Special Meeting
August 19, 1999
CALL TO ORDER
The meeting was called to order by Mayor Kirsch at 6:30 p.m.
ROLL CALL
City Council
Members Present:Martin Kirsch, Mayor; Susan Rosenberg; Sue Sandahl; Russ Susag;
and Kristal Stokes.
Staff Present:Steven Devich, Acting City Manager; Thomas Ferber, City Clerk;
John Dean, Acting City Attorney; and Jim Lynn, Lynn & Associates.
Acting City Manager Devich read a memorandum from Paul Reaume, The PAR
Group, regarding the status of a response from Samantha Orduno regarding the City
Managers position.
Acting City Attorney Dean reviewed and responded to questions regarding the City
Charter provision requiring residency in the City for the City Manager. He stated that
Minnesota State Statutes supercede the City Charter on this issue and that the City
cannot require the City Manager to reside in the City.
Discussion followed regarding issues related to the current housing market,
housing availability, time frame for the new City Manager to find housing, the community
and City Council expectations that the City Manager reside in the City, and that Samantha
Orduno had expressed a desire to live in the City but had been unable so far to find a
home in Richfield large enough for her family.
It was the consensus of the City Council that Samantha Orduno be called to ask
her to affirm that housing is the only issue of concern regarding accepting the position, to
convey to her the City Council and community historical expectations that the City
Manager live in the City, and ask her, if she accepts the position, for her continued good
faith effort to obtain housing in the City.

Discussion followed regarding finalizing the terms of an employment agreement
assuming the responses of Samantha Orduno are satisfactory. It was the consensus of
the Council that this should occur on the August 23 City Council Meeting or at a Special
City Council Meeting on August 25 if necessary.
M/Susag, S/Rosenberg to schedule a Special City Council Meeting for August 25,
1999 at 6:00 p.m. (if necessary) for consideration of the City Manager appointment.
Motion carried 5-0.

The meeting was adjourned by unanimous consent at 7:50 p.m.
