11-27-1972CI'1'S' OF RICHF LEI,D 12RGU1~AR MEFI'ING November 27, 1972 Abe Council of the City of Richfield met in regular session in the Council Chambers of the City Hall, 6700 Portland Avenue, November 27, 1972, at 7:00 p.m. Rev, Philip Frazier, Baptist Church of our Saviour, gave the invocation. Present: Councilmen - Jacobsen, Kenealey and T,uettinger. Mayor T,aw. Absent; Councilman Anderson - Attending the National Teague of Cities Conference as a delegate from the City of Richfield. 1.~. Minutes : Motion by Kenealey, seconded by Jacobsen, that the minutes of the November 13th regular meeting and the minutes of the November 9, 1972 special meeting, be approved as presented, with the following corrections to the minutes of November 13th; Page 1 - Item 1. Councilman Kenealey requested that the words "motion by motion" be inserted ~in the following sentence: "He wanted the budget adopted motion by motion by departments". Page 2. Councilman Kenealey requested that the words "by deed" be inserted in the following sentence...."...to table action on the application until the applicant, Shelter Development, can provide assurance to the city that the Richfield I,a1ce shore- line land adjacent to the project site and any lake bottom-land which could be claimed by the owner of such shoreline land will be preserved as public open space and will be transferred to the city b~ deed for that and other public purposes." Page 7 m Item 16. Councilman Kenealey requested that a notation be made to this item..."that Sandra Carter and Gordon McKinnon reported that they heard him appointed at the first meeting", Page 9 - Item 2`0. Councilman Kenealey requested that the administration check with the State of Minnesota as to their classification for the City of Richfield. It was his feeling that they placed the city in a classification that would deny them the bridge and that t~::is classification was possibly in error. All ayes - Carried. - 2 - November 27, 1972 2. Request for Variance for Construction of Garage. Robert Adelmann, 7601 Lyndale Avenue, applicant, appeared and requested a variance from the provisions of Section 3.33, subdivision 3, which prohibits the loca- tion of a garage upon commercially zoned property abutting upon residential property. Motion by Jacobsen, seconded by Luettinger, that this hearing be closed. A11 ayes - Carried. Motion by Jacobsen, seconded by Luettinger, that the council grant this variance and allow Mr. Adelmann to place an automotive garage installation and accessory sales business within his existing commercial building at 7601 Lyndale Avenue So. A11 ayes - Carried. 3. Sewer Utility Ordinance Code Change. Bi11 No. 1972-10. Bill No. 1972-20, "Amendment to Chapter VIII, Part II, of the Ordinance Code of the City of Richfield" was read, the same being on file in the office of the City Clerk. (C-9443). Motion by Luettinger, seconded by Kenealey, that this constitute a first reading of Bi11 No. 1972-20; and that it be published in the official newspaper, Po11 of votes; Ayes - Jacobsen, Kenealey, Luettinger and Law. Nayes -None, Absent - Anderson. Carried. 4. Rezoning Amendment from Residential to Multiple Residential - 6500-6508 23rd Ave requested by Wa1 Don Builders, Bi11 No. 197218, "Amendment to Appendix C, Section 4, of the Ordinance Code of the City of Richfield, Minnesota", was read, the same being on file in the office of the City Clerk. (C-9442). Don Balmer, 7315 Penn Avenue, Secretary-Treasurer of Wa1 Don Builders, appeared as applicant. (009444) Lawrence Wozniczka, 6744 Wentworth Avenue, spoke in opposition to appropriating these funds at this time. Approval of Bus Routes - "E", "F'" and "G", Mayor Law read two letters - from James A. S3oering, 7638 Upton Avenue, and - 5 - November 27, 1972 Wm. G. Kirchner, 6830 Newton Ave., (President of Richfield Bank & Trust Co.) both of whom favored approval of the three additional bus routes within the City of Richfield. Mr. Kirchner, however, offered some modifications to Route "F". George Knapp, President of the Bloomington Bus Company, objected to Routes 11F" and "G". Lou :Olson, Assistant General Manager of the Operations Division of The Metro- politan Transit Commission, answered questions pertaining to the three additional bus routes, which would provide express bus service to downtown Minneapolis as part of the Highway 35W Urban Corridor Demonstration =Project. Mrs. Francis Achats, 7445 2nd Avenue So., spoke in favor of the bus routes. George Holter, 6424 Emerson Avenue, spoke in opposition Leland Sveum, 6745 Portland Avenue, asked questions. Sandra Carter, 7008 Oakland Avenue, spoke in favor of letting small bus companies improve their service, Don Houlding, 7145 - 13th Avenue, spoke against the present service in general and was against this proposal. Wa11y Vavrosky, 7338 Harriet Avenue, spoke for the Richfield Chamber of Commerce and expressed their concern about business area access, Carl McBride, 723b Oak Grove Blvd,, a member of the Chamber of Commerce Traffic Committee, reported that Route "F" by-passes Richfield business areas, and inquired as to what would be expected after "demonstration project" was completed, and should private operators be subsidized for their losses. He also encouraged service improve- went to downtown Minneapolis. Motion by Luettinger, seconded by Jacobsen, that Routes "E" and "F" be approved as presented, and strongly recommend consideration of providing bus by-pass ramps and metered access at 62nd and Lyndale Avenue. Don Houlding,. 7145 m 13th Avenue, suggested that the mini®bike track location be limited to non licensable machines, and a maximum age group, Gordon McKinnon, 7308 Upton Avenue, favored a study of several locations, Motion by Luettinger, seconded by Jacobsen, that this item be referred to the administration for a study committee with interested parties on the use of Legion Lake area for minimbikes, A11 ayes - Carried, 12.
