The Wuttke Corporation has filed an application for a rezoning request from residential to multiple -residence at 6525 Emerson Avenue So. A copy of the petition and a sketch listing information about the petition is attached. Inasmuch as the petitioner did not actually file his application for rezoning until Wednesday, June llth, Midwest has not had enough time to complete their analysis so that it could be included with this material. However, Midwest Planning will either send copies of their analysis directly to the Planning Commission members or if that is im- possible, they will have copies at the hearing on Tuesday night. Request for Variance to Construct a Swimming Pool. Mr. Richard F. Rouser, 7501 lst Avenue South has submitted a request for a variance to construct a swimming pool 5 feet from the property line instead of ten feet as required by the City Ordinance. (See sketch attached). The City Ordinance provides that an adjustment or variance may be granted by the City Council following review by the Planning Commission. However, before granting an application for a variance the City Council must make the following findings: (1) That there are special circumstances or conditions affecting the particular land, building or use referred to in the appli- cation, not common to other properties in this or similar districts. (2) That the granting of the application is necessary for the pre- servation and enjoyment of substantial property rights. (3) That the granting of the application will not materially and adversely affect the health or safety of persons residing or working in the neighborhood of the property of the applicant and will not be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood. It will be necessary for the applicant to provide justification for these findings at the Planning Commission hearing and also for the City Council. Request for Variance to Construct an Annex to an Existing Dwelling. Mr. Bruce Wood, 6605 1st Av=_nue South, has made application for a variance to construct an annex to an existing dwelling as shown on the attached sketch. a Memo to Planning Commission (cont.) - 2 - June 13, 1969 Mr. Wood wishes to construct the annex three feet eight inches from the lot line instead of five feet as required by City Ordinance. On November 10, 1967 Mr. Wood obtained a building permit to construct an addition to his house at 6605 lst Avenue, and to construct a concrete slab for a garage which he intended to move to the rear of his lot. The garage was moved and the concrete slab constructed but Mr. Wood did not complete the addition to the dwelling. Work on the addition to the building was suspended for at least 120 days and when this occurs it becomes necessary for the owner to obtain a new building permit before work can be continued. Therefore, in accordance with this recommendation, Mr. Wood obtained a second building permit for the same project on April 8, 1969. The Chief Inspector and Engineer in a recent inspection determined that Mr. Wood's project continued to increase in size over and above the type of annex that he proposed to build when he obtained the original building permit. The Chief Inspector and the Engineer also determined that Mr. Wood was building too close to the lot line in violation of the City Ordinance and a "stop order" was therefore issued to Mr. Wood. At the present time Mr. Wood cannot continue construction on this addition until he presents plans to the Chief Inspector showing, in detail, the addition which he now is attempting to construct. Also, he cannot continue with the present addition unless he is able to obtain a variance from the City Council permitting him to build to within three feet eight inches of the property line instead of five feet required in our Ordinance.
