07-12-1982CITY OF RICHFIELD REGULAR CITY COUNCIL MEETIlVG July 12, 1982 The city council of. the City of Richfield met in regular session in the council chambers of the city hall on July 12, 1982, at Z:00 p.m. Mayor John Hamilton called the meeting to order at 7:06 p.m. Present: Bunce, Kirsch, Hamilton Absent: Hassenstab, Ludeman (Vacations) Rev. Daniel Waiter, Pastor of Richfield Evangelical Free Church, gave the invocation. Mayor Hamilton led the council and audience in the Pledge of Allegiance. 1. Approval of Minutes of June 28, 1982 Regular City Council Meeting and Concurrent City Council/HRA Meeting Motion by Bunce, seconded by Kirsch that the minutes of the June 28, 1982 regular city council meeting and the concurrent HRA meeting be approved as presented. All ayes - Carried. Absent - Hassenstab, Ludeman. 2. Council Approval of ,Agenda Motion by Bunce, seconded by Kirsch to approve the agenda. All ayes - Carried. Absent - Hassenstab, Ludeman. 3. Request for Special Use Permit to Allow Conversion of a Service Station to a Service Station Store, 6744 Penn Avenue City Manager Nollenberger summarized the request of Conoco, Inc. for a special use permit to allow conversion of an existing service station at 6744 Penn Avenue, to a service station store, as explained in Council Letter No. 227. This proposed remodeling would be done only on the interior. Mr. K. Ingram, representing Conoco, appeared in support of the company's request. He said they would agree to use shrubbery or fence as a buffer. Motion by Bunce, seconded by Kirsch to close the hearing. All ayes - Carried. Absent - Hassenstab, Ludeman. Council Meeting Minutes -2- July 12, 1982 Motion by Kirsch, seconded by Bunce to grant this special use permit with the stipulation that buffer/screening is provided along the west property boundary of the site, abutting the adjacent residential district. All ayes - Carried. Absent - Hassensta.b, Ludeman. 4. Ordinance Amendment Relating to Personnel Ordinance. Second Reading. City Manager Nollenberger presented an amendment to the personnel ordinance for city council second reading consideration. - Bill 1982-22, "An Ordinance Amending the Ordinance Code of the City of Richfield, Minnesota, as follows: Amending Section 2.28 by Reorganizing the Section and Making Amendments; Amending Section 2.29 by Providing New Defi- nitions; Amending Section 2.30 by Reorganizing the Section and Deleting Subdivisions.; Amending Section 2.31 by Combining it with Previous Code Section 2.32 and Reorganizing the Two Sections and Making Certain Amendments; Amending Previous Code Section 2.32 by Renumbering it to New Code Section 2.32 and Combining Parts of Previous Code Section 2.36 Making Certain Amendments and Adding Certain New Subdivisions; .Amending Previous Code Section 2.34 by Renumbering it to New Code Section 2.33 and Making Certain Amendments Thereto; Deleting Previous Code Section 2.35 Which is now Covered by the New Code Section 2.32, Subd. 9; Deleting Previous Code Section 2.36 Which is Now Covered Under Section 2.32, Subd. 10; Creating a New Section 2.34 and Providing a New Subdivision and Combining Parts of the Previous Code Sections 2.37 and 2.37A and Making Certain Amendments Thereto; Renumbering Previous Code Section 2.3$ to the New Code Section 2.35 and Making Certain Amendments; Renumbering Section 2.39 to the New Code Section 2.36 and Making Certain Amendments; Deleting Previous Code Section 2.40; Renumbering Previous Code Section 2.40; Renumbering Previous Code Section 2.41 to the New Code Section 2.37, and Making Certain Technical Amendments", was presented by Council Meeting Minutes -3- July 12, 1982 Assistant City Attorney John Dean,_ the same being on file in the office of the city clerk. Motion by Bunce, seconded by Kirsch that this constitute a second reading of Bill 1982-22; that it be gublished in condensed form in the official newspaper and that it be made a part of these minutes. Po11 of votes: Ayes - Bunce, Kirsch, Hamilton. Nays - None. Absent - Hassenstab, Ludeman. Carried. 5. Ordinance Amendment Relative to Billboard Heights. Second Reading. City Manager Nollenberger presented an ordinance amendment relating to billboard height for city council second reading consideration. Nancy J. Jorgensen, vice president of Naegele Outdoor Advertising, was present to observe the council actions. Motion by Kirsch, seconded by Bunce to close the hearing. All ayes - Carried. Absent - Hassenstab, Ludeman. Bill 1982-21, "Amendment to Chapter III, Part V, Section 3.49, Subdivision 4. of the Ordinance Code of the City of Richfield", relating to special height permits for signs, was read and reviewed by Assistant City Attorney John Dean, the same being on file in the office of the city clerk. (C-139} Motion by Bunce, seconded by Kirsch that this constitute a second reading of Bill 1982-21; that it be published in the official newspaper and that it be made a part of these minutes. Poll of votes: Ayes - Bunce, Rinsch, Hamilton. Nays - None. Absent - Hassenstab, Ludeman. Carried. Motion by Kirsch, seconded by Bunce to approve the issuance of a sign permit to Naegele Outdoor Advertising, effective August, 1982, to allow removal of the existing billboard at 400 West 66th Street and the construction of anew sign on the vacant lot immediately south of the city's central garage facility. Council Meeting Minutes -4- July 12, 1982 All Ayes - Carried. Absent - Hassenstab, Ludeman. 6. Ordinance Amendment Relating to Rezoning Certain Properties to MR-l. First Reading. City Manager Nollenberger presented an amendment to the ordinance code concerning rezoning property from MR, Multiple Family Residence, to MR-l, Two- Family Multiple Residence. Areas recommended for rezoning are areas where two family dwellings currently exist. Community Development Director Dennis Kraft gave historical data regarding the comprehensive plan and the "new duplex" zoning of MR-1. Gordon McRinnon, 7308 Upton, asked if his lot would qualify for a rezoning to MR-1. The city manager said his lot did qualify if he met all the conditions for a rezoning. G. Savageau, 6638 Elliot, asked how this rezoning would differ from the comprehensive plan set out by the Metropolitan Council. Mr. Rraft replied that in essence the plans are identical with particular concerns about buffer zones and that the Metropolitan Council has accepted Richfield's plan. Bill 1982-25, "Amendment to Appendix C of the Ordinance Code of the City of Richfield, Minnesota", relating to defining the boundaries of the various zoning districts of the city enumerated in Chapter III, Part IV, Section 3.28, Subdivision 2, was read and reviewed by Assistant City Attorney John Dean, the same being on file in the office of the city clerk. (C-145) Motion by Bunce, seconded by Kirsch that this constitute a second reading of Bill 1982-25; that it be published in the official newspaper and that second reading of this ordinance amendment be scheduled for July 26, 1982. Poll of votes: Ayes - Bunce, Kirsch, Hamilton. Nays - None. Absent - Hassenstab, Ludeman. Carried. 7. "No Parking Except Sunda " on L dale Avenue Between 74th and 76th Streets City Manager Nollenberger reviewed the proposal to implement parking Council Meeting Minutes -5- July 12, 1982 restrictions on Lyndale Avenue between 74th and 76th Streets. He said businessmen from the area have met with the staff over the past months and have determined that traffic flow could be eased if parking were restricted in that area to allow parking only on Sundays. This signage would be in conformance with other minor arterial streets. Charles Miller, representing tenants of the building at 7400 Lyndale Avenue, said this restriction would be a hardship to occupants of the building and employees will need to park in residential areas. Motion by Kirsch, seconded by Bunce that the following resolution be adopted; that it be spread in the resolution book and that it be made a part of these minutes: RESOLUTION N0. 6626 RESOLUTION RELATING TO TRAFFIC CONTROL SIGNS "NO PARKING ANYTIME EXCEPT SUNDAYS" BOTH SIDES LYNDALE AVENUE FROM 74TH STREET TO 76TH STREET Poll of votes: Ayes - Bunce, Kirsch, Hamilton. Nays - None. Absent - Hassenstab, Ludeman. Carried. This resolution appears as Resolution No. 6626 in Resolution Book No. 48. 8. Council's Choice Councilmember Kirsch commended Public Safety Director Morgan and his staff for their excellent performance during the recent 4th of July parade and festivities. Mr. Kirsch also mentioned tall grass at 74th and Lyndale Avenue and suggested the corner be cleaned. Councilmember Bunce said street lights are burning out along Penn Avenue. 9.
