The meeting was called to order by Mayor Hamilton at 7:06 p.m.
PLEDGE OF ALLEGIANCE
Item #1 OU IL AND A NSID RATION OF A REQUES TO AMEND THE
DEVELOPER'S AGREEMENT AND RELATED DOCUMENTS WITH MARKET
PLAZA C.L. 309 HRA LETTER 44.
Acting City Manager Devich reviewed Council Letter No. 309,
HRA Letter No. 44 regarding a request by the Market Plaza
Developers to consider several amendments to the Developers
Agreement, Assessment Agreement, and Agreement to Pay
Deficiencies.
City Attorney LeFevere stated that the Developer had
delivered the amendment documents less than three hours before
the meeting, and did not allow for proper legal review of the
documents. Mr. LeFevere explained the various amendment
documents to the HRA and City Council. He indicated that while
the amendments had been delivered too late for his office to
complete a thorough review, his initial examination revealed
several areas of concern regarding contract language and
omissions. Therefore, he recommended no action be taken at this
time so that further review and refinement of the documents can
be done.
Thomas Harms, HRA Chairman, suggested this item be deferred.
M/Ludeman, S/Harms to defer HRA consideration of a request
to amend the Developers agreement and related documents with
Market Plaza C.L. 309 HRA Letter 44 to the Se tember 9 1985
Joint HRA City Council Meeting.
Motion carried 4-0.
The City Council passed the same motion.
Item #2 NSIDERA ON OF A REQ EST BY HE WOODLAKE POINT
DEVELOPER TO REDUCE THE $25,000 LETTER OF CREDIT BY
FIFTY PERCENT C.L. 310 HRA LETTER 45
Acting City Manager Devich reviewed Council Letter No. 310,
HRA Letter No. 45 regarding a request by the Woodlake Point
Developer to reduce the $25,000 Letter of Credit by fifty
percent. He stated that the developers agreement provided for
the Letter of Credit reduction once the project is 30I
completed. The project was now at least 30~ completed. Mr.
Devich stated that only HRA action was necessary for this item.

submit a new letter of Credi in the amount of 12 500 for he

Motion carried 3-0.
