
77th Street over a period of years.
A public hearing has been scheduled before the Planning Commission
to consider implementation of the first part of the strategy,
the extension of the interim ordinance.
Recommendation:
It is recommended that the Planning Commission conduct a
public hearing on this matter and then recommend City Council
approval of the attached resolution extending the interim
ordinance an additional 6 months or until the effective date
of the ordinance creating the new zoning district and the
developer selection process is complete whichever is sooner.
Basis Of Recommendation:
The recommendation is based on the following conclusions:
1. A significant amount of time and investment by the
city and various citizen groups has resulted in
a redevelopment plan for the ILN area. The development
opportunities provided by this plan are unique and
must be managed to realize the potential and goals
of the plan. Based on general market conditions
and our experience in the Lyndale/Hub/Nicollet area
it will take a number of years to accomplish these
goals.
2. The new zoning district and the developer selection
process are necessary to insure that the development
which occurs in the area is well planned integrated
development of sufficient density to meet the goals
of the redevelopment area, to protect surrounding
residential areas, to improve the tax base of the
city, and to have successive projects within the
market place.
3. The extension of the interim ordinance is necessary
to permit sufficient time for the city to draft,
process, and approve an ordinance amendment to create
the new zonig district and to implement a developer
selection process.
If the permit restrictions lapse development may
occur which is not consistent with the goals of
the ILN redevelopment plan and make it more difficult
and expensive to bring about the type of well planned
integrated development called for in the redevelopment
plan adopted by the city.
Alternate Recommendation:
The alternate recommendation would be to let the interim
ordinance terminate and the basis for issuing permits would
return to that which existed prior to the intitation of the
planning process.
Discussion/Decision Mode:
The interim ordinance expires March 22, 1987. The City Council
is scheduled to consider the resolution extending the interim
ordinance at a public hearing on March 9, 1987. A hearing
is scheduled before the Planning Commission on March 5, 1987.
Notice of the Planning Commission and City Council hearings
on this matter was mailed to property owners and tenants
in and around the ILN area and was also published in the
Richfield Sun newspaper.

A RESOLUTION EXTENDING THE EFFECTIVE PERIOD
OF TRANSITORY ORDINANCE N0. 17.18 F_NTITLED
AN INTERIM ZONING ORDINANCE ADOPTED FOR
THE PURPOSE OF PROTECTING THE PLANNING
PROCESS IN A CERTAIN AREA OF THE CITY,
REGULATING, RESTRICTING AND PROHIBITING
CERTAIN USES, DEVELOP~gENTS AND SUBDIVISIONS
WITHIN SUCH AREA".
8E IT RESOLVED, by the city council of the City of Richfield as
follows:
1. It is hereby found and determined:
A. Many of the conditions which led to the adoption of
Transitory Ordinance No. 17.18 continue to exist.
8. Substantial progress has been made on planning the
future development and/or redevelopment of the
Interstate-Lyndale Area, which is the subject of
that ordinance.
C. Such planning was significantly influenced by a
proposal for the development of the so-called
Cloverleaf Motel property" lying west of and
adjacent to Emerson Avenue between 76th and 78th
Streets.
D. The owner and developer of the Cloverleaf Motel
property is currently reexamining its plans and
proposals, in an effort to develop the property in a
manner generally acceptable to the owners of
neighboring properties.

F. There is a need to formulate, consider and adopt
ordinance amendments which will be applicable to the
development and/or redevelopment of the Interstate-
Lyndale Area so as to assure a desirable intensity

with developers to insure that development is
consistent with the goals of the ILN Redevelopment
Plan.
N. It appears that a continuation of the planning
process, taking into account any revisions in the
plans for the development of the Cloverleaf Motel
property, will be of Benefit to the area and the
city at large.
I. The continuation of the planning process and the
protection of it can test be accomplished by the
extension of the effective day of Transitory
Ordinance No. 17.18.
2. The effective period of Ordinance No. 17.18 is hereby
extended for a period of six months from the anniversary of its
effective date, i.e., the ordinance is continued in effect until
September 22, 1987 or until the effective date of the ordinance
amendment containing regulations to assure that a desirable
intensity, kind and arrangement occurs in the area and a
developer selection process is complete whichever is sooner.
