01-24-1977CITY OF RICHFIELD Regular Meeting January 24, 19'77 The Council of the City of Richfield met in regular session in the Council Chambers of the City Hall on Monday, January 24, 1977 at 7:00 PM. Rev. John McMillan of St. Nicholas Episcopal Church gave the invocation. The meeting was called to order by Mayor Law. Present: Anderson, Ludeman, Luettinger, Law Absent: Jacobsen (Business obligation) 1. Minutes Motion by Ludeman, seconded by Anderson that the following amendments be made to the minutes of the January 10, 1977 meeting: Page 10, Paragraph 2 - Bi11 No. 1977-4, an Ordinance Amending Code Section 12.02, Subdivision 1, entitled, "Compensation of Mayor an:d Council Members", which proposed an increase of 5% in salary, for the mayor; from $5,400 to $5,670 per annum, and for councilmen; from $4 L020 to $4,221 per annum, was read and reviewed by the city attorney, the same being on file in the office of the city clerk. (C•9773) Page 11, Paragraph 2 - Motion by Ludeman, seconded by Anderson to designate the Sun Newspaper as the official city newspaper for 1977. A11 ayes - Carried. Absent - Jacobsen 2. Bicentennial Committee Report Mrs. Gertrude Ulrich, the chairperson of the Richfield Bicentennial Committee, presented a final report on the projects undertaken by the Bicentennial Committee during 1976. The council expressed their thanks and apprep.ation for the work done by the committee. 3. Citizen of the Year Award ' Mr. William Siemens, chairman of the Human Rights Commission, presented the fifth Citizen of the Year Award to Gertrude Ulrich in recognition of her many Council Meeting Minutes -2- January 24, 1977 civic oriented activities. Mayor Law presented Mrs. Ulrich with a proclamation honoring her as Citizen of the Year for 1976. 4. Labor Contract - Local 49 (Not on Agenda) The city manager reviewed the proposed 1977-78 two year labor agreement with Local 49. Motion by Luettinger, seconded by Ludeman that the following resolution be adopted; that it be spread in-the resolution book and that it be. made apart of these minutes: RESOLUTION N0. 5679 ' RESOLUTION APPROVING LABOR CONTRACT BETWEEN CITY OF RICHFIELD AND INTERNATIONAL UNION OF OPERATING ENGINEERS LOCAL 49 AFL/CIO FOR THE YEARS 1977/78 Poll of votes: Ayes - Anderson, Ludeman, Luettinger, Law. Nayes - None. Absent - Jacobsen. Carried. This resolution appears as Resolution No. 5679 in Resolution Book No. 40. Lawrence Wozniczka of 6744 Wentworth, questioned why the city did not negotiate separately from other communities. Arlan V. Nelson, 6939 13th Avenue, thanked the council for their action and expressed regret for any inconvenience caused to the citizens. 5_. Study of Richfield's Data Processing S stem The city manager reviewed Phase Y of the report prepared by Intech, Inc., the computer consultant, and requested authorization to proceed to Phase II of the data processing study. Mr. Dewey Albers of Intech. Inc., presented details of his findings and recommendations and answered questions of the council and the audience. Gertrude Ulrich, 7601 Aldrich, inquired about voter registration system. Council Meeting Minutes -3- January 24, 1977 Motion by Ludeman, seconded by Anderson to receive the report and approve Phase I and authorize the consultant to continue to Phase II. A11 ayes - Carried. Absent - Jacobsen. 6, Report on State and Federal Legislative Matters The city manager proposed that future agendas should include a discussion item which would cover pending federal or state legislation and that the staff would attempt to provide the council with general background information about these items. The council could discuss them and ask further studies or possibly take a stand on a piece of legislation. The council indicated they would like to include such discussion on future agendas. 7. Transitory Ordinance Appropriating Funds for Outdoor Recreational Facilities at West Junior High School Bill No. 1977-5, Transitory Ordinance No. 16.39, "An Ordinance Providing for the Expenditure of Money from the Special Revenue Fund for Certain Capital Im- provements", was read and reviewed by city attorney, Clayton LeFevere, the same being on file in the office of the city clerk, (C-9775) Motion by Anderson, seconded by Luettinger that this constitute a first reading of Bill No. 1977-5; that it be published in the official newspaper and that second reading of this ordinance amendment be scheduled for February 14, 1977. Poll of votes: Anderson, Ludeman, Luettinger, Law. Nayes - None. Absent - Jacobsen. Carried. 8. Proposed Change in Fee Schedule for Various Land Use Applications Wayne Burggraaff, city manager, reviewed the proposed revisions in certain fees charged by the city for special use permits, variances, zoning district changes, land subdivisions, off-street parking contracts, street vacations and for planned unit developments. He advised that these changes are necessary in oxder to reflect the costs the city incurs in processing these applications. Council Meeting Minutes -4- January 24, 1977 The planning director answered questions and provided additional information. Lawrence Wozniczka, 6744 Wentworth, spoke in favor of a more nominal fee structure. Motion by Anderson, seconded by Luettinger to approve the proposed fees and to authorize the city attorney to prepare the necessary ordinance amendments. A11 ayes.- Carried. Absent - Jacobsen. 9. Feasibility Study for Ban.dshell and Picnic Shelter Park and Recreation director, Don Fondrick, reviewed the background of the feasibility study. Richard Schwarz, consultant, presented his report. Motion by Anderson, seconded by Law to accept the feasibility study -for further consideration. 10. L/H/N Public Improvement Right-of-Wa Acquisitions Richard Krier, planning director, reported that the appraisals for the right-of-way for~the public improvements of the L/H/N area had been received for the property occupied by Nelson's Restaurant and requested council adoption of the required resolution establishing just compensation. Absent - Jacobsen 14. Discussion of Criminal Justice System Meeting The city received communication from the county regarding the availability of community service programs. Public safety director, Tom Morgan, explained that the city already had a crime prevention program and he agreed to notify the service clubs of this program. 15. Discussion of Date for Council/Staff Training Session The city manager requested council to consider establishing a time for another council-staff training session in the near future. The council requested staff to submit to them some proposed dates for this event. 16. Discussion of Public Recreation Swimming Program The staff presented the council with information on the winter public recreation program indicating it was not paying for itself and also reviewed the summer use of West Junior High pool. Motion by Law, seconded by Luettinger to request the city manager and_the Advisory Park and Recreation Commission to develop recommendations for user fees which would be adequate to provide public recreational swimming at West Junior High pool this summer on a self sustaining basis. Discussion Items (Not on Agenda) January 24, 1977 The city attorney reported that in conjunction with the residential storm I~ sewer project No. 700, the city needed to acquire an easement for right-of-way to bring the storm sewer line from the back of t~.e property to drain into the street storm sewer and that he had been negotiating with Mr. Ludeen Bengston, 1707 East 89th Street, Bloomington, for an easement to this right-of-way at 7231 Oak Grove Boulevard.
