REGULAR MEETING
May 8, 1972
The Council of the City of Richfield met in regular session in the Council
Chambers of the City Ha11, 6700 Portland Avenue, May 8, 1972, at 7:00 p.m.
Gerald Harmon, a student from Bethel College, gave the invocation for Rev.
Aaron Markuson, Bethany Covenant Church.
Present: Anderson, Jacobsen, Kenealey, Luettinger and Law. Absent - none.
Mayor Law called the meeting to order.
1. Minutes•
Motion by Jacobsen, seconded by Luettinger, that the minutes of the April 24.th
regular meeting, and the April 11, 1972 Comprehensive Development Plan (Area No. 5),
be approved as presented, with the following corrections:
Regular meeting...Page 3, Item 7: "Motion by Luettinger, seconded by Jacobsen,
that the council accept the petitions and that they be referred to the adminis-
trative staff for further consideration in making revisions to the comprehensive
plan."

2. Land Division - requested by Stanley F. Bachman.
It being 7:15 p.m. Mayor Law called for the hearing on the land division re-
quested by Stanley F. Bachman, for property located at 6800 Emerson Lane.
The applicant, Stanley F. Bachman, presented his request for this land division.
Motion by Anderson, seconded by Jacobsen, that the hearing be closed.

Motion by Luettinger, seconded by Anderson, that the council grant this land
division.

3. A artment Use Permit for four Townhouse Units,
Dennis Otteson, appeared as applicant, and requested approval of an Apartment
Use Permit to construct four three-bedroom townhouse units on property located at
7401 Washburn Avenue So.
Neil Weber, architect for this project, described the site and building plans
to the council.
Robert Gordon, 6937 Nicollet Avenue, and Gordon W. McKinnon, 7308 Upton Avenue,
also appeared in interest.
Motion by Jacobsen, seconded by Kenealey, that the hearing be closed.

Motion by Jacobsen, seconded by Luettinger, that this apartment use permit be
granted with stipulations contained in the Manager's Council Letter No. 109, dated
May 8, 1972, and that applicant obtain letters of approval from abutting property
owners.

4. Special Use Permit for Restaurant and Cocktail Lounge.
Attorney William Fox, 860 Northwestern Bank Building, appeared for Left Guard,
Inc., applicant, and requested approval of a special use permit for a restaurant
and cocktail lounge which will occupy space in an existing building proposed for
renovation at 7717 Nicollet Avenue So. Bi11 Martini, Secretary of Left Guard, Inc.,
also appeared for applicant.
Donald Houlding, 7145 13th Avenue, appeared in interest,
Motion by Jacobsen, seconded by Luettinger, that the hearing be closed.

Motion by Jacobsen,. seconded by Luettinger, that the council approve this
special use permit with stipulations included in Manager's Council Letter No. 107,
dated May 8, 1972, and that the City Council makes affirmative findings in accord-
ance with Section 3.33, Subdivision 4, Paragraphs (a) through (h) of the City
Code.

Motion by Anderson, seconded by Kenealey, that the city attorney be instructed
to make a proposed ordinance change to include "Industrial Zone" in the liquor
ordinance.

Jim Rush, applicant., appeared and requested an amendment to change his proposed
schedule of priorities which were approved on his off-street parking contract.
Robert Worthington reported on the original phases of the off-street parking
contract granted to the Heidelberg Dining Lounge,
Motion by Anderson, seconded by Luettinger, that the council re3ect the amended
ordinance changes.
Poll of votes:. Ayes - Anderson and Luettinger. Nayes ~ Jacobsen, Kenealey, and Law.
Absent - none. Motion lost.
Bi11 No. 1972-7, "Amendment to Section 11.06, Subdivision 12, Paragraph 5, of
the Ordinance. Code of the City of Richfield", was read, the same being on file in the
office of the city clerk. (C-9382).
Don Houlding, 7145 13th Avenue, spoke in favor of the ordinance.
Motion by Jacobsen, seconded by Kenealey, that the hearing on this proposed
ordinance amendment be closed and that this constitute a second reading of Bill
Imo: X972-7, that it be spread in the ordinance book; that it be published in the

Motion by Jacobsen, seconded by Kenealey, to require the Heidelberg Dining
Lounge to install a sprinkler system in the basement within 90 days and that the
balance of the requested time table changes requested by Mr. Rush, be referred to
the administration for an amended off-street parking contract to be brought back
to the council the first meeting in June.

6. Proposed Ordinance Amendment Regulating Age for Selling Non-Intoxicating Malt
Liquor Off-Sale.
Bi11 No. 1972-9, "Amendment to Section 11.02, Subdivision 8, of the Ordinance
Code of the City of Richfield, Minnesota", was read, the same being on file in the
office of the City Clerk. (C-9385)

Motion by Anderson, seconded by Jacobsen, that the hearing on this proposed
ordinance amendment be closed and that this constitute a second reading of Bi11
No. 1972-9, that it be spread in the ordinance book; that it be published in the
official newspaper and that it be made a part of these minutes.

7. Proposed Ordinance Amendment Concerning Installation of Dead Bolt Locks.

Eugene Kerwin, 7000 Cedar Avenue, also spoke in favor and would like to see

that landlords be required to reimburse tenants who have already installed locks.
Motion by Anderson, seconded by Luettinger, that this proposed ordinance
amendment, Bill No. 1972-10, be deferred to the council meeting of May 22, 1972.

8. Request for reconsideration of denial of special use permit to Taco Bell
Restaurant, 2208 West 66th Street.
Motion by Anderson, seconded by Luettinger, to delete, upon applicants re-
quest, reconsideration of denial of Taco Bell Restaurant Special Use Permit.
All ayes - Carried.
9. Bids on Storm Sewer Construction.
Motion by Jacobsen, seconded by Kenealey, that the minutes and tabulation of
the bid opening on April 14, 1972, at 11:00 a.m., on Storm Sewer Construction, be
approved as presented.
A11 ayes - Carried.
Motion by Jacobsen, seconded by Kenealey, that the low bid submitted by
Northern Contracting Company, in the amount of $503.,026.19, be accepted as recom-
mended by the city manager in his council letter No. 105.

Motion by Jacobsen, seconded by Kenealey, that the following resolution be

10. Authorization to Ca11 for Bids - Lyndale Ave. Liquor Store Carpeting.
Motion by Jacobsen, seconded by Anderson, that the council authorize the call
for bids on replacing the worn carpeting at the Lyndale Avenue Liquor Store.

11. Discussion - Public Safety Director Position,
The city manager asked that the approval of his appointment for public safety
director be deferred to the next city council meeting.
Motion by Jacobsen, seconded by Anderson, that this item be deferred to the city
council meeting of May 22, 1972. (This motion was not acted upon by the city council).
William Reischel, 7701 Upton Avenue South and Robert Gordon, 6937 Nicollet Ave.,
appeared in interest and requested ,that the city council discuss this item, After
additional discussion the city council agreed to hear from a Peoria, Illinois representa-
tive of the International Firefighters Association, but not ~nntil after the other items
of business on the agenda had been completed. The city council waived the 11 o'clock
adjourrnnent deadline to permit the firefighter's union representative to speak.
12. Local Government Information System Joint Powers Agreement.
Motion by Anderson, seconded by Jacobsen, that the council defer its decision to
participate jointly with other governanental units in the development of a municipal
information system, The city manager agreed to obtain additional cost data.

13. Change Order for Wood Lake Nature Center Project.
Motion by Luettinger, seconded by Jacobsen, that the change order to decrease
Orvedahl Construction Inc. Wood Lake contract, in the amount of $621.82, be approved.

14. Estimates:
