SPECIAL CITY COUNCIL MEETING
MARCH 17. 1986

The meeting was called to order by Mayor Hamilton at 7:06 p.m.
Item ~~1 CONSIDERATION OF A RESOLUTION TO EXTEND TO MARCH 22,
1987, THE EFFECTIVE PERIOD OF TRANSITORY ORDINANCE N0.
17.18 (ILN BUILDING PERMIT MORATORIUM ORDINANCE)
ENTITLED "INTERIM ZONING ORDINANCE ADOPTED FOR THE
PURPOSE OF PROTECTING THE PLANNING PROCESS IN A
CERTAIN AREA OF THE CITY REGULATING, RESTRICTING, AND
PROHIBITING CERTAIN USES, DEVELOPMENTS, AND SUBDIVI-
SIONS WITHIN SUCH AREA". C.L. 120
Acting City Manager Devich reviewed Council Letter No. 120
regarding a resolution to extend by one year the effective
period of Transitory Ordinance 17.18, the Interstate Lyndale
Nicollet Building Moratorium Ordinance, to March 22, 1987.
Acting City Manager Devich stated that if the planning and
implementing activities required for the ILN Redevelopment area
are completed prior to the expiration of this one year period,
the city council may then terminate the interim zoning ordinance
at an earlier date.
Lawrence Wozniczka, 674 Wentworth Avenue, stated that the
council should not take action to extend the moratorium until
the consultants ILN Redevelopment plan has been completed.

RESOLUTION N0. 7152
A RESOLUTION EXTENDING THE EFFECTIVE PERIOD OF
TRANSITORY ORDINANCE N0. 17.18 ENTITLED "AN INTERIM
ZONING ORDINANCE ADOPTED FOR THE PURPOSE OF PROTECTING

Motion carried 5-0. This resolution appears as Resolution
No. 7152 in Resolution Book No. 54.
Item ~~2 PUBLIC HEARING ON AN ORDINANCE AMENDING TRANSITORY
ORDINANCE N0. 17.18 WHICH MODIFIES THE RESTRICTIONS ON
THE ISSUANCE OF BUILDING PERMITS IN THE ILN AREA.

Acting City Manager Devieh reviewed Council Letter No. 121
regarding an ordinance amendment to the ILN Building Moratorium
Ordinance which modifies the restrictions on the issuance of
building permits in the ILN area.
Steve Sawitzke, Al Foam Speciality, stated his support for
maintaining the moratorium for all properties in the ILN.
Council Member Ludeman stated his opposition to excluding
the west side of Lyndale Avenue between 75th Street and 76th
Street from the moratorium.
Community Development Director Kraft stated that staff had
proposed to delete this area from the effects of the building
moratorium because the ILN plan does not call For any mayor
acquisition in this area.
City Attorney LeFevere stated that deleting this area had
little potential for harm to the Redevelopment plan and was an
attempt to not be arbitrarily prohibitive.
Council Member Sandahl stated his support for the exclusion
of the 7500 block to avoid unnecessary restrictions.
Council Member Kirsch stated that he supported including
this block in the moratorium to maintain control on potential
development.

Council Member Garcia spoke in support of maintaining the
moratorium on the west side of the 7500 Lyndale block.
Council Member Ludeman asked if new hearings would be
necessary if the council was to restore the west side of the
7500 Lyndale block to be included in the moratorium.
City Attorney LeFevere stated that a new hearing would not
be necessary and-that the council could amend the proposed
ordinance by a motion.
M/Kirsch, S/Ludeman to close the public hearing.
Motion carried 5-0.
M/Ludeman, S/Kirsch that proposedordinanee Bill No. 1986-8
paragraph I, be amended to read as follows: I. Section 1,
paragraph A thereof is amended to read: "A. The City is
concerned with the proper and more economic use, development
and possible redevelopment of that area of the city generally
referred to as "Interstate-Lyndale Area", hereinafter referred
to as the "Area", the boundaries as follows:
All of the property between Interstate No. 35W and the
Minnea olis Northfield Southern Railroad tracks and south of
77th Street with the followin additions: a the area west of
Emerson Avenue east of Interstate No. 35W between 7 th and
77th Streets; b in the area between Emerson and Aldrich
Avenues the first arcel abuttin the north side of 77th
Street; c) the entire block between Aldrich and Lyndale Avenues
south of 76th Street• (d) the east one-half block of the block
between 75th and 7 th Streets between Aldrich and L ndale
Avenues• a the entire block between L ndale and Garfield
Avenues between 7 th and 77th Streets; and f between Garfield
and Pleasant Avenues, the first parcel abutting the north side
of 77th Street."
Motion carried 5-0.
M/Ludeman, S/Kirsch that this constitute a Second Reading of
Bill No. 1986-8 as amended, that it be published in the
official newspaper and that it be made part of these minutes.
Motion carried 5-0.
