03-02-1987 Study SessionCITY OF RICHFIELD, MINNESOTA CITY COUNCIL STUDY SESSION March 2, 1987 MEMBERS PRESENT: John Hamilton, Mayor; Michael Sandahl; Martin Kirsch; Edwina Garcia; and Ivan Ludeman (arrived at 8:12 p.m.). STAFF PRESENT: James Prosser, City Manager; Steven Devich, Administrative Services Director; Thomas P. Ferber, City Clerk; Donald Fondrick; Community Services Director; Bruce Palmborg, Acting Community Development Director; Pat Coughlin, Assistant Fire Chief; Clayton LeFevere, City Attorney; Towhid Kazi, Community Development Aide; Rick Jopke, City Planner; and Lidy Flom, Community Development Aide. ADVISORY BOARD OF HEALTH: Joan Pelfrey, Jacquelyn Lockman, Lisa Peterson, Carol Olson, Ramona Rusinak, Larry Slepicka, and Anne Kinley. PLANNING COMMISSION: Gordon Herrboldt, Barbara Kritzman, Charles Kauth, Robert Jensen, Connie Hoverson, Maggi McDermott-Lindstrand, and Russell Kennedy. HOUSING AND REDEVELOPMENT AUTHORITY: Vern Luettinger and Joan Helmberger. OTHERS PRESENT: Lia Ozols, South Hennepin Human Services Council; Arijs Pakalns, BRW; Ron Batty, City Attorney's office. The meeting was called to order by Mayor Hamilton at 7:01 p.m. Item #1 DISCUSSION OF GOALS AND OBJECTIVES WITH MEMBERS OF THE ADVISORY BOARD OF HEALTH STUDY SESSION LETTER NO. 7 Advisory Board of Health Chairperson Anne Kinley reviewed the Richfield Advisory Board of Health 1986 Annual Report. Mayor Hamilton urged the board to not only advise the city council but to actively seek to initiate activities by bringing suggestions to the city council. Study Session Meeting 2 March 2, 1987 City Manager Prosser informed the board of the expanded opportunity for educational efforts through the new city newspaper. Mayor Hamilton and Council Member Sandahl urged the board to monitor the health issues related to AIDS so that current information is available. Larry Slepicka stated that the board was not sure how far it can go in suggesting programs because of budgetary constraints. City Manager Prosser stated that any suggestions should be channeled through the city council for their consideration. Item #2 JOINT DISCUSSION WITH PLANNING COMMISSION/HRA REGARDING FUTURE OF THE ILN AREA STUDY SESSION LETTER NO. 8 City Manager Prosser reviewed Study Session Letter No. 8 regarding a future strategy for the ILN Redevelopment Area. Arijs Pakalns, BRW, reviewed the concept of a new zoning district to be defined within the ordinances of the city. The ordinance would require that new development meet minimum standards in terms of lot size and floor area ratios. Height restrictions to prevent shadows on single family and two family dwellings would also be included. The new C-3 High Density Commercial District would provide city council control to insure development occurs within the framework of the ILN Redevelopment Plan once the moratorium is lifted in the area. Robert Jensen, Planning Commissioner, inquired why the northern portion of the CDR site Baas not included in the proposed C-3 District. City Attorney LeFevere stated that control is still maintained on this site because it is zoned. residential and a rezoning request would have to be approved if CDR proceeds with their project. Ron Batty, from the City Attorney's office, stated that the city, through the C-3 Zoning District, could include a site plan review process to create a climate for quality development, qualitative standards, and a means to address site assembly issues. He stated that the concept of minimum standards is appropriate in the Tax Increment District to insure development which can support the public improvements. He stated that this approach may raise questions on how to deal with the property owner of a small parcel who cannot develop under this ordinance. Council Member Sandahl asked if there would be a maximum for development. Study Session Meeting 3 March 2, 1987 City Manager Prosser stated that the maximum height would be governed by the shadow issue, probably 12 stories as a maximum, and that the ability to meet the parking standards would limit the size of any development. Planning Commissioner Jensen asked how undesirable development, such as a car dealer, could be restricted. City Manager Prosser responded that the ordinance would provide for permitted uses and exclude others. Planning Commissioner Jensen stated his concern regarding the rights of small property owners if exclusive rights are given to a developer for certain areas. Council Member Sandahl stated that their is a need to involve the property owners in a manner similar to the Graham Avenue Development. City Manager Prosser stated that the exclusive rights concept would give a developer time to prepare a project and work with property owners and the city so that when a development window of opportunity occurs, the developer is ready to proceed. He stated that it would be important to involve the property owners in the process. Arijs Pakalns stated that the time assurance would be important to developers and that an open selection process would be essential. Lawrence Wozniczka, 6744 Wentworth Avenue, suggested that public improvements should spur private development and that revised Lyndale Avenue improvements should be investigated. Council Member Ludeman stated support for involving the local businesses and property owners in the development possibilities. He asked if the 494 corridor study findings would affect the 77th Street road concept. Arijs Pakalns responded that the 494 study was not complete, but the 77th Street plan would best address the traffic, noise, and environmental issues in the ILN. Acting Community Development Director Palmborg reviewed the area proposed to be included in the C-3 District which would generally be from Lyndale Avenue to 35W, south of 77th Street. City Manager Prosser stated that the area east of Lyndale to Pleasant Avenue, south of 77th Street, was not included in the C- 3 area in order to concentrate and limit the impact to the area west of Lyndale Avenue. Study Session Meeting City Attorney LeFevere stated it may include the area east of Lyndale Avenue to development of the area. It was the consensus of the members of the city council, HRA, and Planning Commission that the area east of Lyndale Avenue to Pleasant Avenue south of 77th Street should be included in the proposed C-3 High Density Commercial District. City Attorney LeFevere reviewed the proposed 6 month extension of the building moratorium which would be considered by the city council on March 9, 1987. Acting Community Development Director Palmborg reviewed the proposed deletion of properties north of 77th Street from the moratorium area. City Manager Prosser reviewed the status of the Hampton Inn, CDR, and Graham Avenue developments. Item ~3 DISCUSSION OF NUMBER OF ON-SALE 3.2 BEER LICENSES IN THE CITY STUDY SESSION LETTER NO. 9 City Manger Prosser reviewed Study Session Letter No. 9 regarding limiting the number of 3.2 On-Sale Non-intoxicating liquor licenses within the City of Richfield. He stated it wds the opinion of staff that impact on any control would be minimal, especially compared with the administrative burden of establishing limitations and criteria for the limitation. Council Member Ludeman suggested that staff investigate excluding fast food restaurants from holding 3.2 on-sale beer licenses. Mayor Hamilton and Council Member Kirsch concurred. Item #4 DISCUSSION ITEMS City Manager Prosser reviewed the problems that the city has encountered in the conversion to a new computer system and the steps being taken to resolve the problems. 1 City Manager Prosser stated a Joint City Council/School Board Meeting is scheduled for Monday, March 23, 1987 at 5:30 p.m. in the council chambers. City Manager Prosser stated he would present for city council confirmation the appointment of Byron Wallace as Community Development Director at the March 9 council meeting.
