1978-88. ,- 95 s . ~L ~- RESOLUTION NO. 88 RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY BY EMINENT D0~2AIN PROCEEDINGS •w ANA AUTHORIZING THE EXECUTION OF A JOINT ACQUISITION AGREEMENT WHEREAS, the Housing and Redevelopment Authority of Richfield, Minnesota, did on the 15th day of October, 1975, .. .. adopt the Lyndale-Hub-Nicollet Commercial Improvement Program . at which time it was determined that the project area was deteriorated and deteriorating within the meaning of Minnesota Statute Section 462,421, Subdivision 11; and ` WHEREAS, the Lyndale-Hub-Nicollet Commercial Improvement Program has been determined to be necessary to eliminate and to prevent the spread of such deterioration; and WHEREAS, the property described as: The West 25 feet of the South 140 f eet~of Lot 9, Block 4, "J. N. Hauser's Second Addition", and t;iat part of Lot 10, Block 4, "J. N. Hauser's Second Addition" lying Sout:n of the North 117.56 feet thereof ar.d North and East of the following described line: _ Commencing at a point on the South-line of said Lot 10 distant 90.00 feet East from the Southwest corner of said Lot 10, thence Northerly 150.00 feet at right angles to the South line of said Lot 10; thence Northwesterly, deflecting to the left 69 degrees, 65 minutes, 30 seconds to a point 117.56 feet Southerly measured at right angles from the North line of said Lot 10, and there terminating. is within the project area; and WHEREAS, the Housing and Redevelopment Authority of Richfield, "~innesota, finds it to be necessary, proper and expedient in the interest of the public health, safety, convenience and general ~~ .~ 96 welfare of the citizens of the City of Richfield, Minnesota, to acquire for public purposes of redevelopment said property at the earliest possible date; and WHEREAS, the acquisition of the subject property is consistent with and necessary to the successful implementation of the Lyndale-Hub-Nicollet~Commercial Improvement Program and to the elimination of, ~or prevention of, the spreading of deterioration within the project area; and WHEREAS, it is in the public interest that title to and possession of such property b:e acquired before the filing of an award by court-appointed commissioners; and WHEREAS, the City of Richfield intends to acquire fee title to a part of the same tract of land which are subject to this resolution; and WHEREAS, it would be desirable, efficient and expeditious if the proceedings hereinafter authorized were prosecuted jointly with the eminent domain proceedings to be authorized by the City of Richfield; and WHEREAS, Minnesota Statutes Section 117.016 provides for the making of joint acquisition agreements by and between various authorities having the right of eminent domain; NOW THEREFORE, be it resolved by the Housing and Redevelopment Authority of Richfield, Minnesota as follows: 1. Commencement of eminent domain proceedings in the name of the Housing and Redevelopment.Authority of Richfield, rinnesota, is authorized for the purpose of acquiring a fee simple absolute ~~ C' -2-
