Lindvall of the Evangelical Free Church gave- the invocation. Present: Anderson, Jacobsen, Kenealey, Luettinger, and Law.. Absent: None Mayor Law called the meeting to order 1. Minutes Motion by Jacobsen, seconded by Luettinger that the minutes of the. June 25, 1973 regular meeting be approved as presented, but that the following insertion be added to Item 12 on Page 5 as follows: "Prior to seeking the variance, Mr. lack Peterson had fence posts installed on the boulevard right-ofmwav on Columbus Avenue. and on_68th Street with full knowledge that he was in violation of city ordinance,-" . Councilman Kenealey requested that it be acknowledged in the minutes that he was absent when the new library site was approved by the council. 2 Request for Chan e in Agenda Schedule Motion by Kenealey that agenda items be rearranged and considered as follows: Items 13 thru 16 to be first; Item 1 to be second and Item 18 to be third. Atlotion died for lack of a second. 3 Request for Special Use Permit from Wooddale Ba ~ tist Ghureh for Off®Street Parking It being 7 p. m. , Mayor Law called for the hearing on a request for a special use permit from Wooddale Baptist Church for off street parking at the northwest corner of the intersection of Nicollet Avenue and 72nd Street. - Austin'Chapman, 7015 Tupa Drive, Edina, representing Wooddale Baptist Church, appeared before the council to present a summary of the request for a special use permit City Council Minutes =2~ July 9, 1973 to construct a 139 space off street parking facility at the northwest corner of the intersection of 72nd Street and Nicollet Avenue, Mr, Duane Thorbeck, Architect for InterdesignB Inc, , appeared before the council to present. the physical layout of the plan. Mr, jim Benshof, 1915 Clinton; Bather Ringrose and Wolsfeld, Consulting Engineers, appeared and presented a traffic analysis report. Mayor Law annqunced that he would moderate the discussion on this item but would refrain from voting or actively participating in the discussion because he .is a member of the Wooddale Baptist Church, Mr, Joseph V. Stewart, 7600 Sheridan Avenue S. , questioned the "No Parking" signs on the north side of 76th Street from Penn Avenue to St. Richards Church, Connor F. Schmide 4711 Meadow Road, Edina, spoke on behalf of residents interested in saving parks in opposition to the special use permit for the followira.g reasons: a} the parking ramp would be inconsistent with zoning and present use of the.-land b)incon- sistent with park purposes, and c) this type of parking ramp belongs in a commercially zoned area . Frank G, Curry, 6920 Blaisdell Avenue, spoke in favor of the special use permit, and requested that his name be removed from the petition submitted -in opposition to this special use permit because he felt he was misled on facts regarding the facility. Susag, 7305 First Avenue So., spoke in favor of the library. Motion by Luettinger, seconded by Jacobsen, that the hearing be closed. A11 ayes - Carried. Motion by Luettinger, seconded by Jacobsen, that a special use permit be granted to Wooddale Baptist Church for off-street parking purposes with the off-street parking to be provided in the form of a parking ramp located under the proposed parking lot for the new Hennepin County Branch Library to be located at the northwest corner of the intersection of Nicollet Avenue and 72nd Street. Po11 of Votes; Ayes - Jacobsen, Luettinger, and Anderson. Nayes - Kenealey. Abstained - Law. Absent - None. Carried. "Councilman Kenealey voted "No" on the granting of the special use permit for off- street parking, and stated the following as to the reasons for his "No" vote. the question here-deals with one of Land Use, that is, is this a suitable location for an off-street parking lot for Wooddale Baptist Church? I don't think this request is an appropriate land use at this location on the following groundst (a) Public Park Land would be used in part for a Non-Public Purpose. 'fhis Park Land belongs to all of the 47,000 residents 13ving in Richfield. Yet, the request here is to make part of this public land for the ex- clusive use of a special interest group9 the Wooddale Baptist Church, A Church is a business, aid' every other business in the City of Richfield has been required to g~o~ide their own off-street parking on private property without asking the City to furnish them public property for such purpose. there is no oblivion here on the part of the City to provide them with public property for off-street parking. A solution to the parking problem would be for Wooddale Baptist Church to schedule four Services on Sunday instead of the present two, Most of the Catholic Churches in Richfield schedule at~least seven Services, two on Saturday night and five on Sunday. fib) Granting~~;~s request would violate the 1ega1 principles of the separation of Church 'and State, (c) Aesthetics and the General Appearance of the areao (d) Potential 15raffic Problems which could arise. Extra Ingress and Egress points which would be necessary for the 140 car parking ramp below the surface of the ground. Increase of traffic into the neighboring residential area. City Council Minutes - 3A•- Ju1y 9, 1973 Traffic Regulatory Devices which might be required at the inter- section of 72nd Street and Nicollet Avenue.' (e) Detrimental to Public Health, Welfare and Safety of the people of Richfield. (f) Environmental Concerns. 'The danger of pollution to both people and the vegetation in the park. Councilman Kenealey reminded the Council that he had asked the question of whether anyone on the staff had checked out the pollution control standards involved in this request, and the ~~ answer was No. Councilman Kenealey then read into the minutes a news- paper article from the Minneapolis Star dated July 7, 1973, as follows: "WASHINGTON„ D. C. The Environmental Protection Agency wants to block the construction of new parking lots in some urban areas as a means to curb air pollution." I also concur with the reasons given earlier by Mr. Connor Schmid in his present- ation as to the fact that a parking ramp would be inconsistent with the present use of the land, and belongs in a commercially zoned area." Mayor Law explained that the special use permit related only to land use and that it would be necessary for Wooddale Baptist Church to work out the 1ega1 arrangements and gain approval from the County of Hennepin inasmuch as the county would be owner of the land on which the library facilities and parking lot are to constructed. Approval of Plans for Proposed Hennepin County Branch Library Building The following persons appeared and spoke in interesto Donald Houlding, 7145 13th Avenue South E. E. Jackelen, 7227 Blaisdell Avenue South Robert Plasch, 7124 Oak Grove Blvd. Robert Rohlf, Hennepin County Library Director Motion by Jacobsen, seconded by Luettinger that the plans for the proposed Hennepin County Branch Library Building be approved, All Ayes -Carried with a qualified vote from Anderson that he approves the new library but disapproves of the architecture for the building. 6. Approval o~` Off-Street Parking Contract for Proposed Hennepin County Branch Library Motion by Jacobsen, seconded by Luettinger that the off®street parking contract for the proposed Hennepin County Library be approved in accordance with the ®5® July 9, 1973 recommendations contained in Council Letter No. 184 with the additional stipulation that the applicant take whatever measures are necessary to insure that the parking lot is not used for through traffic after library hours . Approval of Agreement with Brauer and Associates for Planning Services for Irilpa~®ve~ents at Augsburg Park Mr. Richard <Peterson, 7019 Nicollet Avenue, appeared and spoke in interest on this item. Motion by Jacobsen, seconded by Kenealey that the agreement for planning services for iaxbprovements at Augsburg Park with Brauer and Associates be approved. All Ayes ®Carried. 8 Surfacing of 76th Street from Sheridan Avenue 'W'est to Xerxes Avenue -City Project No. 615 Joseph Steward, 7600 Sheridan Avenue spoke in opposition to the project questioning how it would improve his property. Motion by Jacobsen, seconded by Luettinger, that the lack of school crossing signs at 76th and Sheridan Avenue be checked along with the enforcement of load limits and speeding at this location. Consideration of peremptory Writ of Mandamus Concerning Rezoning Ordinance No. 1972-21 for Shelter 15eve1o~ment Corporation Pro3ect. Bill No. 1973-16, "Repeal of certain ordinance of the City of Richfield adopted by the city council on February 1S, 1973, relating to the rezoning of curtain property, entitled fAAmendment to Appendix C, Sections 3 and 4 of the Ordinance Code of the City of Richfield, M3.nnesota", was read, the sauce being on file in the office of the City Clerk. The Gity Manager presented a letter from Shelter Development Corporation stating that they could not comply with council's stipulation that construction be started in 1973.
