05-10-99 Worksession CITY COUNCIL MINUTES Richfield, Minnesota Special City Council Study Session Meeting May 10, 1999 CALL TO ORDER The meeting was called to order by Mayor Kirsch at 6:05 p.m. ROLL CALL City Council Members Present:Martin Kirsch, Mayor; Russ Susag; Kristal Stokes, Sue Sandahl and Susan Rosenberg. StaffPresent :Steven Devich, Acting City Manager; Thomas Ferber, City Clerk; Mike Eastling, Public Works Director; and Corrine Thomson, City Attorney. Item #1DISCUSSION OF ACADEMY OF HOLY ANGELS DRAINAGE POND LEASE AGREEMENT. S.S. LETTER NO. 15 Public Works Director Eastling reviewed Study Session Letter No. 15 regarding th stormwater alternatives to the Academy of Holy Angels (AHA) pond at 66 Street and Pillsbury Avenue. He reviewed a drainage contour map of the area indicating that staff seeks to improve drainage in street flooding areas when opportunities such as this present themselves. He reviewed the following alternatives: 1.Continue to pursue shared use/shared cost pond with the Academy of Holy Angels (AHA). 2.Construct a pond in the HUB shopping center. 3.Construct an additional storm pipe to Richfield Lake. 4.Construct an additional storm pipe to Wood Lake. 5.Condemn AHA property for a City pond. 6.Do nothing except require the AHA to construct a pond to National Urban Runoff Program (NURP) standards. Special Study Session Minutes-2-May 10, 1999 He recommended that AHA and the City continue to pursue the shared use/shared cost pond option. Richard Solem, representing AHA, stated agreement in the mutual benefit of a shared use/shared cost pond. He discussed issues regarding capacity, liability, and the legal issues related to the ownership of the land by the Sisters of St. Joseph of Carondelet. City Attorney Thomson reviewed the legal options regarding subleasing the land, renewability, and condemnation. She stated that all options would still be available at the end of a 27-year lease and the City would retain these rights. Pete Willenbring, WSB & Associates, Inc., storm water consultant and representatives of AHA discussed hydrology and capacity issues related to the pond. City Attorney Thomson stated she would proceed to conclude negotiations with AHA and preparation of a lease agreement for approval by the City Council and the AHA Board on May 24.
