No person, firm or corpora- tion shall engage in ~Ghe business of beeping, maintrainng, conduct- ing, operating or exhi~bitri~ng any itinerant carnival, street show, street fair, sideshow, circus, or any similar enterprise in the Vil- lage of Richfield without first obtaining a license to do so from the Village Council as hereinafter provided. 2. An itinerant carnival, street show, street fair, sideshow, circus, o-r other similar enterprise, with- in the meaning of this ordinance shall in¢lud~e any such enterprise which is~held, operated or carried on in the out-oF-moors or in tem- porary structures ar ,tents upon or within any public or private ground, at which there congre- gates and assembles, with or with- out the payment of an admission fee, a gathering of people. This ordinance shall not apply to en- terprises consisting entirely of amusement rides; refreshment stands; educational exhibits of local origin not eustomariiy used in connection with any such it- inerantr carnival, street show or similar enterprise; or any com- binatrion of these. 3. Any person, firm or corpora- tion. desiring to engage in any activity for which a license is re- quired by this ordinance, shall first make applica,trian to the Yil- lage Council. ~• Such application shall Abe ac- companied by a license fee of $100.00 for each day for which a license is sought, and shall be made at least 90 days .prior- to the day or days •Eor which the Iicense is sought. fi. T.he application shall state the Pollowiug: A. The owner mr owners of the enterprise; iR a corporation, the names- of the officers; ;and the addresses of the owners ands of- ficers Fisted!. With reference to each person, firm or corporation Li~stred~, said appdicati~on shall strafe whether or not such person ~Ylas ever been convicted of any Felony or misdemeanor, and if so, the dat®, place, and nature of trhe of- fense. B. The place or :places where such enterprise has been actively operated during the last three months of actual' operation pre- eeding the application.. C'. 7'h~e number of vehicles that will be used inn the transp~or~t- ing or operation of said enter- prise, and the license number of each such vehicle. D. The p-rapo~sod location for the the said activity while within the village limits; the area of said property to be devoted to such use; and the owner of said pmo- perty. E. ,The'space avaiiabie far park- ing of veh2cles within one block of said proposed location, and where such proposed space ~s private property, the written consent of the owner of such property. F. The sanitary fa¢il_ities avail- able to persons on the said pro- posed location, and if privateiq owned, the written consent of the owner Hof such facilities. ~C;. The hours of each day dur_ nig which the applicant .seeks, a license tro operate. H. The names and addres~res of persons, iP any, who will act as special police officers or watch- men on said proposed location while trhe said enterprise or equip- ment connected therewith i~s lo- cated' within ~trhe~ villag®. The said application shall' be accompanied by a ~liond, or cer- ti~fied check in tge sum of $1000.00 obtained 'by the operator {not the sponsor) conditioned upon faithful compliance with they ter-ms of ,this ordinance and alI otrher mrdia~ances of this ~?ilIage by the operator and his agentn, employees, associates or other persons acting for or on behalf of said operator. 7. The person making and sigL- ing trhe applicartion shall be charged with responsibility for the trutu aid accuracy of the stratementb and representations made in the application, and the making of any •false statement or intentron- dIly misleading statement in satld application shal'1 constritrute a v1u- lation of ,this ordinance. 8. In the event that trhe license applied for is granted and the facts relative to any matter con- twined inn the application .are changed before or during tae time said enterprise is conducted within this Village, the applicant, or his agent shall immediately noti•Py the village manager of such change, giwi~ng such information with respect thereto as •the terms of thus ordinance may require. 9. iTpon receipt of ~th~e ap~pl~iea- tion, the ailiage clerk shall re- view the same to determine whetrher said application is com- pletre i~~n all' ~gartriculars. IE incom- plete,. i~tr shall be returned to Uhe applicant as promptly as possible, to enable him to complete the ap- plicatrion. 10. Vpon receipt of the com- p-feted applicati~mn, the clerk shall refer the same to the Chief of Policy for review and for such investigation of traFYic Problems, ei iminal record's, safety precau- tions and other matters related to public safety and welfare as may 'be deemed necessary under the circumstanceb. 11. Said application shall also be referred to the Health Officer who shall review the same with regard to sanitration. 12. Each of the Persons review- ing said application may request such further information from the applicant as is reasonably neces- sary to make a determination oY any question of public health, safety, or general welfare con- nected with his department. Upon completing his review, each such person shall endorse his written approval' or disapproval of the appl!icatron. If disapproved the reasons •for such disapproval sh--all be stated.. Each such person may condition his. approval upon com_ pliance with conditions which he shall set forth in writing. 18. k~ollowing review by said Persons if any conditions to ap- proval' have •been attached to said ap~plicatto~n the applicant shall be notified and he shall endorse has written consent to abide by such conditions upon the application. 1f he is unwilling to do so he shall so indicate in writing. 14. Thereafter the application shall be .presentred to the Village Council at its next subsequent meeting. The Village Council may either grant or deny the 1i:oense. In granting the license, the C'ou•~n- cil may impose the conditions recommended, or such other or further conditions as they shall, in their descretion, determine necessary to the public health, safety, convenience, or genera welfare. F''ailure to abide by the conditions imposed in granting the license shall constitute a via lation of this ordinancb. ]; 6. Prior to the time that the enterprise is commenced the aap- pl'ieantr sharll Purnis~h the viila~ge m~a~nager with the following in- form~ation : A. The name and address of each person who will be employ- ed~~ or engag~ed'~ in the en'te~rprise within the 'v~llRago; and #~hs name and address of each person oper- ating arise, show, concession, of other similar activity, giving the F _ •~ J^ ~.,- particular ride, show, eonoessioa or activity inwhich aumh~ person wi~Pl be engaged'. ~B. The nature of each show, exhibition, concession, ride or other act: "'~.ty connected with the enterprise. C. The size and location of each tent or structure to be used m connection with said enterpris®. D. A plot plan showing the lo- cation of each tent or structure on the ground's, its size, nature, and relationship to other strut tares or buildings within 2 2 feet, E. the plan For lighting the area during .the evening, and the' num- ber and location of public ad- dress systems, calliopes and sm- ilar devices. F. The names of persons, i~f any, who will remain bn the proposed site during the hours when said enterprise is not in operation. G. The fire-fighting equipment available on said proposed site. 16. During the period that said enterprise is being located on the site and during its operation, the health officer, building inspector. uhie~F of poli~ce~, and building i~n- spector shall •be empowered to make such emergency orders as may be necessary to assure the public health, safety, convenience, and general welfare, and. Yailuro to observe such orders shall cou• stitu~te a violation of this ordin- ance. 17. No such enterprise shall be conducted nor shall any duty in connection therewith on the site be performed by any person who has been convicted of any crime or misdeameanor involving moral turpitude' 18• For each suQh enterprise the applicant shall pay to the vi:- lage trhe cost of maintaining one poiioe officer on the site at ai; times during setting up and operation. Such officer shall be furnished ~by the village. The cost of paying such officer shall be Paid to the village at the time of making application, and shall be in addition to the license fee hereinfore provided. 19. No such enterprise shall be eomdueted unless adequate pro- vision has +been made for police protectiba of equipment and oP persona attending said enterprise. 20• Nb part of said entrerprise sh:all involve lewd or obscene features, or gambling concessions, or games of chance, or actors or other persons connected'therewitrh who are engaged' in immoral or dishonest pursuits, or any activ- ity having a detrimental effect upon the health or morals of the community. 21. Provision for fire protdc- tion shall ~be made so as to reduce $he hazard of Pire to persons ana property to 'substantially the same extent as in permanent structures in this villago. 22. Provision shall be made for parking so 'that parking on pub- lic streets, alleys, and public ways will not •be necessary to accom- modate the anticipated attenaance at said enterprise. 23. Provision shall be made for adequate sanitary facilities for all. persona attending or participating in said enterprise. 24. Within 24 hours aRter said enterprise has ceased to be in operation, the entire area anon which it was conducted shall be cleaned of alt advertisements, paper, refuse, temporary struc- tures, lumber,. and similar mater- ials by the applicant, his agents or employees, and the property shall be left in a safe and sanitary condition in all respects. 26. All parts of all buildings, tents or other structures shall be ~tept open to police, fire and health inspection at all times. 26. Transporting said enter- prise to, Erom, or within the Vil- lage oP Richfield shall be done in such manner as to avoid damage to any public or private propery. 2'7. Nb intoxicating liquor shalt be consumed, sold, or !be permit- ted to •be oonsumed or sold on the premises licensed for said enter- prise, and all provisions of the ordinances oP this village relative to intoxicating and non-intoxicat- ing liquors shall be strrictly observ- ed and enforced. 28. The Village Council, In. granting a license •to an applicent, may impose such conditrions as they may deem necessary to so- cure the public health, safety, convenience and general welfare shall constitute a violation of this and violation of such conditions ordinance. 29. Upon conviction for a wilful violation oP this ordinanoe, the Village Manager may immediately suspend the i'icense of any licensoe hereunder. Upon such suspension tale police officers of the village shall order the licensee or any of his agents or em~plbyees to cease the activities in which they are engaged to connection with such enterprise, and Failure to comply with such order shall constitute a violation of this ordinance. Such suspension shall be ePPec~tive un- til the neat meeting of the- Council, atr which time the Council may either continue such suspension For a specified period, lift such suspension, or revoke the license. Failure to act at such meeting shall result in a lifting of the sus- pension. 'Such suspension or re- vokation shall be in addition to the penalties herein provided. 30. The Village Council may waive the license Pee where said enterprise is operated or sponsor- ed by a civic, religious, veterans, or charitable organization. 31. Nothing herein contained shal'1 be construed as in any way abrogating or detracting Prom the provisions of Minnesota Statutes Annotated, Section B16.39. 32. Should any se~etion, para- graph, sentence, phrase or clause of this ordinance be declared in- valid for any reason,. it is the ih- tention of this Council that ail other provisions • shall remain in full force and effect. 33. Any person, Firm or cor- poration violating any provision oY this ordinance shall, upon con- viction therefor, be punished by a Pine not to exceed $100.00, or by imprisonment 'for not to eaceel 90 days. Each person engaged in the violating of this ordinance shall be deemed a separate offen- der, and in case bP violations of a continuing nature each day of such violation shall constitute a separate offense.
