Item #3 COUNCIL DISCUSSION • HATS OFF TO HOMETOWN HITS The City Council acknowledged the efforts of Public Works staff during the recent significant snow fall event. Council Member Fitzhenry encouraged residents to remove the snow from around fire hydrants. Mayor Goettel added the snow should also be removed from storm drains. Item #11 PUBLIC HEARING REGARDING 2011 ON -SALE INTOXICATING AND SUNDAY LIQUOR LICENSE RENEWAL FOR HKD LO, INC. D /B /A JUN BO CHINESE RESTAURANT, 7717 NICOLLET AVENUE STAFF REPORT NO. 248 Mayor Goettel presented Staff Report No. 248. Boris Parker, Jun Bo attorney, discussed the number of public safety contacts, the pending proceedings for failure to pay sales /use taxes, allegations of minor consumption of the premises and the steps taken to address security and sales. Public Safety Director Fritz explained the need for extra patrol of the site, which is a big concern to the City. M /Goettel, S /Sandahl to close public hearing. Motion carried 4 -0. Council Meeting Minutes -7- December 14, 2010 Mayor Goettel stated she would not support renewal of the license. City Attorney Tietjen explained the legal options available to the Council. Council Member Fitzhenry stated he would not support renewal of the license. Council Member Elliott and Council Member Sandahl suggested not voting on the license tonight and waiting until the tax and under age consumption legal matters are concluded. City Manager Devich suggested the City Council wait until all five City Council members are present before taking action on this license. M /Goettel, S /Elliott to continue this license renewal matter to a City Council meeting following the conclusion of all legal matters and provide an interim liquor license with conditions. Motion carved 3 -1. Fitzhenry opposed. Item #12 CONSIDERATION OF FIRST READING OF ZONING DESIGNATION AND RICHFIELD COMPREHENSIVE PLAN DESIGNATION OF 6901 PENN AVENUE (STAFF REPORT NO. 249) Council Member Elliott presented Staff Report No. 249. M /Elliott, S /Goettel to approve the first reading of the ordinance amending Richfield City Code Appendix 1 to change the zoning designation of 6901 Penn Avenue from MR -2 (Multi - Family Residential) to R (Single - Family Residential). Community Development Director Stark stated the Planning Commission recommended staff pursue a Comprehensive Plan amendment rather than rezoning the site. Staffs recommendation is related to the impacts of what would be allowed if the site suffered a loss and was to be rebuilt. Motion failed 0-4. M /Elliott, S /Sandahl to deny first reading of the ordinance and direct staff to pursue an amendment to the Comprehensive Plan so as to agree with the existing zoning designation. Motion carried 4 -0. Item #13 CONSIDERATION OF RESOLUTION IMPOSING CIVIL ENFORCEMENT ON ESTABLISHMENT IN RICHFIELD THAT UNDERWENT TOBACCO COMPLIANCE CHECK CONDUCTED BY RICHFIELD PUBLIC SAFETY AND FAILED BY SELLING TOBACCO TO UNDERAGE YOUTH (STAFF REPORT NO. 250) Council Member Elliott presented Staff Report No. 250. Short Stop Superette — 7034 Cedar Avenue — Short Stop Superette representatives admitted the violation occurred and stipulated to the suspension and penalty. Item #14 RESOLUTION Consideration of resolution awarding sale of $6,455,000 Tax Increment Refunding Bonds, Series 2010B (Staff Report No. 251) Mayor Goettel presented Staff Report No. 251. Rebecca Kurtz, Ehlers & Associates, recommended awarding the sale to United Bankers Bank of Bloomington, MN in the amount of $6,355,000 at a 2.98% interest rate. Ms. Kurtz reviewed the Standard & Poors reaffirming of the City's AA+ bond rating. M /Goettel, S /Elliott that the following resolution be adopted and that it be made part of these minutes: RESOLUTION NO. 10454 A RESOLUTION AWARDING THE SALE OF GENERAL OBLIGATION TAX INCREMENT REFUNDING BONDS, SERIES 2010B, IN THE ORIGINAL AGGREGATE PRINCIPAL AMOUNT OF $6,355,000; FIXING THEIR FORM AND SPECIFICATIONS; DIRECTING THEIR EXECUTION AND DELIVERY; PROVIDING FOR THEIR PAYMENT; PROVIDING FOR THE ESCROWING AND INVESTMENT OF THE PROCEEDS THEREOF; AND PROVIDING FOR THE REDEMPTION OF BONDS REFUNDED THEREBY Motion carried 4 -0. RESOLUTION REGARDING ATTENDANCE BY COUNCIL MEMBERS AT COUNCIL MEETINGS WHEREAS, the attendance of Council Members at meetings is one of the most important duties imposed by law on members; and WHEREAS, member presence to participate in hearings, deliberations and decisions of the Council is essential to the proper discharge of the member's official duties; and WHEREAS, recognizing that it is not always possible for a member to be present at all meetings and that by reason of business demands, state of health, personal problems, vacations and other matters, occasional absences are excusable; and WHEREAS, Subsection 205.15 of the Richfield City Code establishes rules for attendance at City Council meetings that may be invoked by resolution of the Council. NOW, THEREFORE, BE IT RESOLVED, by the City of Richfield, Minnesota that the following rules apply to absences of Council Members from meetings during calendar year 2005: 1. This resolution applies to all regular meetings of the Council, as defined in Subsection 205.01 of the Richfield City Code. This resolution also applies to duly called special business meetings of the Council. The resolution does not apply to special informational or special ceremonial meetings. Special Council meetings are those called pursuant to Subsection 205.03 of the Richfield City Code. For purposes of this resolution, special meetings are further categorized as: a) Special business meetings. Special business meetings include: Special meetings called to conduct official business of the City where the Council considers action requiring a vote of the City Council; special work study meetings; and special meetings called for the purpose of conducting a public hearing. b) Special informational meetings. Special informational meetings are those called for the City Council to receive information or to participate in discussion but where no official action of the City Council is taken, except that the term does not include special work study meetings or meetings called for the purpose of conducting a public hearing. c) Special ceremonial meetings. Special ceremonial meetings are those called for ceremonial activities but where no official action of the City Council is taken, including ribbon cuttings, community celebrations and similar activities. 2. Any member of the Council desiring to be excused shall insofar as possible, give advance notice to the City Manager stating i) the meeting at which the member will be absent; ii) the member's reason for being absent; and iii) the member's location during the meeting. 3. At the beginning of each regular or special business meeting, the Clerk shall call the roll. If a member is absent, the City Manager shall report any communication from the absent Council Member regarding the reason for absence. The Mayor shall request the Council Members to determine whether the absence is excusable or inexcusable. 4. For each unexcused absence from a regular or special business meeting, the absent member shall be penalized by a fine of $25 and the Mayor, if absent, shall be penalized by a fine of $50. The fine shall be automatically deducted from the next Council Member payment unless otherwise directed by a majority of the City Council Members present. 5. This resolution remains in effect until December 31, 2011 unless revoked prior to that date by resolution of the City Council. This resolution supersedes Resolution No. 10329. BACKGROUND The Richfield Sun - Current, published by Minnesota Sun Publications, has been the City's official newspaper for many years. Attached is a copy of a letter from Minnesota Sun Publications requesting that they be designated as the official newspaper for the City of Richfield for 2011. The 2011 advertising rate structure for legal notices is as follows: Sun Current 1 Column width (1.6 inches wide) $11.44 per inch for first insertion $ 5.72 per column inch for subsequent insertions There are 11 lines per inch. The 2011 rate has decreased from the 2010 rate of $14.30 per inch for first insertion and $7.15 per column inch for subsequent insertions. 0111newspaper For 2011, the Minneapolis Star Tribune Newspaper could be considered as the official newspaper. Attached is a letter regarding the 2011 advertising rate structure for legal notices in the Sunday and weekday, metro and statewide issues. The rate is $5.40 per line with 11 lines per inch. Their 2011 rate has increased from the 2010 rate of $3.40 per line; however, they have switched from a 10 column format to a wider 6 column format. Star Tribune 1 Column width (1.77 inches wide) $ 5.40 per line Based on the 2011 rates for 11 lines per inch, the total would be approximately $59.40 per inch in the Star Tribune compared to $11.44 for the first inch ($5.72 per subsequent inch) in the Sun - Current. III. BASIS OF RECOMMENDATION A. POLICY The Charter of the City of Richfield requires in Section 13.01 thereof that the City Council annually designate an official newspaper for the City. The Sun - Current has expressed an interest in continuing to serve as the official newspaper of the City. The Sun - Current has served well as the official paper for many years. The Sun - Current is delivered to nearly all residences in the City. B. CRITICAL TIMING ISSUES • The designation must be made at the first meeting of the new year. C. FINANCIAL The cost of the official publication is reasonable. D. LEGAL • A newspaper must be designated each year by the City for publication of all official and legal City business. E. II. BACKGROUND N/A III. BASIS OF RECOMMENDATION N/A A. POLICY • In accordance with Minnesota Statutes Section 118A.01 - 118A.06, the City of Richfield must designate financial institutions annually. The institutions must pledge the collateral over and above the amount of federal insurance, as public depositories. • U.S. Bank acts as the banking institution in the City's banking arrangement with the 4M Fund. Monies received, checks written by the City, flow through U.S. Bank, however, at the end of each business day, any proceeds remaining in City U.S. Bank accounts are swept to the 4M Fund to be invested. Therefore, at the end of the business day the City accounts are zero, which means the collateral 0111 Depositodes requirements of Minnesota Statutes Section 118A.03 are not required. Accordingly, U.S. Bank has met all other statutory requirements and should be considered as a depository for the City's Deputy Registrar, payroll and vendor accounts and all savings deposits. • The City must also designate annually, certain savings and loan associations, banks, and credit unions as official depositories for deposit and investment of certain City funds. With approval of these official depositories, the City will be able to deposit and invest funds in these institutions, not exceeding the federal insurance of $250,000. • Finally, a designation must be made for certain financial institutions as depositories for the investment of City funds for 2011. I. RECOMMENDED ACTION: By Motion: Adopt the attached resolution authorizing the use of City credit cards by City employees otherwise authorized to make aurchases on behalf of the City. II. BACKGROUND • Minnesota Statutes Section 471.382, require the City of Richfield to authorize the use of credit cards by any City employee otherwise authorized to make a purchase on behalf of the City. • In today's business environment, most retail businesses, will no longer allow the City to purchase on account and will only accept a City check or a City credit card. • Consequently, the use of a City credit card provides efficiency and flexibility for employees to purchase goods and services on behalf of the City. • In addition to the existing credit cards used, the City has entered the Purchasing Card program as offered through US Bank. The program is designed to make the purchasing /procurement process for low dollar valued items more efficient. The intent is to save time and paperwork by reducing the need for purchase orders, petty cash, check requests and employee reimbursements. • The City Purchasing card program began in 2010 on a limited basis and will be expanded during 2011. The program will allow controls to be put in place to limit monthly and single purchase amounts. Finally, a City Purchasing Card Policy has been established which is consistent with the City's Purchasing Policy and Minnesota Statutes. • The City currently uses the following credit cards: • Five VISA credit cards issued through the Richfield Bloomington Credit Union in the name of the City. The cardholders are the following: 0111Authorize Credit Card Use • City Manager • Public Safety Director • Public Works Director • Community Development Director • Recreation Services Director • Four Roundy's credit cards issued to the City of Richfield Recreation Services Department and Public Safety Department. The Recreation Administration division, Wood Lake Nature Center, Ice Arena, and the Public Safety Administrative Aide use the cards. • Three Petco credit cards issued to the City of Richfield Public Safety Department. The credit cards will be maintained by the following: • Canine Officers (2) • SIU Investigator (1) • US Bank Purchasing Card Program. III. BASIS OF RECOMMENDATION A. POLICY • In accordance with Minnesota Statutes Section 471.382, the City of Richfield must authorize the use of credit cards by any City employee otherwise authorized to make a purchase on behalf of the City. • Further, if a City employee makes or directs a purchase by credit card that is not approved by the City Council, the employee could be personally liable for the amount of the purchase. • A purchase by credit card must otherwise comply with all statutes, rules, and City policies applicable to City purchases. • Finally, the City's auditors recommend that the City authorize the use of credit cards by City employees on an annual basis. B. CRITICAL TIMING ISSUES N/A C. FINANCIAL • The holder's of City credit cards are responsible for reviewing and approving all purchases entered into with the credit card. D: LEGAL • The City is required by Minnesota Statute 471.382, to authorize the use of credit cards by City employees otherwise authorized to make purchases on behalf of the City. E. ENVIRONMENTAL CONSIDERATIONS N/A N. ALTERNATIVE RECOMMENDATION(S) • The City Council could decide to not authorize the use of credit cards by City employees. However, most retail businesses in today's environment will no longer allow the City to purchase on account and will only accept a City check or a City credit card. An announcement was made soliciting funding proposals for service in the Sun Current. Notices were also sent directly to prospective agencies. A total of 13 applications were received from the following agencies: The Storefront Group, Modulo de Informacion, Recursos y Apolyo (MIRA), Volunteers Enlisted to Assist People (VEAP), Senior Community Services (SCS), Bridging, Inc., Cornerstone Advocacy Service, Loaves and Fishes, Church of New Life, Community Involvement Program, Family Stability Work Group, AccessAbility, The Family Partnership, and Richfield R.E.A.D.Y. AccessAbility's application was incomplete and Church of New Life's application did not meet submission criteria, and therefore have not been recommended for funding. The remaining 11 applications represent a wide variety of services offered to Richfield residents, as well as others outside of the city of Richfield. The total funding requested by the.eight eligible agencies exceeded the City's funding by $43,500, or approximately 50 %. The terrazzo flooring change order provides for the extension of the terrazzo flooring down the hallway to the public restrooms and into the restrooms in order to better accommodate this high - traffic area and maintenance concerns. A portion of 0111 CO's the electrical- related change orders are related to Sprint and Motorola requirements and are costs that will be reimbursed to the City. The proposed ordinance includes all fees that are required to be established by ordinance. Other fees, including rental licensing fees, are established via resolution (as opposed to ordinance). Revisions to these fees require only one hearing, which was conducted at the December 14, 2010 Regular City Council Meeting. It has been determined by the City Attorney that the portion of the ordinance referencing Public Works fees should be categorized under the resolution portion of Appendix D changes. Therefore it is recommended that this section be moved to 0111AppendixD the resolution and removed from the ordinance resulting in a need to amend the current ordinance. The increase in the Public Works fees for 2011 is reflected in Resolution No. 10464 amending Appendix D. First reading of the proposed ordinance amendment was held on December 14, 2010 and second reading is scheduled for January 11, 2011. III. BASIS OF RECOMMENDATION A. POLICY • Minnesota Statutes, Section 462.353 requires that certain fees be established by ordinance. • The City attempts to establish fees that appropriately reflect the City's costs of administering the permit or application for which the fee is charged. The Arc's Value Village store will remain in the existing building and minor changes will be made related to the location of trash facilities. 011111 - 2nd Reading 6528 Penn - CVS Rezone & PUD Area Vision In October of 2008, the City Council adopted the Penn Avenue Master Plan and Design Guidelines to direct redevelopment and revitalization efforts along Penn Avenue between Highway 62 and 68th Street. Properties were subsequently rezoned to Mixed Use —Community (MU -C) and the Penn Avenue Corridor (PAC) Overlay was created to address items unique to this area. (Note — the small "panhandle" of 6528 Penn Avenue remained as (C -2) General Commercial.) The intent of these changes was to encourage improvements that would "create a traditional neighborhood center that is a vibrant, pedestrian- oriented district ... [accommodating] residential, shopping, recreational and business uses in a flexible arrangement..." (Richfield Comprehensive Plan 4 -23). III. BASIS OF RECOMMENDATION A. POLICY • In 2008 and 2009 the City Council approved a Master Plan and zoning regulations that would encourage and direct the revitalization -of this area. Zoning Code Requirements: • Planned unit developments (PUDs) are intended to encourage the efficient use of land and resources and to encourage innovation in planning and building. PUDs provide flexibility in the application of dimensional requirements, density and land uses if the proposed development is well designed and can be successfully integrated into the neighborhood. • The underlying Mixed Use — Community District is intended for shops and services that support the surrounding community. • While it is not mandatory that the development meet the requirements of the underlying MU -C and PAC Districts, it does meet many of them (parking, pedestrian access, architectural design, impervious surface, building orientation). • The development does not meet the following requirements: ■ Drive -up service windows must be 150 feet from parcels with residential use on the first floor. • The western -most edge of the drive -thru facility is located 50 feet from the adjacent residential parcel. A significant grade change and tree cover at this boundary will separate the uses and will effectively alleviate negative impacts: Maximum allowable front setback is 15 feet. • The western -most edge of the drive -thru facility is located 50 feet from the adjacent residential parcel. Similarly, it is not required that the proposal meet all general zoning requirements, but the proposal does meet most of them (trash and recycling location, parking lot islands, landscaping, irrigation, bicycle parking, lighting). • The development does not meet the following requirements: • Parking lots are to be set back five (5) feet from adjacent commercial property. • Shared access, parking and circulation make this impractical and unnecessary. • Off -site signs are prohibited. • The proposed development includes a main ground sign at the intersection of 66th Street and Penn Avenue. This sign will include advertising for both CVS and Arc's Value Village, even though the proposed development will split the property into two parcels. Off -site signs ( "Outdoor Advertising Signs" by definition in the Code) are prohibited throughout the City in order to prevent additional billboards and visual clutter in the boulevards at corners. In this case, the sign will replace an existing multi- tenant sign and will advertise businesses that will operate with shared parking and drives. The proposal does not violate the intent of the sign regulations. • Approvals should also be conditioned upon: • An agreement with the City Public Works Department for maintenance of public improvements; • An easement for public use of the stairs; • Submittal and approval of a plat subdividing the two properties; and • Recording of a permanent cross - access agreement between the two properties (a copy to be provided to the City). Required Findings The following findings are necessary for the approval of a PUD application (542.09, Subd. 3): 1. The proposed development conforms to the goals and objectives of the City's Comprehensive Plan and any applicable redevelopment plans; The Comprehensive Plan and Penn Avenue Master Plan designate this property as part of a larger mixed use district stretching along Penn Avenue from Highway 62 to 68th Street. A commercial development intended to serve the surrounding community is consistent with these plans. 2. The proposed development is designed in such a manner as to form a desirable and unified environment within its own boundaries; This requirement is met. 3. The development is in substantial conformance with the purpose and intent of the guiding district and departures from the guiding district regulations are justified by the design of the development; The MU -C District is intended to include shops and services that support the surrounding community and include commercial, office and higher density residential uses. The intent of the PAC District is to provide for a balanced mix of commercial, office and residential uses that together create a cohesive and pedestrian- friendly area. The development is in substantial conformance with the intent of guiding MU -C and PAC Districts. The development is in substantial compliance with the guiding MU -C and PAC District regulations as well. The proposed setbacks adequately protect adjacent uses and the proposed ground sign is justified by the shared parking and access between the two parcels. 4. The development will not create an excessive burden on parks, schools, streets or other public facilities and utilities that serve or are proposed to serve the development; Access to and from the development will remain the same and there is no change in the proposed class of use of the property (retail to retail). The developer will work with the Public Works Department to upgrade utilities where necessary and no issues are anticipated. 5. The development will not have undue adverse impacts on neighboring properties, As above, no access changes are proposed and the property will continue to be used for retail purposes. The City has ordinances in place to restrict noise from the drive -thru service window and delivery vehicles, and to significantly limit lighting (1 footcandle) where adjacent to residential properties. 6. The terms and conditions proposed to maintain the integrity of the plan are sufficient to protect the public interest, The final development plan, which establishes the terms and conditions of the development, meets this requirement. All uses are conditional uses in a Planned Unit Development. The findings necessary to issue a Conditional Use Permit (CUP) are as follows (547.09, Subd. 6): 1. The proposed use is consistent with the goals, policies and objectives of the City's Comprehensive Plan, The Comprehensive Plan and Penn Avenue Master Plan designate this property as part of a larger mixed use district stretching along Penn Avenue from Highway 62 to 68th Street. The proposed use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intents to locate the proposed use, The proposed use will assist in the implementation of the City's Comprehensive Plan and Penn Avenue Mater Plan by providing an upgraded streetscape and pedestrian environment as well as a building with design details that are consistent with the intent of the Planned Mixed Use (PMU) District and the underlying Mixed Use — Community and Penn Avenue Corridor Districts. 3. The proposed use is consistent with any officially adopted redevelopment plans or urban design guidelines, The development is consistent with the Penn Avenue Corridor Master Plan and Design Guidelines. 4. The proposed use is or will be in compliance with the performance standards specified in Section 544 of the Code, The proposed use will substantially comply with performance standards. Variations are supported by the specifics of the project as part of the approved final development plan. 5. The proposed use will not have undue adverse impacts on governmental facilities, utilities, services or existing or proposed improvements; There are or will be adequate facilities, utilities, streets and services to support the development. 6. The use will not have undue adverse impacts on the public health, safety or welfare, Adequate provisions have been made to protect the public health, safety and welfare. 7. CRITICAL TIMING ISSUES • The City is required to issue a decision within 60 days of submission of a complete application unless a letter extending the deadline (up to an additional 60 days) is sent. The 60 -day deadline for a decision on this application was December 28, 2010. Because the second meeting in December was cancelled, a letter of extension was issued to allow consideration of this item on January 11, 2011. • The property owner and applicant have indicated that delay could impact the feasibility of the project. C. FINANCIAL • The required application fee has been paid. D. LEGAL • A public hearing was held before the Planning Commission on November 22, 2010. The Planning Commission found that the proposed development and rezoning were consistent with the Comprehensive Plan (7 -1, Schuller dissenting); and recommended approval of the final development plan and conditional use permit (6 -2, Schuller and Rublein dissenting). • A first reading of the rezoning of the property was held on December 14, 2010. • If approved, the rezoning will be effective 30 days following publication in the Sun Current Newspaper. Findings of Fact. The City Council hereby makes the following findings of fact: A. The City's zoning ordinance establishes zoning classifications for individual property. The property located at 6528 Penn Avenue is zoned C -2 (General Commercial), MU -C (Mixed Use — Community) and is within the PAC (Penn Avenue Corridor) Overlay District. B. Velmeir Companies has submitted an application to the City for a planned unit development plan [the "PUD plan] for the south 220 feet of 6528 Penn Avenue [the "subject area "]. The PUD plan proposes to construct a 12,900 square foot retail building with drive -thru service and 58 parking stalls. C. The City has reviewed the zoning ordinance and determined that it would be appropriate to rezone the subject area as PMU (planned mixed use) and approve the PUD plan to establish the regulations governing the PMU district. D. The Planning Commission has conducted a public hearing concerning the PUD plan and amending the zoning ordinance in the subject area. The Planning Commission recommended approval of the PUD plan and zoning ordinance amendment on November 22, 2010. The City Council held a first reading of the rezoning on December 14, 2010 and second reading and consideration of the PUD plan on January 11, 2011. E. The City's zoning ordinance provides criteria for approving a PUD plan and rezoning of property to a planned unit development. The City Council finds that the PUD plan and rezoning of property in the subject area meets the criteria in the following ways: 1) The proposed development conforms with the goals and objectives of the City's Comprehensive Development Plan and any applicable redevelopment plans: a) The PUD plan is consistent with the Comprehensive Plan designation of this property as part of a larger mixed use district stretching along Penn Avenue from Highway 62 to 68th Street. b) The PUD plan is consistent with the described intent of this designation to "create a traditional neighborhood center that is a vibrant, pedestrian - oriented district ... [that] would accommodate residential, shopping, recreational and business uses in a flexible arrangement that captures the spirit and intent of the Penn Avenue Revitalization Master Plan." [4 -22] c) The PUD plan is consistent with the Penn Avenue Master Plan vision for this area as a continued home for the Arc's Value Village store, additional retail and surface parking. The PUD plan is consistent with the Penn Avenue Design Guidelines in that it I - a-- appropriately transitions between the public street and private development. d) The PUD plan and rezoning are also consistent with the expressed desire for "enhance[d] business opportunities ... either as part of upgrading existing retail areas, expanding new retail business opportunities and /or seeking new and /or redevelopment opportunities for offices, entertainment and service businesses." [4 -16] 2) The proposed development is designed in such a manner as to form a desirable and unified environment within its own boundaries: The building is designed to accommodate customers for the proposed business, as well as continued shared access with the adjoining property. Drive -thru service is separated from the general parking area to prevent traffic congestion within the site. Enhanced crosswalk treatments on site will allow for safe pedestrian movement within the development and to /from the adjoining property and public street. 3) The development is in substantial conformity with the purpose and intent of the original MU -C and PAC zoning districts, and departures from the original district regulations are justified by the design of the development: Setbacks have been adjusted based on the particulars of the site — specifically, the significant grade change from the intersectiori to the northwest corner of the property and property's relationship to the adjacent residential buildings to the west. The proposed ground sign with that will contain advertising for the business on the northern half of the divided property is justified based on the shared parking and access for the two uses. 4) The development will not create an excessive burden on parks, schools, streets, or other public facilities and utilities which serve or are proposed to serve the development: Access to and from the development will remain the same and there is no change in the proposed class of use of the property (retail to retail). The developer will work with the Public Works Department to upgrade utilities where necessary and no issues are anticipated. 5) The development will not have undue adverse impacts on neighboring properties: No access changes are proposed and there is no change in the class of use of the parcel. The use is significantly separated and screened from the residential parcels to the west by a grade change and existing tree cover that will remain. 6) The terms and conditions proposed to maintain the integrity of the plan are sufficient to protect the public interests: A final development plan, which establishes the terms and conditions of the development, is required before construction can commence. There is a need for enhanced and upgraded retail in the City; and WHEREAS, the commercial use meets or will meet all the specific conditions set by this code for the granting of a final development plan and conditional use permit; and WHEREAS, the City has fully considered the request for approval of the final development plan and conditional use permit; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. BACKGROUND According to State Statute 471.66, the governing body of cities and school districts must adopt a policy that controls out -of -state travel for elected officials. That policy was adopted by the City Council in November 2005 and stipulates that the City Council must approve, in advance by a motion, attendance at out -of -state conferences. The general guidelines for evaluating out -of -state travel opportunities are listed in the policy. Information regarding the 2011 N.O.I.S.E. conference typically held in July and the November 2011 NLC Congress of Cities in Phoenix, AZ conference will be provided to the City Council when the agendas become available. III. BASIS OF RECOMMENDATION 7�= 0111 conferences A. POLICY • The Council has determined that attendance at the NLC and N.O.I.S.E. Conferences is beneficial to the City's operations and long - range planning efforts. B. CRITICAL TIMING ISSUES • While the City continues to face revenue reductions from the State, it is even more critical that the Council remains in the informational loop regarding congressional activities as it relates to airport/aviation activities, federal funds and homeland security issues. C. FINANCIAL Funds for one Council Member to attend the NLC Conference(s) are budgeted in the City's 2011 budget. The N.O.I.S.E. Conference is budgeted in the HRA 2011 budget. The estimated total cost of each conference, including registration, flight, lodging and per diem, is $2500 per Council Member. The City Council may wish to take into consideration the financial constraints facing the City for 2011. D. LEGAL • According to State Statute 471.66, the governing body of cities and school districts must adopt a policy that controls out -of -state travel for elected officials. E. BACKGROUND It is necessary to designate a City Council Member to serve as the Mayor Pro Tempore for those times when the Mayor is absent from the City. City Council Member Sue Sandahl served as Mayor Pro Tempore for 2010. III. BASIS OF RECOMMENDATION A. POLICY • Each year the City Council designates a Council Member to serve as the Mayor Pro Tempore. B. CRITICAL ISSUES • It is necessary to designate a Mayor Pro Tempore to ensure continuation of City operations during an absence of the Mayor. IV.
