1978-8390 HRA RESOLUTION NO. 83 • RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN REAL PROPERTY BY EMINENT DOMAIN PROCEEDINGS _ (600 West 66th Street) WHEREAS, the Housing and Redevelopment Authority of Richfield, Minnesota, did on the .15th day of October, 1975, adopt the Lyndale-Hub-Nicollet.Im- provement Program at which time it was determined that the project area was deteriorated and deteriorating within. the meaning of Minnesota Statutes Section 462.421, Subdivision 11; and WHEREAS, the Lyndale-Hub-Nicollet Commercial Improvement Program has been determined to be necessary t~ eliminate, and prevent the spread of such deterioration; and WHEREAS, property legally described as: "That part of Lot Nine (9), Block Four (4), in 'J. N. Hauser's Second Addition', described as follows: Commencing at-the Southeasterly corner of said Lot Nine (9); thence north along the East line of said Lot One Hundred Forty (140) feet; thence West and parallel with the South line of said Lot Forty (40) feet; thence South and parallel with the East line of said Lot One Hundred Forty (140) feet more or less to the South line"of said Lot; thence East along the South line of said Lot Forty (40) feet, more or less to the point of beginning, according . to the plat thereof on file and of record in the office of the Registrar of Titles in and for the County of Hennepin, State of Minnesota." is within the project area; and WHEREAS, the Housing and Redevelopment Authority of Richfield, Minnesota, finds it to be necessary, proper and 'expedient in the interest of the public health, safety, convenience and general welfare of the citizens of the City of Richfield, Minnesota, to acquire said property at the earliest possible date; and Resolution No. 83 - 2- WHEREAS, the acquisition of the subject .property is consistent with and necessary to the successful implementation of the Lyndale-Hub-Nicollet Commercial Improvement Program and to the elimination, oz prevention of the spreading of, deterioration within the project area; and WHEREAS, it is in the. public interest that title to and possession of such property be adquired before tha filing. of an award by court- appointed commissioners. NOW, THEREFORE, be it resolved by the Housing and Redevelopment Authority of Richfield, Minnesota, that the Executive..,D;irector, acting as agent for the Housing and Redevelopment Authority is hereby authorized and directed to commence eminent domain proceedings to acquire a fee simple absolute interest in the subject property for the purposes of redevelopment. The property to be cor_demned sha7.l be the property being in-Hennepin County and legally described as follows: "That part of Lot .Nine (9.), Block Four (4), in 'J. N. The Executive Director is authorized and directed to seek to have title and possession transferred as soon as is allowed by law.
