04-04-1988CITY OF RICHFIELD, MINNESOTA CITY COUNCIL STUDY SESSION April 4, 1988 MEMBERS PRESENT: Steven Quam, Mayor; Ivan Ludeman; Michael Sandahl; Martin Kirsch; and Edwina Garcia. STAFF PRESENT: James Prosser, City Manager; Steven Devich, Administrative Services Director; Thomas P. Ferber, City Clerk; Donald Fondrick; Community Services Director; Byron Wallace, Community Development Director; John Erskine, Public Safety Director; and Larry Miller, Hennepin County Principal Property Appraiser. ADVISORY BOARD OF HEALTH: Jane Koenig, Susan Rosenberg, Randall Roehl, Anne Kinley, Jane Myre, Carol Olson, and Kevin Keller. OTHERS PRESENT: Don Priebe, MSAC Representative; David Braslau, David Braslau Associates, Inc. The meeting was called to order by Mayor Quam at 7:01 p.m. Items I DISCUSSION MITH THE ADVISORY BOARD OF HEALTH. STUDY SESSION LETTER N0. a Advisory Board of Health Chairperson Anne Kinley reviewed the health goals contained in the Guide for Promoting Health in Minnesota publication. She reviewed the accomplishments of the Board and stated that the objective of the Board was to address community health issues as they arise. Ms. Kinley stated that they are currently active in the formation of the Tri-City HIV Infection Task Force in conjunction with Bloomington and Edina. She also indicated the Board's desire for the addition of student members. Public Safety Director Erskine stated that the city council had passed a resolution on March 28 authorizing the addition of two student members to the Advisory Board of Health. City Manager Prosser reviewed the potential sources of providing health information to the community. Discussion followed regarding issues related to AIDS, food handling in restaurants, and health inspection programs. Study Session Meeting Minutes -2- April 4, 1988 Item II DISCUSSION RELATING TO 4/22 PROPOSED RUNMAY EXTENSION STUDY SESSION LETTER NO. 6 David Braslsu, David Braslau Associated, Inc., reviewed the issues and concerns raised by the environmental assessment of the proposed runway 4-22 extension. He reviewed slides depicting the current and proposed airport layout, projected air traffic growth, operation of the preferential runway system (PRS) flight track projections, noise contours, and MnDot Safety zones. Don Priebe, MSAC Representative, reviewed the potential impacts of the extension of runway 4-22 and the preferential runway system on aircraft noise in Richfield and adjacent • communities. Mr. Priebe advocated an equitable distribution of runway use. Council Member Sandahl suggested that. the City investigate legal avenues and the retention of a legal counsel specialist to block the extension of runway 4-22. City Manager Prosser stated that the city attorney has reviewed the legal issues and that the City should pursue administrative remedies prior to legal actions. Mayor Quam stated the need to continue to raise concerns through the administrative review process and seek additional information regarding the extension of runway 4-22. He discussed the political and public opinion aspects of litigation. City Manager Prosser indicated that city staff could identify potential legal counsel who have experience in airport issues and that the timing of any potential legal action is important. Council Member Sandahl stated the N.O.I.S.E organization could be a source of information in identifying a legal counsel. Mayor Quam suggested that the city continue to pursue further information regarding the runway 4-22 extension and that Council Member Sandahl and the City Manager identify potential legal counsel in this matter. 1 Study Session Meeting Minutes -3- April 4, 1988 Item III DISCUSSION REGARDING PRELIMINARY INFORMATION FOR 1988 BOARD OF REVIEW. STUDY SESSION LETTER N0. 5 Larry Miller, Hennepin County Principal Property Appraiser, reviewed the duties and responsibilities of Local Boards of Review, data regarding- Richfield home values, and sample property comparisons. Discussion followed regarding the affect of flooding on assessed values and- desirability of obtaining data from other communities regarding this issue. Item IV DISCUSSION RELATING TO WHETHER THE SALE ANDIOR CONSUMPTION OF BEER SHOULD BE PERMITTED IN CERTAIN CITY PARKS. STUDY SESSION LETTER N0. 7 City Manager Prosser reviewed Study Session Letter No. 7 regarding the interest of certain organizations in an ordinance which would allow beer to be possessed, consumed and sold in certain City parks. Council Member Sandahl stated that only under certain controlled situations he could support certain organizations having beer in the parks but could not support allowing beer for softball tournaments. Council members Ludeman, Garcia, and Kirsch spoke in opposition to changing the ordinance to allow beer in city parks. Mayor Quam stated his concerns regarding the abuse of alcohol and concerns regarding the criminalization of a family having beer in a park. Public Safety Director Erskine reviewed enforcement issues related to beer in the parks. It was the consensus of the council to not consider a change to the city ordinance prohibiting the sale, possession, and consumption of beer in certain city parks. City Manager Prosser stated he would contact the interested organizations. Study Session Meeting Minutes -4- April 4, 1988 Items V STATUS REPORT REGARDING TERRY FELDMANN'S IMPORTS ORDINANCE VIOLATION ISSUES. Community Development Director Wallace reviewed the enforcement actions related to the following ordinance violations at Terry Feldmann's Imports: 1) Signs located on and extending over the public right- of-way . 2) Display of vehicles on public right-of-way. 3) Violation of the special use permit for the property north of 77 Street relating to the designation of customer parking. 4) Use of the car wash site in violation of the zoning ordinance. Mayor Quam stated that granting a special temporary permit to allow the use of the car wash site could increase it's value and result in increased costs if the property were to be acquired for redevelopment. Community Development Director Wallace stated staff has been reviewing this issue. Council Member Sandahl stated his support for the enforcement actions. He stated concern about the public perception of the city requiring off street storage for cars but not allowing the use of carwash site for this storage. Council Member Ludeman stated support for allowing the use of car wash site and his concern about the timing of the C-3 ordinance in relationship to the purchase of this property. Council Member Garcia stated that she had received many calls from residents who support city efforts to assure car dealer compliance to city ordinances. Council Member Kirsch stated his support for continued enforcement actions. Item VI DISCUSSION OF HIRING AND PROMOTION POLITIES. City Manager Prosser reviewed the city's policies regarding hiring and the promotion of employees. 1 Study Session Meeting Minutes -5- April 4, 1988 Discussion followed regarding internal training, promotion from within opportunities, employee morale, and administrative authority in these issues. Council Member Kirsch requested that the council be provided with information regarding training and educational opportunities provided for employees.
