the Council of the City of Richfield met in regular session in the Council
Chambers of the City Ha11 on Monday, March 11,1974, at 7x00 P.M. -
Rev. Mork, Oak Grove Lutheran Church, 71st Street & Lyndale Avenue, gave the
invocation,
Presents Jacobsen, Luettinger, Kenealey and Law,
Absents Anderson (arrived at 7x25 P.M.)

Motion by Kenealey, seconded by Law, that the minutes of the February 25, 1974
meeting regard correction of the February 11,.1974 minutes be changed to include the
followings "Kenealey wanted to respond to the change which Luettinger made in the
minutes of the February 11th meeting referring to the statement that Luettinger felt
Kenealey had a conflict of interest when he voted on the outdoor merchand-ig3.ng and
storage ordinance. Councilman Kenealey responded that it was his opinion that he did
not have a conflict of interest since he was just participating as a board member in
a community organization that nad presented a point of view on a particular piece of
legislation proposed by the city council".

Motion by Jacobsen, seconded by. Law, that the minutes of the February 25, 1974
council meeting be approved as corrected.

2. Presentation.
Mayor Law presented a Certificate of Appreciation to John Labo for his 21 years
of dedicated service on the Police Civil Service Commission, Robert Gordon of the
Civil Service Commission and the Acting Public Safety Director, Burt Reitan; were in
attendance for this presentation,
3. Petition to Rezone Property at 6900 Penn Avenue,
Charles Little, applicant, requested the rezoning of his property at 6900 Penn

Avenue, from Residential to Ne:Lghborhood Business, to allow Mr. Little to remodel the
first floor of his home for professional offices which would be rented.
Councilman Kenealey indicated he would ~e abstaining from voting on this item
fQr the following reasonso 1) He was a personal fiend of the family, 2) He was
their family attorney, and 3) He might locate in their building,

J. B. Fowler, 6916 Penn Avenue, concerned about alley traffic and the potential
change of the neighborhood. according to the Comprehensive Plan.
R, Beranak, 6923 Queen Avenue, inquired about sigo:alization on 69th and Penn
Avenue and expressed concern about generating traffic.
Arnold Krumm, 6909 Queen Avenue, spokeagainst the trend of zoning this property
to commercial. -
George Z'ellgren, 6937 Upton,. spoke about types of business locating in proposed
development compared with. a retail store. -
J. W. Bloomberg, 6908 Oliver Avenue, was concerned about traffic and total
area's future,
A. I. Hargreaves, 6908 Penn Avenue, spoke against this rezoning.
Arden Larson, 6917 Queen Avenue, asked about effect on property values; not
opposed, - .
Mrs. J. C. Belmore, 6925 Queen Ave., spoke against the rezoning.
Motion by Jacobsen,,`seeonded by Anderson, that this Dearing be closed,

Bill No. 1974m2,. "Amendment to Appendix C, Section 2, of the Ordinance Code of
the City of Richfield, Minnesota, was read, the same being on file in the office of

Motion by Jacobsen, seconded by Anderson, that this constitute a first reading
of Bill No, 1974w2s that it be published in the official newspapers and that .the

2nd reading of this ordinance amendment be scheduled for April 8, 1974, with the
stipulation that property be rezoned to residential after improvement, and that
property owners within x.350 foot radius of this proposed rezoning be notified by
mail.
All ayes - Carried.
Motion by Kenealey, seconded by Anderson, that the variance requiring a set-back
in a Commercial Zoning District, and the Off-Street Parking Contract for an office
and residence remodeling at 6900 Penn Avenue be deferred to the council meeting of
April 8, 1974.

4. Ordinance Amendment on Taxicab Licenses,
Bi11 No. 1974-4, "An Ordinance Amending Subdivision 12 and Repealing Subdivision
13 of Section 6.20 of the City Ordinance Code, Relating to the Number of Authorized
Taxicab Licenses, was read, the same being on file in the office of the City Clerk
(C-9515).
Motion by Anderson, seconded by Kenealey, that this hearing be closed.

Motion by Anderson, seconded by Kenealey, that this constitute a second reading
of Ordinance No. 1974-4, an amendment on taxicab licenses; that it be published in
the official newspaper, and that it be made a part of these minutes,

Motion by Jacobsen, seconded by Luettinger, that the administration bring back to
the council, within thirty days, information on rates charged by other taxi-cab
companies,

It was also suggested that information on rates accompany applications made to the
City, and that the rates be filed and posted at the city hall.

5. Amendment to the City Code of Ordinances, Chapter III, Part TVA Section 3.42_,
Subdivision 4.
Bi11 No. 1974-3, "An Amendment to Chapter III, Part IV, Section 3.42, Subdivision `~
(4) of the Ordinance Code of the City of Richfield, Minnesota" was read, the same
being on file in the office of the City Clerk. (C-9517) (Mailing of Notice),
Motion by Kenealey, seconded by Jacobsen, that this constitute a first reading
of Ordinance No. 1974m39 that it be published in the official newspaper; and that the
second reading of this ordinance amendment be scheduled for April 8, 1974.

6. Off_Street Parking Contract for Richard Brandtner & Son Enterprises,
Eldred Wiley, representing Richard Brandtner & Son Enterprises, applicant, re®
quested approval of an off-street parking contract for an Automotive Diagnostic and
Tune Up Center for which a special use permit was granted by the council on February
25; 1974.
Mr. Wiley requested a variance on the south fence line because of landscaping
proposed to provide proper screening, and variance for no sidewalk in front of
building because of the blacktop around the. building.
Richard Brandtner also spoke for approval of this off-street parking contract.
Motion by Jacobsen, seconded by Luettinger, that this off_street parking contract
be granted with the following stipulationso
1. All of the relative requirements of Section 3.33, Subdivision 3, are
complied with as those requirements apply to public garages without
gasoline pumps. _ '
2. Proper screening is provided along the sough and west side of the property,
and around trash containers,
3, Indl.rect lighting so as not to cause a nuisance. landscape treatment is
provided to maintain the residential character of the adjacent residential _
property. Landscape and 13.ghting plans to be approved by city staff,
4. Final building plans for the remodeling of the existing building to be
approved by the Department of Public Works,.
