1951-3.071F I ORDINANCE N0.~3.071 AN ORDINANCE CONCERNING DOGS AND PROVIDING THE i,~CENSING THEREOF The V511age Council of the Village of Richfield do ordain as follows: 1. A. Every owner or keeper of a dog or animal of the dog kind with- in the limits of the Village of Richfield, shall cause the same ~ be registered, numbered, described and licensed in the office of the Clerk of said Vrillage before such dog is permitted to run at large Suet license shall be for the whole or unexpired portion of the year ending on the next ensuing first day of June. Provided, that no license shall be required fora dog or animal of the dog kind while it is less than three months old. B. The Village poundkeeper shall also be authorized to issue license in a11. cases where dogs have been taken into his custody try reason of not being licensed. C. Such owner or keeper shall pay the Village Clerk or pound keeper for each license the sum of one dollar for each male dog or spayed female, and three dollars for each other female dog. 2. A. The V313~ge Clerk sha11 provide and furnish for each licensed dog a metallic tag upon rich he sha11 have stamped or engraved~the~ register number of the dog, the word Richfield and the year when regist- ered. The design of such metallic tag sha11 be changed each~.yeax. B. Any person who shall make, se1.]., purchase, possess, or shall. place or allow to be placed on their dog any metallic tag of the same form, shape, or intended to be like the official. tag, or shall attempt in atxy way to counterfeit the design adapted for such official tag, sha17:. be guilty of a misdemeanor. C. In case the said metallic tag is lost or stolen, after hav3r~g: been regularly issued as herein provided, the ow .er or keeper~of a deg! upon presenting and surrendering to the Village (;1erk the license or receipt issued when the dog was registered, numbered, described and licensed, as herein provided, shall. receive a duplicate tag and a dup~~~ license upon the payment of twenty-five cents to the Village Clerk. ` D. But no person shall be granted a duplicate tag and license unless the original tag has actually been lost or stolen and the Village Clerk may, before issuing such duplicate tag and license, require an affidavit to be made and furnished by such applicant for a duplicates license az d tag, setting forth the fact that such tag has been lost or stolen and is not at the time in their possession. 3. The Village Clerk sha11 pay over such fees, monthly, to the Village Treasurer. 4. Ever3r owner or keeper of a dog or animal of the dog kind, within the Vila ge limi.ts, sha13. place and keep around the neck of the clog oar animal owned or kept by him, a Dollar, o~ which sha].1, be securely fixed the meta~lliD tag above mentioned. 5• No person having the custody or control. of any dog or animal of the dog kind shall permit the same to go upon any street in said Village or to run at large within the limits of said Village unless it wears the Dollar and tag above described. 6. No person shall keep or suffer to be kept in his premises, or on premises occupied by him within said Village nor permit nor suffer to run at large in said Village or on any street thereof any dog of a ferocious or vicious character, ~iabit or dieposition. And it shall be lawful for any person to kill or d~,~troy any such animal if found in any 8~ . . street at large in said Village. 7, No owner or keeper of a female dog shall permit or suffer the same ~ td run at large or be in any street, alley or public place in said Village while same is in heat, and it shall be lawful for arty person to kill or destroy such female dog i.f so found running at large in said Oillage. 8. A.. Whenever the prevalence of a hydrophobia renderd such action i necessary to protect the public health and safety, the Mayor shall issue a proclamation ordering every person owning or keeping a dog to confine j it securely on his premises unless it is muzzled so that it cannot bite. f, B, The Council may designate a period not to exceed two weeks each year when all dogs within the village shall be confined to assist the poundkeeper and the police officers of this village in carrying out the provisions of this ordinance. At least two weeks notice of such period ~ shall be given by posting copies of such notice in three conspicuous ~ places within the Village, and by publishing at least once in the official newspaper of the Village. C. Any person having the care or control of a dog within this villb r age, who shall fail or refuse to comply with such order, shall be guilty of a misdemeanor. N 9, It shall be the duty of the police officers and the poundkeeper e of the village to enforce the provisions of this ordinance and to kill or cause to be killed or transported to the village dog pound any and G, all dogs kept within the village or running at 1a.rge therein, contrary ~' to the provisions of this ordinance. l0. It shall be unlawful for any person to refuse to exhibit his license or receipt to any police officer or poundkeeper when requested to do so . ~; 11aThe Village Council shall designate a suitable place in said • Village as a dog pound and ali dogs conveyed to the said pound shall be kept, with kind treatr.~pnt and sufficient food and water for their comfort, `; at least three days unless sooner reclaimed by their owners as hersin- after provided, In case the owner of any dog shall desire to reclaim him from the dog pound, such dog may be released from the dog pound upon ~ payment of such owner of the sum of one dollar, plus the cost of the keep ~ of such dog in said pound and upon exhibiting to the keeper of such pound - of a 13cense duly issued pursuant to this ordinance, 12. If, at the end of said three day period, any such dog shall not j have been reclaimed by tl:e owner, then such dog may be sold by the keeper k of such pound for a sum not less than the cost of the keep of such dog, ~ plus one dollar,to any person who sha]1 procure a license for such dog ~ provided. that such license shall be duly exhibited to the poundkeepex i F before he gives possession of said dog to such licensee. •' 13. At any tame after said three day period, such poundkeeper may ~ cause such dog to be killed and shall properly dispose of the remains ~ thereof and such poundkeeper shall account for and pay over monthly to the Villa. a Treasurer all move received g y by him on behalf of the Village, by reason of sales and licenses. Said poundkeeper shall also P keep an accurate account of all licenses issued by him, all fees collect- ~ ed, all sales made, all dogs received at the dog pound and all dogs killed a or released therefrom and shall sub.-nit such account monthly to the Vill- ~ age Clerk. - 1I~, Whenever any dog within the Village of Richfield shall have bitten any person, the Village Health Officer may, and he is hereby authorized ~ and empowered to order the police officers or poundkeeper to take such dog. to the dig pound and there keep such a.og for such time as such Health- k g~ Officer shall order, to give such Health Officer an opport~ani.ty to det~rm3.ne whether such dog is diseased, and no diseased dog shall be killed unta.l so ordered by said Health Officer. l5. No person shall in any manner molest, hinder or interfere with any person carrying out the terms of this ordinance. ld. No person shall keep more than two dogs over three months of age in any residential district in the Vil]~age of Richfield and the keeping of mare than two dogs over three months of age in any such re- sidential district is hereby declared to be a nuisance. 17. A. No person firm or Corporation shall maintain in the Village of Richfield a kennel where dogs are kept for sale, boarding, breeding, showing or for treatment without first securing a license therfor from the Village Clerk. The license fee shall be one hundred 0100.00) dollars per year, B. No such kennel shall contain more than thirty-five (35) doge over three months of age at any one time. All such kennels shall be subject to inspection by the Village Health Officer or other designated officer at least once each month to insure their being maintained in a sanitary and healthful condition. 18, The Village Manager shall designate a poundkeeper. The Village Council may designate. as the official dog pound of this Village a kennel that is located in or near this Village and may contract with the owner of such kennel for such services as may be necessary to carry out the provisions of this ordinance. Dogs impounded pursuant to the provisions of this ordinance shall not be included in the limitations imposed by Section 17-B of this ordinance. 19. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanors This ordinance shall take effect and 'be in force from and after its publication. _ / As passed by the Council this 28~/aay of Nlay 1951.
