RESOLUTION AUTHORIZING EXECUTION
OF STIPULATION RELATING TO
ACQUISITION OF CERTAIN REAL
PROPERTY AND IMMOVABLE FIXTURES
(Flowertown)
WHEREAS, the City of Richfield and the Housing and
Redevelopment Authority of Richfield have jointly commenced
an action for the acquisition by eminent domain of the
following described property:
"The West 25 feet of the South 140 feet of
Lot 9, Block 4, "J. N. Hauser's Second Addition"
and that part of Lot 10, Block 4, "J. N.
Hauser's Second Addition" lying South of the
North 117.56 feet thereof;
and

WHEREAS, Jonathon Building, the fee owner of the property,
and Fl-owertown, Inc., a leasee, have heretofore objected to
and challenged the City and HRA's authority to acquire such
land by eminent domain; and
WHEREAS, such parties are desirous of withdrawing said
objections and stipulating to the terms and conditions of
acquisition by. the City and the HRA; and
WHEREAS, all such matters are acldressed in the proposed
stipulation which is attached herewith as Exhibit "A" and made
a part hereof as if fully set out at this point; and
WHEREAS, the Housing and Redevelopment Authority has
carefully reviewed such stipulation and is familiar wittl its
contents.

NOW, THEREFORE, BE ST RESOLVED by the Housing and
Redevelopment Authority. of Richfield, Minnesota, as follows:
1. The stipulation contained in Exhibit "A" hereto
- is approved.
2. The Chairman and Executive director are authorized to
execute the stipulation.
3. • .The Authority Attorney is authorized to offer the
stipulation into evidence at any hearing on the condemnation
proceeding.
4. The Authority Staff is authorized and directed to take
all-necessary steps to implement the terms and conditions of
the- stipulation as they relate to acquisition of the property
therein described.
- Passed by the Housing and Redevelopment Authority of the
City .of Richfield., this. 14th day of September, 1978.
