05-31-1977 SpecialCITY OF RICHFIELD SPECIAL MEETING May 31, 1977 The Council o~f the City of Richfield met in special session in the Council Chambers of the City ~~.11 on Tuesday, May 31, 1977 at 9:00 PM for the purpose of continuing the hearing of May 23 on the liquor license application of the Godfather, Tnc. The meeting was called to order by Mayor Law. Presents Jacobsen, Lv:d:eman, Luettinger, Law Absent: Anderson 1. Liquor License_Aplsl.ication Hearin, Godfather,. Inc., 700 West 66th Street Gerald Singer, 1616 Park Avenue, the attorney for Mr. John C. Anzevino, applicant, was present. Richard Williams, 715 Cargill Building, attorney for former owners of the property, reported that the lis pendens on the property will not interfere with closing. He indicated h,e could deliver the release papers tonight. Frank Riley, r~presciibng the State of Minnesota Department of Revenue, reported on, the state's release of lien on state taxes due from Minotte's. Mr. Anzevino indicated his tai.llingness to work with the public safety department to 3risure-the highest degree of fire safety. Motion by Jacobsen, seconded by Luettinger to close the hearing. A11 ayes - Carried. A.tasent = Anderson. Motion by Jacot~sen, seconded by Luettinger to grant the license with the following stipulations 1. That the Richfield resident manager be submitted for review and. approval by the Public Safety Director and City Manager prior to the issuance of the liquor license. 2, That the reconstruction and alteration of the premises, in- eluding all improvements necessary to meet minimum environmental health standards be completed prior to the issuance of the licenses. 3. That unpaid utility bills against the premises in the amount of $1,233.52 be paid before the licenses are issued. Special Council Meeting Minutes -2- May 31, 1977 4. That the billboard sign on the roof of the building be removed before the licenses are issued in accordance with the agree- ment offered by the applicant. 5. That the landscaping improvements, as specified by the city council, be completed prior to the licenses being issued. 6. That evidence of satisfaction on the dismissal of lis pendens be provided before the licenses are issued. 7. That evidence of removal of the tax lien be provided before the licenses are issued. 8. That there will be no live rock music entertainment or other loud music. 9. That food sales represent 70 - 80% of total sales, with liquor sales limited to 20 - 30% of total sales. 10. That beginning 45 days after the issuance of the licenses, the applicant file with the city at the end of each month a state- ment indicating that all accounts, including taxes are paid up on a current basis. A11 ayes - Carried. Absent - Anderson. 2. Discussion on League of Minnesota Cities Motion by Jacobsen, seconded by Ludeman to nominate Mayor Law to be the voting delegate and Councilman Ludeman the alternate delegate at the State League of Minnesota Cities Conference in June. All ayes - Carried. Absent - Anderson. The city manager reviewed the proposal on the league dues for the period 1977-78 to 1980-81. There was some discussion expressing concern about the timing of dues increases in relation to adopted budgets. The city manager suggested that the council consider supporting the dues increase proposal at this time with the recommendation that the council offer suggestion to the League that in the future they consider annual dues increases timed to coincide with the period before budgets are adopted and to become effective at the same time city budgets become effective. Motion by Jacobsen, seconded by Luettinger to authorize the mayor to vote 1 1 1 in favor of the proposed LMC dues increase for the years 1977/78 and 1978/79 and Special Council Meeting Minutes -3- May 31, 1977 to urge further study of the proposed dues increase for the years 1979/80 and 1980/81 with special consideration given to the possibility of annual adjustments which would become effective after the beginning of municipal budget years. A11 ayes - Carried. Absent - Anderson. 3. Discussion of City's Arbitration Law Suit (Not on Agenda) Mayor Law reported receiving a letter from Phil Cohen, of the League of Minnesota Cities, commenting on the importance of the city's law suit questioning the constitutionality of the arbitrators in settling labor disputes. The city manager reported that the League had expressed some interest in joining Richfield in this legal matter. Luettinger Motion by seconded by Jacobsen to request the League of Minnesota Cities to participate in the city's appeal on the arbitration constitutionality and to share in the cost of litigation. Po11 of votes: Ayes - Jacobsen, Luettinger, Law. Nayes - Ludeman. Absent - Anderson. Carried. 4. Pool Tickets (Not on Agenda) Mayor Law requested clarification on the indoor/outdoor season ticket concerning whether a minimum of 250 tickets must be sold to implement that system. Councilman Jacobsen said he felt the number of 250 had been set as a goal in order to make the pool self-sustaining and if ticket sales fell short of that goal it should be brought back to the council for consideration. Councilman Ludeman reported that he purposely placed no limit on the number of season tickets purchased in his motion. Councilman Luettinger felt that if 200 season tickets were sold the season tickets should be used. He stated he felt that it was a matter of judgment and that perhaps even if only 150 were sold the tickets should be used. Lowell Carl of 6421 Newton, reported that he understood that regardless of how many tickets were sold,' the season tickets would apply. Ms. Mary Jane Stern, 6625 Newton, questioned whether the city had adequately Special Council Meeting Minutes -4- May 31, 1977 studied the issue and suggested closing the outdoor city pool in the summer time and just have the city rent time in the East and West school pools. John Hamilton stated that there should be a meeting of the city-school district joint facilities committee. In answer to a question he suggested that perhaps the district might be willing to help by adjusting leasing rates to the city. Motion by Ludeman, seconded by Luettinger to approve the following items concerning 1977 summer use of West Junior High indoor Pool: 1. Reaffirm the following season ticket fees established at the May 23, 1977 meeting: Resident family $32 Resident single 20 Non-resident family 48 Non resident single 36 2. No minimum number of season ticket sales required. 3. These season ticket holders would be able to use the outdoor city pool at no additional cost. 4. Reaffirm individual hourly admission fees established at the February 28, 1977 meeting at the rate of $.50 per hour or $1 for three hours. 5. Reaffirm the West Junior High indoor pool schedule commencing June 20, 1977 and ending August 26, 1977 as printed in the 1977 park and recreation summer recreation brochure. 6. Cost of operating the West Junior High pool to be paid by these season ticket sales and hourly admissions with .any necessary subsidy to be derived from a reduction in school district charges or a transfer from the general fund contingency account or a com- bination of these two sources.
