SPECIAL ASSESSMENT HEARING
October 6, 1980
The City Council of the City of Richfield met in special session on
October 6, 1980 at 7:00 p.m. in the Council Chambers of the City Hall to
review the appeals to the proposed special assessment for City Project No.
705 that were presented to the city council at the September 22, 1980 hearing
on special assessments for City Project No. 705.
Present: Bunce, Collins, Ludeman, Luettinger, Priebe.
The meeting was called to order at 7:15 p.m. by Mayor Donald Priebe.
City Manager Karl Nollenberger and Assistant City Attorney John Drawz
described the special assessment process and changes in the law that stipulate
findings and information that the city council must use in sustaining assessments.
William Dorigan, attorney representing the Godfather Restaurant, asked
questions regarding the process and how the council will hear the appeal of
an assessment for a specific property.
City Manager Karl Nollenberger presented additional information. regarding
the special assessment for the property at 6400-02 Nicollet Avenue. He
recommended that the council consider reducing the special assessment for this
property, on the basis of its uniqueness among the properties being assessed,
in that it is being used for residential purposes; it is the only residential
property in the assessment district that is not scheduled for acquisition as
part of the overall commercial or multifamily development activity in the project
area; and the disparity between the proposed assessment for this property in the
project area and a very similar property immediately to the north, not in the
project area.
Mr. Richard C. Nelson, owner of property at 6400-02 Nicollet Avenue,
asked questions regarding zoning for his property and the requested adjustment
in the special assessment.

Motion by Luettinger, seconded by Bunce to reduce the special assessment
for the property at 6400-02 Nicollet Avenue (27-24-0039) from 5 145.50 to
164.00.
All ayes - Carried.
Mr. Nelson stated that he would withdraw his objection to the special
assessment on this basis.
Motion by Ludeman, seconded by Luettinger to adjourn this hearing to
February 2, 3-and 4, 1981 at 7:00 p.m. in the city council chambers of the
city hall.
All ayes - Carried.
The meeting adjourned at 7:50 p.m.
