The C ounci 1 of the Village of Richfield does ordain: SECTION 1: PURPOSE OF THE ORDINANCE. ' It shall be the purpose of this ordinance to establish a uniform and equitable system of municipal. personnel administration for all employees of the Villa ge of Richfield based upon (1) the merit principle of selection, promotion, and retention of employees; (2) establish wage ranges for job classifications; • (3} automatic cost -.of - living adjustments in pay,and, (4) employee participation in the formulation of municipal personnel policies. DE'G INITIONS "Part--t~.me employment° shall menu employment regularly engag®d in on a schedule less than full.-time basis. "Casual employment"• shall mean employment which is incidental to the main functions of the Village governmemt normally for short duratioa, .and compensated for on an hourly basis. "Seasonal employment" shall mean employment regularly engaged in on a scheduled, full-time work week basis for less than twelve (12) months in any one calendar year.. "Beaefits" means privileges granted to as employee in the form of vacation leave, sick leave, overtime allowance, holidays, military induction pay, or pay received in lieu of accrued leave upon term- ination of employment. "Budget time" means that period during which budget requirements for the following fiscal year are estimated, considered, and adopted according to law. "Ti'iscal yearl1 shall be .T~nuary 1 to Decembex 31 inclusiv®~ or as otherwise provided by law.• °Appointing authority" sh~.l.l mean the Council, except where the power to appoint and remove personnel is otherwise provided by law under Plan B, Plan C or home rule charter. SECTION 8. COMPENSATION PLAN There shall be established a compensation plan for all positions sub3ect to this ordinance. A. Elements of the Plan. The compensation plan shall consist of: {1} A Basic Table of Numbered P~r• Ranges. Individual Pay Rates. The compensation rate far each individual employee shall be established by Resolution of the Council and shall be step s A14, "B", rrCr-,~ rrJ~yr.~ nEn ~ or ir~+o of the pay range assigned to his class of positions. How Computed Prior t o ar during the preparation of the annual budget there shall be conducted an investigation to determine the °•Conaumer~s Price Index" (hereafter designated as C.P.T.) as reported by the U. S. Department of Labor (Bure~z of Labor Statistics) or other appropriate Federal Agency for Minneapolis, or the nation as a whale if the C.P.I. for Minneapolis is not available. B. Base of Compution. • The C.P.I, of 170.0 {the approximate average of the C.P.I, for 1948, 1g49 and 195C)shali be taken as the base for future cast-of-living adjustments. The rate of pay applicable for the year 1851 shall be con- sidered the appropriate rate to correspond to the Cd' . S. of 170.0. Thereafter, prior to preparation of the annual budget tk-e average of the C.P.T. figures for March l5, and June 15, just past shall be computed. C. Pay Rate Adjusted to CPI Rates ~f gay far each class of position and each employee shall be adjusted. Individual rates of pay shall be ad~t~.sted from range to range to tae nearest pay step ("~A°,uB",-'Ctr,uDu~r-Eu~orrr:Fa) which correap- onds to the changes in cast-of-living according to the following sc}aedulea If an increase (or decrease) of over 2~ (3.~4 C.P.I. points) but lase than 6°fo (lo.~ C.P. ., points) has occurred between the base figure of 170.0 and the average•.pf the CPI figures for Marsh l5 and June 15 just pasty the salary of each employee shall be adjusted to the corresponding step of the next consecutive higher (or lower) pay range. If the increase (or decrease} is 6~ (10.~ CPI point} or more bat not less than 10~ (1'j0.0) (CPI points) the salary of each employee shall be adjusted to the corresponding step of the second consecutive higher (ar lower) pay ra.~zge, and so on depending upon the extent of changes in CpI figures. Monetary Pay Any salary range established for a class aha11 represent the total remuneration for full-time employment in the olasa~but sh all be considered as reimbursement for official travel or other e~cpenses.which may be allowed for the conduct of official business. Unless approved by the appointing authority, no employee shall receive pay from the municipality '~ in addition to the salary authorized far a~ position or positions to which ~ he has been appointe~.~ This shall not operate to prevent employees from working in mama than one position when authorized. SECTION l6. OVER TIME PAYMENT. Authorized ovex-time work normally shall be compensated for by allowing employees a proportionate amount of time off, to be taken within g0 days of the time earned. All over-time work in excess of 16 hours earned in any one ca].endax month shall be paid for at the regular rate of pay. The assignment of over-time work shall be conditioned upon uniformity and equality of treatment as among employees. SECTION 17. VACATION I-EAVE ~ A. How Much Each provisional probationary, and permanent employee sha11 earn vacation leave at the rate of one working day per calendar month of fuli- time service; or mayor fraction of a month or such servic®, except that vacation leave granted probationary employees sha11 not be available for use until satisf actory completion of the initi a1 (not promotional) probationary period.. i B. When Taken Vacation Ieave may be used as earned provided that the appointing authority shall determine the time at which vacation leave may be taken- ~ and. no new employee may use vacation ]e eve prior to completion of six months of service. 0. Accrual.. Employees may accrue vacation leave to a maximum of eighteen (18) working days. In the event an employee has been unable to take advent- ~ age of vacation leave as earned, with the result that said employee has accumulated a total of eighteen (18) working days vacation, he may absent himself from work without notice to take vacation leave and thus prevent the loss of vacation leave beyond the maximum of eighteen (l8) days. LEAVE W~HOUT PAY A. Limits A permanent employee may be granted leave of absence without pay. or .benefits for a period of not to exceed ninety (g0) days, unless a request for extension is approved by the department head ar~d th~+ appoint- ed authority, for sickness, disability, jury duty, or other good and suf~.cisn~t reasons which are considered to be of the best interests of the municipality. • B. Jury Duty Tn the case ~f jury duty.; however, an employee shall receive an amount of compensation which will equal the difference between the employee's regular pay and oompensatioa paid f~-r jury duty.. Dr Exceptions= • Att®ndanco at of~'icial meetings, where the good of the municipality's service is 9.nvolved shall be considered a.a time bn duty w9:th3ri the mean- ing of this ordinance except that such attendance at meeting outside the State or as otherwise specified by the appointing authority must be approved in advance by the appointing authority. SECTION 22. Holidays Municipal employees, whether working on a full.-time basis, hourly, daily, or monthly, may observe eight holidays unless such employees are required to be on regular duty.. The eight holidays shall be New Year's Day, Labor Day, Decoration Day, Thanksgiving Day, Fourth of July, Christmas Day. Such two (2) other holidays as the appointing authority sY~all authorize for each employee. The Village Hall shall be closed for business on only the six (6) holidays specfically listed above. The two additional holidays shall be two of the following, but the municipal off ices shall not be closed on these days; Lincoln~a Birthday; G~ashington's Birthday; Good Friday; Columbus Day; Armistice Day. When a holiday falls on Sunday and it is customarily celebrated on the following Monday, that Monday shall be considered the holiday. A11 employees who are required to be on duty on any. holiday shall either be given the following day as a holiday or given an additional day of vacation leave, at thed~.scretion of the appointing authority. SECTION 23. RESIGNATION. Any employee wishing to leave the municipal service in good standing shall file with his department head, at least fourteen (14~) days bef ore leaving, a written resignation stating the effective date of the resignation and the reason for leaving. Failure to comply with this procedure may be considered cause for denying such employee future employment by the municipality and denying terminal leave benefits. Unauthorized absence from work for a period of three working days may be considered by the department head as a resignation without benefits. S:~TION 2~. GRIEVANCE POLICY It shall be the policy of the municipality to adjust grievances of 76 I employees promptly and fairly. Within, the framework of existing laws and regulations every effort shall be made to adjust grievances in a - manner mutually satisfactory to employees and management. An employee who believes he has received inequitable treatment because of some con- dition of his employment may personally or through his represenative, appeal for relief from that condition. A. Proper Channels of Appeal. (1} An employee shall take up any grievance with his immediate supervisor first, if the matter is not then settled, the employee may discuss the mattex with his department head. (2}. If the grievance arises out of a matter over which the supervisor or department head has no control, the employee may request his supervisor or department head to carry such grievance on his behalf to the appropriate authority. The supervisor or department head sha11 be obligated to transmit such an appeal to the appropriate authority regardless of his evaluation of the validity of the grievance. B. Report in Writing The supervisor or department head sha11 furnish to the employee a dated statement in writing of the results of such an appeal. • C. Appeals from decisions of Department Heads. Employyees who ~desireto appeal to the appropriate authority decisions of their department heads in grievance matters may do so. Such appeals must be in writing, must be dated, and must state fully the nature of the :grievance, and the steps wY:ich have been taken to achieve its settlement. D. Protection of Employees Officials of the Village at all levels sha11 be responsible for receiro•ing and acting upon grievances of employees under their jurisdiction. Tn the presentation of grievances at any supervisory level, employees shall be free from restraint, interference, discrimination, or reprisal. SECTION 25 LAY-OFFS The appointing authority may Iay off any employes whenever such action is made necessary by reason of shortage of work or funds, the abolition of a position, or because of changes in organisation. T3ow ever, no permanent employee shall be laid off while thexe axe temporary, provisional, or probationary employees serving in the same class of positi-one far which the permanent employee is qualified, eligible, and available. S]~TION 26. SUSPENSION fihe appointing authority may suspend an employee without pay for d~,scip'.ina._y reasons. Such suspensions shall not exceed thirty (~0} da~rs in any .one calendasr year. SECTION 27 Demotions An employee may be demoted by the appointing authority for ineffi~ dent performance of his duty, for disciplinary reasons, or far good and sufficient reasons. SECTION 2$ DISMISSAL No officer or employes subject to the provisions of this ordinance after completion of the initial probationary period, shall be dismissed from the municipal service except for cause. Evidenco of the following shall be sufficient cause for dismissal: 77 1. Incompetence or inefficiency in the performance of his duties; 2, Conviction of a criminal offense or a misdemeanor involving moral turpitude; 3. Violation of any lawful or official regulation or order or failure to obey any lawful direction made and given by his superior officer where s uc h violation or failure to obey amounts to an act of insubordination or a breach of proper discipline, or has resulted or reasonably might be expected to result, in loss of injury to the municipality or to the public; ~. Intoxication on duty 5. Contraction of an infectious disease; 6. Physical or mental defect which, in the judgment of the appointing authority, incapacitates the employee for the proper performance of the duties of his position. 7, Wanton use of offensive conduct or language toward the public or municipal officers or employees; 8. Failure to pay or make reasonable provisions for future payment of just debts due or owing by him, causing thereby annoyance to officers and employees of the municipality; g. Carelessness and negligence in the handling or control of municipal property; 10. Inducing or attempting to induce an officer or employee of the municipality to commit an unlawful act or to act in violation of any lawful and reasonable official regulation or order; 11, Taking any fee, gift, or other valuable thing in the course of his work or in connection with it, from any citizen for his personal use, when such fee, gift or thing is given in the hope or expectation of receiving a favor or better treatment than that accorded other citizens; 12, Conduct in private life which brings discredit upon the municipal service; 13, Proven dishonesty in the performance of his dut3,es; l~M. Violations of the provisions of this ordinance. SECTION 2g. RIGS' TO 1~PPE.AZ In all cases of suspension, demotion and dismissal the reasons far such action must be presented in a dated written statement to the employee affected. Upon the employee's dated written request to the appointing authority filed with the village clerk within five t5) working days of receipt of the statement of reasons, an employee shall be granted a hearing before the ap- pointing authority said hearing to be held not later than ten {10) days from the date of filing of a request for a hearing. SECTION 30. PROHIBITIONS No person shall wilfully or corruptly make any false statement cer~ tificate, mark, rating or report in regard to any test, certificate, or ap- pointment held or made under the municipal personnel system or in any manner commit or attempt to commit any fraud preventing the impartial execution of the provisions of this ordinance, No person seeking employment to ar promotion in the municipal service, shall either directly or indirectly give, render, or pay any money, service, or other valuable consideration to any person for or on account of or in connection with his test, pro- posed appointment, promotion, or proposed promotion. 78 -~-~-- _._ _ ~.
