1979-125•~ ). .; HRA RESOLUTION NO. 125 RESOLUTION AUTHORIZING EXECUTION OF DEVELOPER'S AGREEMENT, AUTHORIZING THE PURCHASE OF CERTAIN REAL PROPERTY AND AUTHORIZING ITS RESALE PURSUANT TO SUCH DEVELOPER'S AGREEMENT WHEREAS, the Housing and Redevelopment Authority has authorized David. Ames and Robert Dippen as developers for the New Home Scattered- ..Site Psngram; and ~~EI3EAS, the Executive Director has been authorized to negotiate a developer's agreement with David Ames and Robert Dippen in furtherance of the New Home Program heretgfore adopted by the. City. of Richfield and the- Housing and Redevelopment Authority of the City of Richfield; and WHEREAS, the Executive Director has now presented a proposed Developer's Agreement between the Housing and Redevelopment Authority of Richfield, Minnesota, and the Ames Corporation which agreement achieves the goals of the New Home Scattered-Site Program; and WHEREAS, in furtherance of its intention to provide suitable properties for development pursuant to such agreement, the Housing and Redevelopment Authority has authorized its Executive Director and Attorney to negotiate for the purchase of certain real property for the purpose of resale to the developer, said property being described as follows: Lot 5, Block 15, Tingdale Brothers' Lincoln Hills Third Addition (6916 Queen) Lot 2, Block 22, Irwin Shores (7504 Colfax) Lots 83 and 84, Western Surety and Adjustment Company's Addition "The Pines" (11 East 68th Street) Lot 6, Block 5, Nokomis Gardens Rearrangement of Blocks 1, 2, 3, 4 and 5, Girard Parkview Addition (6530 Bloomington Avenue); and _ _ WHEREAS, the Housing and Redevelopment Authority of Richfield, Minnesota, is authorized by Minnesota Statutes 462.445 to purchase real property; and WHEREAS, the Housing and Redevelopment Authority of Richfield, Minnesota, has caused appraisals of the subject properties to be made and has carefully considered such appraisals; and WHEREAS, the negotiations for the real property described above have resulted in the execution of purchase agreements based upon such appraisals; and _ WHEREAS, i~--~urti~erance ~f its intentifln to pravide suitable prap~erties-fvr development pursuant to such agreement it is necessary, and practical that the following property presently owned by the Housing and Redevelopment Authority also be provided for sale to the developer pursuant to and in accordance with the terms of the developer's agreement: Lot 2~, and the West 36 feet of the North 10 feet of Lot 3, Block 2, "Wooddale Second Addition" (7104 Second Avenue); and _ WHEREAS, the proposed project is necessary to alleviate a shortage of decent, safe and sanitary housing for persons of low or moderate income as previously defined by the Authority; and WHEREAS, upon public hearing preceded by the required notice, it appears that giving fair consideration to the estimated fair market or rental value of the cleared lands as determined pursuant to Minn. Stat. 1978 X462.541, the sale of all such lands to the proposed developer pursuant to and in accordance with the terms of the developer's agreement is appropriate and permitted by law. Resolution No. 125 NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority of Richfield, Minnesota, as follows: 1. That the Executive Director and Commission Chairman are authorized to execute the proposed developer's agreement. 2. That in accordance with the terms and conditions contained LJ therein, the Executive Director and Commission Chairman are authorized to purchase the four parcels above described for the following purchase prices: 11 East 68th Street - $26,~flfl , 6 91 b Queen Avenue - 23 , fl D 0 _ _ ?504 Co3fax Avenue ~ - 20, 000 6530 Bloomington Avenue - 27,000 3. That in accordance with and subject to the terms and conditions contained in the developer's agreement, the Executive Director and Commission Chairman are authorized to sell the five lots herein described.
