AN ORDINANCE AMENDING AN ORDINANCE GRANTING TO

AND ALLEYS THEREOF FOR THAT PURPOSE.
THE VILLAGE COUNCIL OF RICHFIELD DO ORDAIN AS FOLLOWS:
Section 1. That the ordinance entitiled:"•AN ORDINANCE GRANTING

1~eing an ordinance adopted September g, 194, is hereby amended~by'adding
thy.following new sections immediately after Section d of said ordinances
"Section '~. The Company shall at all 1'sinies pz`avide and furnish an adequate
saf® acid continuous supply of gas to the Vi.].lag~ and its inhabitants; sut*-
ject~ htlwever, , to the further provisions of ~~-3,s section. The Company
sells. and distributes straight natural gas, througYiout its entire gss
d#.~t~.+3.`lsution system; which, is located in tYie City. of Minneolis; Mi~i~i®sots,;
and in s, number of suburb~l .communities and in ties. territory ad3acer~ to
and near. the said c~.ty. The natural gas diSt3'3.butsd by the Company is
f'urni,s]~ed by the pipe line. system owned ansi opef'ated by the ,Northern
Natural Gas Company, a "natural gas company." uriti.s~ the Federal Naturs,~.
Gan Act, -which subjects said Nor,~hern Natural Ga,s Company .to the juris-
diCtion of the Federal Power Commission:
'The Company shall not' be l.iabl'e to the Vi12,age.or its inha:~itants,
nor shall the village, or any inhabit~i.t Who is a customer of the Company
be liable to the Company hereunder by season of the i`nilure of the
Company, to d®litrer, or of a Village or a customer to receive natural
gas a,s a result of acts of God, or the public enemy, inability of pipe
~.ine supplier to furnish adquate supply due to an emergency, an girder
or decision of a public regulatory body, or other acts beyond the control
of the party affected.
"Whenever any of the occurences named above take place, the Company
shall have the right 'and authority and it shall be its duty to adopt
reasonable rules and r®gulatians~in connection with limiting, curtail..
ing or allocating extensions of service or supply of gas tc any customers,
or prospective customers, and withholding the supply of gas to new
customers, provided that such rules and regulations shall be uniform
as applied to each class of customers, and shall be nondiscriminatory
as between communities.
"The Company shall have the right to contract, for the sale of gas
for industrial use on an interruptible basis, requiring the customer to
have standby equipment for use upon notice by the Company, The COmpany~s
rules regulations, schedules or contracts for curtailing interruptibl®
gas service shall be uniform as applied to each class of interruptible
customers.
"'If service is temporarily suspended because of any of the reasons

part of the (company! such suspension shall not' b~ m~t~ .hits bass of any

gas sold in the Village shall be the same as t at sold ~e the Company's
customers in the City_of Minaeapolis.
