1978-9910$ ..~ • ~4 ~ RESOLUTION NO. 99 RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY LEASEHOLD INTEREST BY EMINENT DOMAIN PROCEEDINGS (FLOWERTOWN) WHEREAS, the Housing and Redevelopment Authority of Richfield, Minnesota, did on the 15th day of October, 1975, adopt the Lyndale/ Hub/Nicollet Commericial Improvement Program at which time it was deter-mined that the project area was deteriorated and deteriorating within the meaning of Minnesota Statute Section 462.421, Subdivision 11; and, WHEREAS, the Lyndale/Hub/Nicollet Commercial Improvement Pro- gram has been determined to be necessary to eliminate and to prevent the spread of such deterioration; and, WHEREAS, the Housing and Redevelopment Authority of Richfield has acquired fee simple title to certain real property within the project area and legally described as: The South 78.45 feet of the North 278.45 feet of Lot 9, Block 4, J. N. Hauser's Second Addition; and, i WHEREAS, such ownership is subject to a leasehold interest of Naegele Outdoor Advertising Company for the maintenance of two poster panel signs with a roof-top installation located on a one story building at 6513-15-21 Lyndale Avenue South known as the Woodlake Cleaning Center Building; and, 6VHEREAS, the Housing and Redevelopment Authority of Richfield, P-linnesota, finds it to be necessary, proper and expedient in the interest of the public health, safety, convenience and general welfare of the citizens of the City of Richfield, Minnesota, to acquire for public purposes of redevelopment said leasehold interest in the subject real property at the earliest possible date; and, . WHEREAS, the acquisition of the interest in the subject property is consistent with and necessary to the successful implementation of the Lyndale/Hub/Nicollet Commercial Improvement Program and to the elimination of, or prevention of, the spreading of deterioration within the project area; and, WHEREAS, it is in the public interest that title to and possession of such interest be acquired before the filing of an award by court- appointed commissioners; NOW TIiEREFOP.E, be it resolved by the Housing and Redevelopment Authority of Richfield, Minnesota as follows: ,. 'Lsa" r Commencement of eminent domain proceedings in the name of the Housing and Redevelopment Authority of Richfield, Minnesota, is authorized for the purpose of acquiring the leasehold interest in the subject real property for the purpose of redevelopment. The leasehold interest to be condemned relates to property in Hennepin County and is legally described as: The South 78.45 feet of the North 278.45 feet of Lot 9, Block 4, J. N. Hauser's Second Additi:an. Authority is further given to obtain title and possession as soon as may be allowed by law.
