ADJOURNMENT M E M O R A N D U M April 11, 1969 TO: PLANNING COMMISSION FROM: CITY MANAGER SUBJECT: INFORMATION ON APRIL 15, 1969 AGENDA ITEMS The following two items are on the April 15, 1969 Planning Commission agenda: Quit Claim Deed for 10 foot Easement west of 63rd Street and Dupont Avenue. The City has received a letter from Donald H. Seel, Attorney, asking that the City provide a Quit Claim Deed for a 10 foot easement located to the west of 63rd Street and Dupont Avenue. You will recall that this is in the area which was re- zoned last year for multiple -residence and is where an apartment house complex is proposed for construction in the near future. The attached sketch shows that 63rd Street has been previously vacated and that the 10 foot easement referred to by Mr. Seel lies along the northern edge of this section of vacated 63rd Street. This 10 foot easement was originally deeded to the City for road purposes because 63rd Street had only a 30 foot right-of-way at that location. Since this action was taken, 63rd Street has been vacated and the city no longer has any use for this 10 foot strip. This 10 foot strip is in the area where off-street parking is planned for the proposed apartment house complex. The off-street parking con- tract was approved by the City Council at the March 24, 1969 meeting. Mr. Seel's request has been reviewed by the City Attorney and the City staff and it is our recommendation that the Planning Commission recommend approval of a Quit Claim Deed for this 10 foot strip. The strip was originally acquired without consideration and, therefore, would involve no consideration at this time in this action. The City Attorney advises that in effect this is a matter of clearing the title for the land owner as Mr. Seel has suggested in his request to the City. 77th Street Right-of-way Acquisition between Lyndale and Garfield Avenues. Approximately one year ago the City engaged in negotiations with Mr. Robert Reddick concerning the purchase of the S2 of the right-of-way for 77th Street be- tween Garfield and Lyndale Avenues. At that time the City agreed to offer $2,500 for the purchase of this right-of-way. Although Mr. Reddick originally wanted more money for this land, he has now agreed to sell it to the City in the amount agreed upon by the City Council last year. The attached sketch shows, in red, the property owned by Mr. Reddick and pro- posed to be purchased by the City for street right-of-way purposes. We have recommended to the City Council that this right-of-way be acquired and that a special assessment project be created to include the acquisition of right-of-way, grading, surfacing, and concrete curb and gutter construction on this one-half section of 77th Street. Planning Commission Memorandum (continued) - 2 - April 11, 1969 It is recommended that the Planning Commission make a recommendation to the City Council for approval of this property acquisition for street right-of-way purposes. As you will note on the attached sketch, the acquisition of this land will make it possible to have the same amount of right-of-way in this block of 77th Street as in the area to the east.
