Motion by Anderson, seconded by Kenealey, that the minutes of the 13ecember 26,
1972 regular meeting be approved as presented, with the following underlined in®
sertion to be made as follows;
Page 2, Paragraph 3....(Councilman Luettinger wished to qualify his "yes" vote
by going on record as being. opposed to allowing combustibles in storq.ge area without
sprinkler system being installed).

3131 North Fernbrook Lane, Minneapolis.
Robert Wortrkington, Planning Director, presented this item to th.e city council.
Wilson Montgomery, 3030 Harbor Lane N., Minneapolis, representing BelMar
Builders, answered questions from council members concerning this proposed project,
Gordon McKinnon, 7308 Upton Avenue, and Sandra Carter, 7008 Oakland appeared in
interest and asked questions.

Motion by Anderson,. seconded by Kenealey, that the council approve this
apartment use permit subject to stipulations contained in City Manager°s Council
Letter No. 6, dated January 8, 1973, as follows, with the exception of Items 9 and 10,
but including letters from the Richfield Fire Chief and the State Fire Marshall
that it meets all codes. (C-9447).
1. A variance from the two and one-half story height restriction be approved
for this project by the planning commission and city council,
2. Off-Street parking contract for this project be approved by the city
council,
3. Evidence of the private easement providing access from 76th Street into
the property be reviewed by the city attorney and filed with the city as
part of the off-street parking contract.
4. Landscape and lighting plan be approved by the planning director.
5. Building plans be approved by the chief inspector and fire marshall.
6, Drainage and grading-plan be approved by the city engineer.
7. A.11 electrical and telephone service into the project be installed under=
ground.
8. The two parcels be combined for tax purposes,

Street,
to Construct a Three Story Apart-
The purpose of this variance is to allow the applicants,. Be1Mar Builders, to
construct a three story apartment building on property located at 221 West 76th
Street. Detailed explanation of the essential features of this proposal were covered
by the council when the apartment use permit for this project was considered previm
ously on this council agenda.
Motion by Anderson, seconded by Luettinger, that this hearing be closed, and
that the variance from the height requirement be granted with the stipulation that
street area be vacated.

Walter Ball, 6711 Oakland Avenue, appeared before the council and explained that
this land division request was made to accommodate two double bungalow units they
propose to move from 6401-11 Nicollet Avenue to 6504 m 23rd Avenue, the lots on 23rd
Avenue were recently rezoned from Residential to Multiple Residence to allow the double
bungalows to be relocated.
Motion by Luettinger, seconded by Anderson, that this bearing be closed.

Motion by Luettinger, seconded by Kenealey, that the council grant the land
division for 6504 - 23rd Avenue as requested by Wal Don Builders, 6425 Nicollet Ave.,
and that the present buildings be removed from 6504 - 23rd Avenue within six months,

5. Special Use Permit for Car Rental Business at 1400 East 78th Street,
P. J. Marinovich, 7100 Heatherton 'Frail, Edina, appeared before the council and
requested approval of a special use permit for a car rental business to be operated
as apart of the existing Standard Oil gasoline service station and car wash. facility
at 1400 East 78th Street.
Motion by Anderson, seconded by Luettinger, that this hearing be closed,

Motion by Anderson, seconded by Luettinger, that the council approve this special
use permit, subject to the following stipulations contained in the city. mans.ger°s
council letter No, 1, dated January 8, 19730
1. No more than tep. (10) rental cars to be located on this site without first
renewing this permit.

6. Off-Street Parking Contract to Accommodate Car Rental Business at 1400 Bast
78th Street.
P. J. Marinovich, representing A. T. Minn. Tnc., requested approval of an off-
street parking contract for th,e Standard Oil gasoline service station and car wash
facility to a11ow for the 1e~cation`of no more than ten car rental units on this
existing gas station property at 1400 Bast 78th Street.
Motion by Anderson, seconded by Luettinger, that the following resolution be

Treatment Plant.
Motion by Anderson, seconded by Kenealey, that the council authorize the call
for bids on January 22, 1973, for the excavation and removal of lime residue at the
Water-Treatment Plant, which item was provided for in the 1973 budget.

8. Approval of Budget Purchase in Excess of $1,000.
Motion by Anderson, seconded by Luettinger, that the council approve the
purchase of eight vehicles, which are scheduled for replacement of fully depreciated
automobiles currently in the central garage revolving fund, in the amount of $28,666.21.
All ayes - Carried. Absent - Jacobsen.
9. Delegate and Liaison Appointments:
Motion by Kenealey that some council member be appointed as liaison representative
to the Charter Commission. Motion lost for lack of a second.
Councilman Kenealey was asked to accept some council appointments but that he
reused.
Councilman~Kenealey indicated that he refused to serve as a liaison to other
coumaissions because he feels the council is setting a double standard by not in-
eluding the Charter Commission.
