10-05-1981 Budget HearingGITY OF RICHFIELD SPECIAL MEETING CONTINUED HEARING ON L/H/N MAINTENANCE ASSESSMENTS AND CONTINUED BUDGET HEARING October 5, 1981 The City Council of the City of Richfield met in special session on October 5, 1981 at 7:00 p.m. in the council chambers of the city hall. Mayor Priebe called the meeting to order_at 7:12 p.m. ~~ Acting city clerk Joyce Wilcle called the roll.. Present: Bunce, Collins, Hassenstab, Ludeman,.Priebe 1. Public Hearing to Consider Specially Assessing Current Maintenance Services - L/H/N Area for the Period July 1, 1981 to December 31, 1981 and January 1, 1982 to December 31, 1982 and Z. Resolution Regarding Adoption of Assessment Roll on City Protect 763, L/H/N Maintenance January 1, 1981 through June 30, 1981 . City Manager Karl Nollenberger introduced the public hearing related to the adoption of an assessment project for on-going maintenance services in the L/H/N area from July 1, 1981 to December 31,.1982; and adoption of a specific assessment roll-for collection of those costs incurred from January to June, 1981. He described the services and costs included. Ralph Bruins, 7100 Oak Grove Boulevard, spoke on behalf of the Richfield Chamber of Commerce. He described a proposal developed by the Chamber of Commerce regarding this matter, that was approved by 22 Chamber members at a special meeting on October 2; that the special assessments proposed for the period of January - June, 1981 (i.e. $45,000) be reduced by 50%; that the amount of special assessments proposed for the period of July - December, 1981 be reduced by 10°1°; and that the property owners assume responsibility for maintenance of their property and abutting public property behind the curbline, such maintenance to be performed at a level established by the City of Richfield. He stated that this proposal would likely result in a 75% reduction in the on-going special assessments. Special Council Meeting -2- ~, October 5, 1981 Mr. Nollenberger stated that about $21,590 of the costs incurred from January - June, 1981 could be charged to the L/H/N area public improvements project, since they were one time costs; that of the remaining costs would be the special assess- ments, and that approximately $900 would be charged to the City's General Fund. He~also observed that the proposed 10% reduction for the second one-half of the year would result from charging one time costs to the public improvement project.,. Mr: Nollenberger emphasized that; where a property owner does not maintain his property in accordance with the standard set for the maintenance in the area, the City will assume those maintenance responsibilities and those charges. will be additionally assessed to that property. Mr. Gary Strom, 6532 Lyndale, expressed his gratitude for the work that had been done in developing the-Chaml~er-~o~ Commerce proposal. He expressed the following reservations, however: 1. The original L/H/N plan didn't, to his recollectio n, provide for assessing the property owners; 2. The project maintenance costs are disproportionate to the initial cost of the improvements. Motion by Ludeman, seconded by Hassenstab to amend the resolution adopting the assessment roll for L/H/N maintenance for June to January, 1981 to a reduction of 50% of what wa.s originally proposed. Motion by Hassenstab,. seconded by Bunce to adopt the resolution creating a special assessment district for January to December, 1982, with the understanding that the maintenance of City property within the Lyndale/Hub/Nicollet area be the responsibility of the adjacent property owner from curb line to property line and such property not being maintained up to agreed upon standards will be maintained by the City and billed to the appropriate owner, thus reducing the responsibility of maintaining improvements by the City to common areas such as medians, streets, gutters and civic plaza; that it be spread in the resolution book and that it be made a part of these minutes: RESOLUTION N0. 6516 RESOLUTION ORDERING UNDERTAKING OF CURRENT SERVICE PROJECT L/H/N MAINTENANCE - JANUARY 1, 1982 THROUGH DECEMBER 31, 1982 i Special Council Meeting -4- October 5, 1981 Poll of votes: Ayes - Bunce, Collins, Hassenstab, Ludeman, Priebe. ' Council recessed for five minutes at 7:52 p.m. and reconvened at 8:12 p.m. Ci.ty_Manager Nollenberger suggested that the council may wish to review, finalize and adopt the 1981 revised and the 1982 proposed General Fund budgets, since the tax levy must be certified to Hennepin County by Friday, October 9. Councilmembers asked questions regarding the'~relatioriship of the proposed tax levy to the levy limit and the potential impact of further reductions in state aids on the budget. Larry Wozniczka, 6744 Wentworth, expressed concern regarding the proposed 1982 property"tax rates and observed that the state had likely expected some sharing on the local level with cutbacks. He also suggested that the HRA had some monies that were uncommitted and~that-tiaose'=monies should be used to reduce taxes. Sid Sanford, 7000 Portland, spoke supporting a reduction in services similar to previous years. Motion by Ludeman, seconded by Hassenstab to close the public hearing. All ayes - Carried.
