MEMBERS PRESENT WERE: HENSHAW, COOMBS, ERSPAMER, WOERNER AND C~RUNDITZ

THIS MEETING WAS OF REGULAR MEMBERS ONLY.
MINUTES:
THE MINUTES OF THE LAST MEETING WERE READ AND APPROVED.
i. APPOINTMENTS AND SUBMISSION OF REPORTS:
IN RESPONSE TO THE REQUEST OF THE COUNCIL, THE MATTER OF APPOINTMENt OF COMMIS-
SION MEMBERS AND OF THEIR TERMS OF OFFICE WERE DISCUSSED. ERSPAMER MADE THE MOTION
AND WOERNER SECONDED THAT THE FOLLOWING RESOLUTION BE PRESENTED TO THE V{LLAGE
COUNGIL:
THE LONG RANGE CAPITAL IMPROVEMENTS PLANNING COMMISSION FEELS THAT THE
TIj+iE OF APPOINTMENT OF COMMISSION MEMBERS AND THEIR TERMS OF OFFICE ARE
FUNCTIONS OF THE VILLAGE COUNCIL RATHER THAN THE PLANNING GOMMISS{ON.
IT lS THE COMMISSIONiS OPINION, HOWEVER, THAT APPOINTMENTS SHOULD BE
MADE AT THE FIRST MEETING OF 7HE COUNCIL iN JANUARY AND THAT THEIR
REPORT SHOULD BE PRESENTED 8Y OCTOBER ISTH. IN ORDER TO MAINTAIN CON-
TINUITY, IT IS RECOMMENDED THAT STAGGERED APPOINTMENTS OF COMMISSION
MEMBERS SHOULD BE MADE IF POSSIBLE.

2. PLAPdNiNG COMMISSION ACTIVITIES:
THERE WAS A CRITICAL EVALUATION OF PROGRESS OF THE PRESENT COMMISSION IN
TERMS OF HOW MUCH HAO BEEN COMPLETED DURING THE MONTHS (N WHICH IT HAD BEEN ACTIVE.
3. REVIEW OF PREORIT{ES:
IT WAS DECIDED THAT A REVIEW OF PRIORfT1ES AS SET UP BY THE FORMER COMMISSION
SHOULD BE STARTED IMMEDIATELY. MR. BUBBERS WOULD BE ASKED TO GET A STATUS OF PRO-
JECTS RECOMMENDED IN REPORT ~[ BASED ON THE 1959 BUDGET.
4. THOROUGHFARE BEAUTIFICATION:
BECAUSE THERE WAS DIFFERENCE IN OPINION AS TO WHETHER BEAUTiFICATiON OF
THOROUGHFARES FELL UNDER THE PLANNING COMMISSION FUNCTION, ERSPAMER MOVED THAT MR.
BUBBERS 8E ASKED TO SECURE FROM MR. LEFEVRE A LEGAL OPINION AS TO TH15 QUESTION.

MR. LEFEVRE WOULD ALSO BE ASKED TO PRESENT HIS WRITTEN MEMO ON ORDINANCES
AFFECTING THOROUGHFARE BEAUTIFICATION.
5. WATER:

SINCE THE QUESTION OF WATER FOR THE VILLAGE HAD BEEN DISCUSSED AT A RECENT
C{Ti2ENtS LEAGUE MEETING WITH SOME NEW EMPHASES, [T WAS DECIDED THAT THE COMMIS-
SION WOULD ASK MR. BUBBERS TO SECURE INFORMATION FROM VARIOUS WELL COMPANIES AS

SUBJECT: THOROUGHFARI BEAUTIFICATION
I am informed by the Intern Administrative Assistant that a question
has arisen as to cahether ttthoroughfare beautificationtf can be con
sidered a proper long range capital improvement, This question can
best be answered by taking up the individual aspects of ~~thorough-~
fare beautificationn separatelyo

Further restrictions against parking on boulevards could be
embodied in the traffic ordinance, if the council should deem
it desirableo This would not be in the nature of a capital
improvement but would be a change in regulations. Boulevard
parking will be affected by the installation of curbsa The ins
stallation of curbs is one of those improvements mentioned in
the Improvement Code (Aiinnesota Statutesn Chap. 429), as an
assessable improvement; at is therefore a long range capital
improvemento
2. Boulevard Maiatenance:
The maintenance of boulevards is an annual problem not involving
a long term capital outlay and. not involving assessments over a
period of pears. I doubt whether this could be classified as ~;
long range capital improvemento

None of these would seem to fall in the classification of long
range capital improvementso
4o Access to Commercial Areas:
Access to commercial areas is designated by the installation of
curb and gutter. This installation irould constitute a long range
capital improvemento
5a Stagnant Water:
Stagnant water may occur on either public right of way or private
right of caay. Where it occurs on public right of way or public
property, it may necessitate the making of capit al improvements
such as curb and gutter, storm sewer, and street grading, These
are all long range capital improvementso Some pools of stagnant

water on private property may fall within the classification of a
~~nuisance~, and abatement would not constitute a long range .capital
improvemento
I am not aware that any municipality has ever used the Improvement
Code to make street beautification a separate pro3ect. Street
beautification is normally adjunct to some other capital improvement.
The planting of trees now constitutes a separate capital improvement
for cahich assessments may be levied against the benefited property,
