05-9582r 182 RESOLUTION NO. 9582 RESOLUTION APPROVING SUMMARY PUBLICATION OF BILL NO. 2005-3 WHEREAS, the City has adopted the above referenced ordinance; and WHEREAS, the verbatim text of the ordinance is cumbersome, and the expense of publication of the complete text is not justified. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield that the following summary is hereby approved for official publication: SUMMARY PUBLICATION BILL NO. 2005-3 AN ORDINANCE ESTABLISHING A ONE YEAR MORATORIUM ON THE DEVELOPMENT OF CERTAIN PROPERTIES IN THE 1-494 CORRIDOR THAT ARE GUIDED FOR REGIONAL COMMERCIAL/OFFICE USES AND DIRECTING THAT A PLANNING STUDY BE CONDUCTED On February 8, 2005, the Richfield City Council adopted an ordinance designated as Bill No. 2005-3, the title of which is stated above. This summary of the ordinance is published pursuant to Section 3.12 of the Richfield City Charter. The ordinance establishes a moratorium on the development of properties that are: (1) located between 1-494 and 76th Street; (2) guided for Regional Commercial/Office uses; and (3) currently zoned for General Commercial C-2, High Density Commercial C-3 or Industrial I. The ordinance also directs that a planning study be conducted to determine the appropriate land uses and development standards for properties in the 1-494 Corridor and that appropriate amendments be made to the City's official controls upon completion of the study. The following land use applications are excepted from the moratorium: (a) building permits for expansions of 500 square feet or less; (b) building permits for routine maintenance or repairs that do not constitute an expansion or change in use; (c) applications for development of 150,000 square feet or more of retail space on property zoned or to be zoned Planned Commercial PC-2. Applications for exceptions from the moratorium may be made to the City Council. Copies of the ordinance are available for public inspection in the office of the City Clerk during normal business hours or upon request by calling 612-861-9760 of the Community Development Division. ~ity~ BE IT FURTHER RESOLVED, that the City Clerk is directed to keep a copy of the ordinance in her office at City Hall for public inspection and to post a full copy of the ordinance in a public place in the City for a period of two weeks.
