5. The request for zoning variation by Marvin Wolfenson, Northwest Unit Invest-
ment Company, 7620 Penn Avenue South, to construct an addition to an office
and recreational building with less distance between buildings than required
by ordinance.

SUBJECT: INFORMATION ON TWO HEARING ITEMS ON SEPTEMBER 23, 1969 AGENDA.
The following two items are on the September 23, 1969 Planning Commission agenda:
Request for Variance to Construct a Swimming Pool.
Mr. Thomas Gargan, 7133 Garfield Avenue South has submitted a request for a variance
to constructa swimming pool 5 feet from the property line instead of ten feet as required
by City Ordinance. Mr. Gargan has obtained approval from all but two of his surrounding
neighbors as shown on the attached petition for the construction of the swimming pool in
such a location as shown on the attached sketch. The two neighbors from whom he has not
obtained approval are presently on vacation.
The City Ordinance provides that an adjustment or variance may be granted by the
City Council following review by the Planning Commission. However, before granting an
.application for a variance the City Council must make the following findings:
(1) That there are special circumstances or conditions affecting
the particular land;:building or use referred to in the appli-
cation, not.common to other properties in this or similar
districts.
(2) That the granting of the application is necessary for the pre-
servation and enjoyment of substantial property rights.
(3) That the granting of the application will not materially and
adversely affect the health or safety of persons residing or
working in the neighborhood of the property of the applicant
and will not be materially detrimental to the public welfare
or injurious to property or improvements in the neighborhood.
It will be necessary for the applicant to provide justification for these findings at
the Planning Commission hearing and also for the City Council.
Request for Variance to Construct Building Addition with less than Required Side Yard
Distance.
Mr. Marvin Wolfenson, Northwest Unit Investment Co., 7620 Penn Avenue South, has sub=
mitted a request for a variance to construct a 11 X 38 ft. addition to the North side of
the office and recreation building at his apartment complex at that address. The attached
sketch indicates the location of the proposed addition with respect to the existing building
and other near by buildings. Also attached is a letter from Suburban Engineering, Inc.
commenting -on the proposed project.
The City Ordinance provides that each multiple dwelling project containing more than
.ie dwelling structure shall have a rear -yard and side -yard set -back of at least 25 feet
and there shall be a space between any two adjacent buildings at least equal to the sum of
the heights of the two buildings.

The existing office and pool recreational building is approximately 20' in height and
the adjacent existing apartment building is approximately 30' in height which would require
a space of approximately 50' between the existing office building and the adjacent apartment
building. Mr. Wolfenson is requesting a variance of 35.6' wh �h would leave a spa^fl-14.4' between the two buildings as shown on the attached sketch. Mr.-Wolfenson plans to-
use the proposed addition to the office building for storage space. The proposed addition
would be approximately 13' in height compared to the present office building which is
approximately 20'-in height.
