1978-104HRA RESOLUTION N0. 104 113 FI1`IDINCS AND DETEFLNIINATIONS BY, ' _ AND RESOLUTIONS OF THE HOUSIPdG APTD REDEVELOPMENT AUTHORITY OF RICHFIELD, MINNESOTA, RELATIVE TO AN APPROVAL OF A BOUNDARY '~40DIFICATIODT FOR THE LYNDALE-HUB-NICOLLET REDEVELOPMENT AR.~A IN RICHFIELD, n4INNESOTA ENTITLED "LYNDALE-HUB-NTCOLLET COA'iMERCIAL IMPROVEP~IFN?' PROCF.An?" WHEREAS, the Authority did on October 15; 1975, by resolution bearing ghat date approve a redevelopment plan for an urban renewal plan for the Lyndale-Hub-Nicollet area of Richfield entitled "LYndale- Hub-Nicollet Commercial Improvement Program" which consists of-the: Lyndale/Hub/Nicollet Area Study; Phase I a. Inventory b. Economic Potentials Analysis c. Problem Assessment Determination Phase II a. Alternative Plans and Evaluations Phase III a. Development Plan b. Urban Design Elements c. Project Costs and Financing and WHEREAS, upon application to the City Council of the City of Richfield, Minnesota, the City Council did on November 24, 1975, by resolution bearing that date approve the plan in all respects includincT the proposed method for financing; and WHEREAS, the Housing and Redevelopment Authority has now proposed a modification to such redevelopment plan which modification would result. in the inclusion in the project area the following additional parcels: 114 - 2- r Lots 15, 16, 17 aid 18, Blc^k 3, Fairwood Shores Addition, _ Hennepin County, Minnesota r and i WHEREAS, the modification was: duly transmitted by the Authority to the Planning Commission of the City of Richfield, being the duly desginated and acting official Planning agency of Richfield, for its - study and with a request for a written opinion thereon; and - WHEREAS,' the-said Planning Commission, at its meeting of November 28, 1978, did, by resolution duly adopt and render its written opinion of the modification; and - WHEREAS, the. Authority, prior to proceeding with the modification -must first approve the`modi.ficaticn-and thin-apply to the City Council ~='v of the City of Richfield, 'Minnesota, for approval of`the modificatio and receive .such approval. NOW, THEREFORE, the Housing and Redeve]:opment Authority of-the . City of .Richfield, Minnesota does hereby make the foll.owincx findings and determinations: 1. That the area ~.nelr~rlec~ within the -Plan ac mod?_fitd (she "Project Area") is a deteriorated and deteriorating-area within the meaning~~of i~tnnesota Statutes 1977- Supplement, X461.421 Subd. 11; 2. That the-urban renewal project proposed by the Plan as modified is necessary to eliminate,. and prevent the spread of such. deterioration within-the Project Area as modified; 3. That the Project Area as modified is subject ao conditions preventing. private development and would not: be made available for redevelopment without the governmental assistance and financial aid proposed. by the-Plan; 115 4. That the Plan as modified affords maximum opportunity for redevelopment of the Project Area as modified by private enterprise, S consistent with the sound needs of the locality as a whole; 5. That the Plan as modified provides an outline for the develop- ment and redevelopment of the Project Area as modi~ied and is suffi- ciently complete to indicate the relationship o.f the Plan to the objectives of the City of Richfield as to appropriate land uses within the Project Area as modified, and to indicate the general land uses and general standards of development or redevelopment within the Project Area as modified; 6. That there is a feasible method for the. temporary relocation of families who may be displaced from the Project Area as modified, and that there are available, or will be provided, in the Project Area as modified, or in other areas not less- desirable in regard to public utilities and public and commericla facilities, and at rents or prices within the financial means of the families who may. be displaced from the Project area as modified, decent, safe, and sanitary dwellings at least equal in number to the number of families who may be so displaced; that the Authority, in acquiring any properties must and will .provide all relocation assistance and benefits required by the Federal Uniform Relocation Assistance and Real Property Acquisition Policies Act o 1970, and acts admendatory thereof, any regulations duly adopted z:ur- suant thereto, and any regulations duly adopted by the State ofi Minnesota, its agencies, or political subdivision, pursuant to la~•r; -- ~- 7. That the objectives and purposes- of the-Plan as modified conform to and are- consistent with th:e c;enera~. land user_ronosals and planning objectives previously, from time to time, established by the Planning Commission of the City of Richfield for development of the Project Area as modified; 11:6 -4- 8. That the Planning Commission of the City of Richfield, by resolution dated November 28, 1978, did render its written opinion o: the modification, which opinion was that the Plan modification shoul be approved by the Authority and the City Council and be implemented and carried out as soon as possible. THEREFORE, the Authority does hereby resolve and direct as follocas: A. That the Project Area modification to the Plan adding the following parcels to the Project Areas: Lots 15, 16, l7 and l8, Block 3, Fairwood Shores Addition, Hennepin ~Cz3urity Minnesota is in all respects hereby approved; B. That the Authority should apply to the City Council of the City of Richfield, Minnesota for approval of. the Plan modifica- tion, and does hereby authorize and direct the Executive Director of the Authority, for and in behalf of, and in the name of, the Authority, to make application to the City Council of the City of Richfield for approval of the Plan modification and to take such other action and submit to the City Council such other information and material as this Executive Director may deem necessary or advisable in order to obtain and expedite the approval of the Plan modification by the City Council; C. The Secretary of the Authority is hereby directed to file a copy of the Plan modification and a copy of the written opinion of the Planning Commission of the City of Richfield with the minutes of this meeting of the Authority; D. That the ExecutivE Director of the Au~ilority is hereby further authorized and directed to transmit to the State Housincr Commission certified copies of the plan modification and t.Ze caritten opinion of the Planning Commission; -5- 1..17 E. That the Executive Director of the Authority i.s hereby further authorized and directed, immediately upon approval of the plan modification by the City Council of Richfield, r'tinnesota, to rec.xuest for and on behalf of, and in ~i:he name of.~, the Authority, the. r Auditor of Hennepin County '~innesota to certify the assessed valuation of all taxable real property within the Project Area modification as then most recently determined, in order to fix the "Original taxable value" for tax increment financing purposes, pursuant to Minnesota Statutes 1977 Supplement, Section 461.585, and to do all other acts and furnish to the said County Auditor all documents the Executive Directory deems necessary or desirable to fix sucri "original tax value" as soon as possible after the Plan modification is approved by the City Council; and, F. That the Executive Director of the Authority is hereby further authorized and directed to take all such action, including furnishing of documents, as he deems necessary or desirable, for and in behalf of, and in the name of, the Authority to obtain and expedite approval of the Plan modification by all necessary or desirable agencies political subdivisions, persons, and authorities, and to • obtain and expidite all necessary financing in con.f_ormance with the financing method proposed by the Plan.
