ITEM ~I, PLANNED UNIT DEVELOPMENT, CDR - 35W AND 494.
Mr. Rick Jopke presented the staff report.
Mr. Jopke stated that the developer had not finalized the phasing
as of yet and would like to include the hotel in phase one of the
project. Mr. Jopke stated that staff felt because of the
possibility of the hotel being included in phase one, extra time
is needed to answer all the questions and to coordinate the ILN
public improvements with the CDR project.

Mr. Jopke reviewed the background information on the ILN area and
the CDR project. Mr. Jopke indicated that the plan departs from
normal ordinance requirements and PUD ordinance guidelines

Commissioner Jensen inquired whether, with a PC-2 zoning, the
city could regulate the areas of tree buffers. Mr. Jopke stated
that if future development would occur on the site the changed
plans would have to come back to the city far approval before any
permits could be issued.
Commissioner Lunas indicated that he would like to have
information on solar access. Mr. Jopke stated that he would
write a summary of the state solar access guidelines.
Commissioner McDermott inquired whether the PUD would be ready on
December 30th, and whether the developer has all the information
together. Mr. Jopke stated that if the Planning Commission is
not satisfied with the information provided, they could defer the
PUD again. Mr. Prosser stated that the Planning Commission
should set the time frame and if they have any concerns to let
staff know so they can find out or clarify the issue. If
information cannot be provided by December 30th the decision can
be delayed. Mr. Prosser stated that the parking issue for the
most part is resolved, but staff is recommending that an
agreement between the city and the developer be signed so that
the city has the ability to go back to the developer if parking
does not satisfy the demand.
Mr. Hoffman stated that the developer would also like to have all
the information together.
Commissioner Lunas inquired if there was a problem with Girard
Avenue coming into the site, with access to the apartments.
Access must he protected to the apartment buildings.
The Planning Commissions concerns were as follows:
1. Parking - when, where and how much
2. Hotel issue (Phasing)
3. Surface drainage
4. Sanitary sewer capacity
5. Traffic
6. Assurance of trees - landscaping.
Commissioner Quam would like all aspects of the PUD ordinance
addressed and complied with.
Commissioner McDermott stated that another question she would
like answered is where would extra parking, if needed, would go
on the site in the future.

Issue Statement:
Review of a draft ordinance amendment concerning auto detailing
uses in C-1 zoning districts.
Background•
In November of 1986 the City Council denied an appeal of a staff
interpretation that auto detailing uses were not permitted in C-1
limited Business Districts. The appeal related to the property
at 7301 Penn Avenue. The Council also directed the City
attorney's office to draft an ordinance amendment which would
permit auto detailing uses in C-1 Limited Business districts Ly
special use permit. Attached for your review is the ordinance
drafted Ly the city attorney's office.
The draft ordinance indicates that auto detailing uses would Le a
permitted use in C-1 districts if a license is first oLtained
from the city. The ordinance revision then sets up conditions
and requirements which must Le met for obtaining a license to
operate an auto detailing use in the city.
Staff Recommendation:
It is recommended that the Planning Commission review this draft
ordinance and make a recommendation to the City Council
Basis of Recommendation:
It is staff's opinion that this particular approach will give the
city maximum control over this type of use. It was felt that the
licensing approach would Le Letter than a special use permit
approach because licenses are renewed annually where as special
use permits are not required to Le renewed. Through this annual
renewal process the city can determine if the particular use
continues to meet all the conditions set forth in the ordinance
or which were placed on the approval of the license.

We believe that this is preferable to a "pure zoning"
approach because it will give the City an ongoing oppor-
tunity to police the activity after the use is initially
established. Because C-1 districts directly relate to
residential neighborhoods, licensing will give the City
an opportunity to determine on a periodic basis whether
the activity continues to operate as originally antici-
pated. If it fails to do so, the controls of license
suspension, revocation or non-renewal will likely be more
effective than attempting to terminate a special use
permit. rloreover, the license fee can be set at a level
to cover the City's anticipated costs in the ongoing
review.
You will note that I have not suggested a license fee. I
would ask that l~ou determine an amount. Once that is
done, I will prepare the Appendix D resolution
establishing that fee.
As a final comment, I must remind you of our concern
about whether this type of use is appropriate for a C-1
district. In theory, I doubt that it is the typical sort
of neighborhood use which is best suited for the C-1
district. In practice, however, it does seem to
partially address the problem of what to do with old

CITY OF RICHFIELD DOES ORDAIN•
Chapter III, Part IV, Section 3.32, Subdivision 1 of the
Ordinance Code is hereby amended in the following respects:
I. By adding to said subdivision 1 of Section 3.32 the
following new paragraph (4):
4) Automobile Detailing Establishments,
meeting the definition contained in '
section 6.24 of tr,is Code, which have a
current and valid license issued under
that section."
2. By renumbering the paragraphs in subdivision 1 of
section 3.32 accordingly.

OF THE ORDINANCE CODE OF
THE CITY OF RICHFIELD
City of Richfield Does Ordain:
Chapter VI of the Ordinance Code of the City of Richfield -.
entitled "Business and Trade Regulation and Licensing" is amended
by adding thereto the following new section:
6.24. Automobile Detailing Establishments.
Subdivision 1. Definitions. The following terms shall have
the meanings ascribed to them in this section:
1) "Automobile Detailing Establishment" means a business
activity where, for a fee, automobiles, including compo-
nents and parts are cleared and refurbished. The term does
not include the repair or replacement of parts or
components, oil changing or lubrication, painting other than
minor touch-up, sale of fuel or automobile parts,
accessories or products.
2) "Automobile" means a motor vehicle exclusively designed and
equipped to transport its driver and passengers. The term
includes a van which is so equipped, but does not include
trucks, busses or motor homes.
Subd. 2. License Required. No person shall operate an
automobile detailing establishment without having first obtained
a current and valid license to do so. Except as hereinafter
provided, operation without a license is a misdemeanor.
Subd. 3. Application. Any person desiring to engage in the
business of operating an automobile detailing establishment shall
submit an application for license to the City Clerk. The appli-
cation shall be on a form prepared by the City Clerk and shall
contain the following:
1) The applicant's name, age, residence and whether
applicant is a registered voter of the city. If the
applicant is a partnership, the names of all partners
verified by one such partner. If the applicant is a
corporation, the names of all the officers verified by
one such officer.

Issue Statement: Upcoming Organizational Meeting
The Planning Commission eylativs require that the Planning
Commission hold an annual organizational meeting and elect from
its memdership a chairperson, a vice-chairperson, and secretary
at the first regular meeting in February. The organizational
meeting for 1987 is scheduled for the regular meeting which will
e held Fedruary 24, 1987. The commission should he prepared to
conduct such an election at the February 24th meeting.
Also at the organizational meeting the Planning Commission
reviews the Planning Commission Bylaws and determines if any
amendments ors necessary. If it is determined that Bylaw changes
are necessary, the proposed amendments need to Ce written into
the minutes for consideration at a future meeting. It is
recommended that the commission review the attached Cylaws and
determine if any bylaw changes are necessary so that they can he
put into the minutes of the January 27th meeting and he
considered at the organizational meeting on February 24, 1987.
The third item that occurs at the organizational meeting is the
appointment of liaisons to the Community Services Advisory
Commission, City Council, HRA and School Soard. The commission
should also Ce prepared to make those appointments on February
24th.

BYLAWS AND RULES OF PROCEDURE
OF IHE CITY PLANivING COP~'IISSION
RICHii'IELD, MINNESOTA
The following by laws and rules of procedure are adopted by the City Planning
Commission to facilitate the performance of its duties and functions as
empowered under Chapter III, Part VII, Section 3.58, Subdivision 1-9 of the
city ordinance code.
PART I. i~'iEETINi~S
Section 1. Regular i~Ieetin~s
Regular meetings of the Planning Commission shall be on the fourth
Tuesday of each month commencing at 7:30 PM in tip council chambers of
the city hall.
Section 2. ueneral Planning I~Ieetings
The second Tuesday of every month shall be reserved for discussing and
deliberating on general planning matters related to the proper
development and future well-being of the community.
Section 3. Special Meetings
Special meetings of the planning commission can be called by the
chairperson and one member or by three members of the commission or at
the request of the city council. Notice, designating the time and
place of the meetings, shall be given to all members not less than
twenty-four (24) hours in advance thereof.
Section 4. Deadline for Hearing Items
The planning commission will accept all applications to be heard
before it, no later than fifteen working days preceding the regular
planning commission meeting. Upon written notice to the community
development director prior to the planning commission meeting, an
application may be withdrawn. Once an application is withdrawn, it
must be refiled with the Community Development Department, City of
Richfield, before any planning commission hearing is held.
Section 5. Quorum
Five members of the planning commission shall constitute a quorum for
tY~ transaction of business. No action shall be taken in tl~ absence
of a quorum with the exception that the planning commission members
present may take testimony for use at a later meeting at which a
quorum is present, and may adjourn a meeting to a later time without
further notice.

In the event that the secretary is absent from a meeting, the
chairperson shall appoint a member of the commission to approve the
minutes of that meeting.
Section 2. Tenure
The chairperson, vice-chairperson, and secretary shall take office
immediately following their election and hold office until their
successors are elected and assume office.
Section 3. Duties of Officers
The duties and powers of the officers of the planning commission shall
be as follows:
a) Chair erson
1 Presides over all meetings of the commission.
2) Appoints committees and performs such other duties as may
be ordered by the commission.
3) Signs documents of tree commission
4) Sees that all actions of the commission are properly
taken.
5) Calls special meetings of the commission in accordance
with these bylaws.
6) Works with appropriate city staff in organizing
agendas of all general planning commission meetings.
b) Vice-Chairperson
Performs all of the duties and responsibilities of the
chairperson in his/her absence.
c) Secretary
1) Assumes duties and responsibilities of the chairperson
when both chairperson and vice-chairperson are absent.
2) Keeps the minutes of the meetings of the commission in an
appropriate minute book.
3) Signs all minutes of the commission as well as other
official documents of the commission.
PART III , i~4ISCELLANEOUS
Section 1. Suspension of Rules
The commission may suspend any of these rules by a 2/3 vote of
those members present.
Section 2. Amendments
These rules may be amended at any regular meeting by a 2/3 majority of
the members of the commission, provided that the amendment was
presented and written into the minutes of a previous meeting.

Section 3. Review
1'he contents of these bylaws and rules of procedure should be
comprehensively reviewed, evaluated, and modified where necessary, at
the organization meeting held in February of each year.
