SPECIAL CITY COUNCIL MEETING
April 15, 1993
MEMBERS PRESENT: Martin Kirsch, Mayor; Susan Rosenberg; Russ
Susag; Michael Sandahl; and Don Priebe.
STAFF PRESENT: Steven Devich, Acting City Manager/Acting
City Clerk; Donald Fondrick, Community
Services Director; and Mike Eastling, City
Engineer.
The meeting was called to order by Mayor Kirsch at 6:00 p.m.
Item #1 CONSIDERATION OF RECOMMENDATION FOR AWARD OF CONTRACT
RELATED TO RIGHT OF WAY CLEARANCE FOR PHASE I OF 77TH
STREET IMPROVEMENT PROJECT. C.L. NO. 121 and C.L. N0.

Acting City Manager Devich reviewed Council Letters No. 121
and 122 concerning consideration of recommendation for award of
contract related to right of way clearance for Phase I of the
77th Street Improvement Project.
Council Member Sandahl asked if the wells will be properly
abandoned and if the bidders knew the engineering estimate prior
to bidding.
City Engineer Eastling responded that the wells would be
properly capped and that the bidders did not know the engineering
estimate ahead of time.
Council Member Susag asked who determined the engineers'
estimate and if the City or State was familiar with TCM
Construction.
Community Services Director Fondrick responded that it was
MnDot's estimate and that MnDot was aware of TCM and had no
problem with them.
Council Member Sandahl asked if a bid bond was provided by
the contractor.
Community Services Director Fondrick responded that a 5~ bid
bond was submitted.
Council Member Priebe asked if the State had a listing of
approved disadvantaged contractors.
Mr. Fondrick said the State had such a listing and had
verified TCM as a disadvantaged contractor.
Council Member Susag asked that Mr. Fondrick provide a time
table for the work on the 77th Street Project.
Council Member Sandahl asked that such a schedule be
prepared reflecting milestone events in the construction process.

Mr. Fondrick responded that~a schedule would be prepared
after the April 19 Special City Council Meeting which will be
held concurrently with the Housing and Redevelopment Authority.
M/Susag, S/Priebe that the City Council recommend award of
contract for right of way clearance for Phase I of the 77th
Street Improvement Project to TCM Construction, Inc. in the
amount of 5176,628.83.
Motion carried 5-0.
