03-27-1972CITY OF RICHFIELD REGULAR MEETING Mauch 27, 1972 - The Council of the City of Richfield met in regular session in the Council Chambers of the City Hall, 6700 Portland Avenue, March 27, 1972, at 7:00 p.m. Father Paul Slattery, St. Richard's Catholic Church, gave the invocation. Present: Anderson, Jacobsen, Kenealey, Luettinger, and Law. Absent: None. Mayor Law called the meeting to order. 1. Minutes: Motion by Jacobsen, seconded by Luettinger, that the minutes of the March 13, 1972 regular meeting be approved as presented, with the following wording added: Page 3, Item 8, Paragraph 1: ....and the conditions under which these housing facilities can be made available, and a survey of senior citizens that fal.7. within `this group that live in their own homes. Page 3, Item 8, Paragraph 2....in this age catagory, who are ixi~neecT~of such relief. All ayes - Carried. 2. Presentation. Mayor Law presented a certificate to Patrolman Robert R. Doeden to pay honor and tribute to him for his heroic action on February 5, 1972, at the scene of afire at 521 West 74th Street, Richfield. The certificate states that his fearless and dew cisive performance on that occasion was a credit not only to the Police Division of the Richfield Public Safety Department but also to the entire profession of law enforcement.• 3.. ":Land Division Hearing. Tt being 7:00 p.m. Mayor Law called for the hearing on a land division requested by Charles Adams, 6314 Aldrich Avenue South, to separate the East 178.23 feet from Parcel 600, Plat 44828. (Location 6340 Lyndale Ave. So.~ 0 2 March 27, 1972 Robert E. Zeck, 7100 France Ave. So., attorney for Charles Adams, applicant, appeared regarding this Land division request. Motion by Anderson, seconded by Jacobsen, that this land division hearing be closed. All ayes - Carried. Motion by Luettinger, seconded by Jacobsen, that the council grant the land division as requested by the applicant so that Lot A. (as shown on the sketch attached to Manager's Counoil Letter No. 57) may be used as a parking area for the building now occupied by a real estate firm, with the stipulation that parcel 600 be combined with the adjacent lot on the North. A11 ayes - Carried. 4. Ordinance Amendment to Sec. 11.03, Sub-divisions 3 and 14 of the Ordinance Code. Sale of Set-ups for consumption of liquor...V.F.W. Post ~~5555. Bi11 No. 1972-5, "Amendment to Section 11.03, Subdivisions 3 and 4 of the Ordin- ance Code of the City of Richfield, Minnesota", was read, the same being on file in the office of the City Clerk. (C-9370). Donald Houlding, 7145 13th Avenue, inquired as to whether children under age can be present when set-ups are being sold. The answer was "no". Gordon McKenna, 7308 Upton Avenue, inquired whether or not the Heidelberg could serve set®ups on Sunday, if this change were approved. The answer was "no, not under their liquor license, but that they would be eligible for a setmup license.!' Motion by Luettinger, seconded by Anderson, to deny the 2nd reading of Ordinance Amendment to Section 11.03, Subdivisions 3 and 14 of the Ordinance Code of the City of Richfield", Bill No. 1972-5. Poll of votes: Ayes - Anderson, Luettinger, and Law. Nayes - Jacobsen. Councilman Kenealey abstained from voting because he is the attorney for V.F.W. ~~5555, the petitioner requesting ordinance change. Carried. - 3 - March 27, 1972 5~. Submission of Report from Library Project Review Committee. Charles J. Kauth, Chairman of the Library Project Review Committee, gave an oral presentation regarding the report of the Library Project Review Committee. It was their recommendation to the council to improve the Richfield library facilities by construction of a new building on the southeast corner of Augsburg Park, or as a lesser alternative to remodel and expand the existing facility at 70th and Harriet Ave, Motion by Jacobsen, seconded by Anderson, that the council receive this report from the Committee and extend to them their appreciation for their time and effort in compiling this information, A11 ayes - Carried. 6. Submission of Report from Committee Studying Teen Center Needs, Leo Poehling, 7445 14th Avenue, Youth Commission Chairman, appeared before the council concerning the need for a Teen Center in Richfield, and presented a report, in detail, as to the recommendations proposed by members of the Youth Commission, the Richfield Recreation Department, and various Richfield youth groups, Motion by Anderson, seconded by Kenealey, that the council receive this report from the Teen Center Committee and extend to them their appreciation for their time and effort in compiling this information. A11 ayes - Carried. 7... Request from Heidelberg Dining Lounge for Amendment to the Municipal Code to Permit Op~t~.a'tion of a Sidewalk Cafe, Matson by Luettinger, seconded by Anderson, that this .request be deferred to the council meeting of April 10, 1972, due to the absence of James Rush, applicant. A11 ayes - Carried, 8. Request to Fence Pond at Sheridan Park, Mr. and Mrs. Howard A, Tyson, 6414 Upton Avenue, applicants, appeared and requested that a fence be placed around the ponding area at Sheridan Park. o March 27, 1972 Motion by Jacobsen, seconded by Kenealey, that this request be acknowledged and that the administration be directed to submit a report on this request at the next council meeting. Motion by Anderson, seconded by Luettinger, that the minutes of the bid opening on March 6, 1972, at 11:30 aom., on the 1250 GPM Pumper, be approved as presented, All ayes o Garried. Kenneth Kunz, 2920 Wo 78th Street, appeared in interesto Motion by Anderson, seconded by Luettinger, to defer the decision on the low bid recommendation on the 1250 GPM Pumper until the council meeting of April 10, 1972. Motion by Jacobsen, seconded by Anderson, that the minutes and tabulation of the bid opening on March 20, 1972, at 11:30 a.m., on a Pulvi Mixer, be approved as preen seated. Motion by Anderson, seconded by Jacobsen, that the council reject all bids that were opened on March 20, 1972, and authorize the administration to negotiate with insurance companies and bring results back to the council for approval at a later date. All ayes m Carried. 12, Approval of Budgeted Purchases in Excess of $1,000, fine City of Richfield, through the Hennepin County Cooperative purchasing group, solicited and received bids for a motor grader, but the low bid for this piece of equipment was rejected by both Hennepin County and the City of Richfield because it did-not-meet specifications. Motion by Jacobsen, seconded by Luettinger, that the council approve the lowest bid meeting specifications for a motor grader from Ziegler, Inc., in the amount of $33,172, as recommended by the city manager in his council letter No. 55, dated March 27, 1972, All ayes m Carried. 13. Agreement for Engineering Services a Permanent Street Paving Projects. Motion by Anderson, seconded by Kenealey, that the mayor and city manager be direr acted to execute an agreement, on behalf of the City, with Orr~Schelen~Mayeron and Associates, Inc,, for engineering services for permanent street paving projects within the City of Richfield, as recommended by the city manager in his council letter No. 64. This resolution appears as Resolution No. 4748 in Resolution Book ~~31. 15. Approval of Agreement with Bond Consultant. Ernest Clark, 1509 1st National Bank Building, representing T. G. Evensen & Associates, Inc., appeared before the council to answer questions the council might have regarding bond consulting services. Motion by Jacobsen, seconded by Kenealey, that the council approve the firm of T. G. Evensen & Associates, Inc., as bond consultants for the City of Richfield and that the mayor and manager be directed to e~cute an agreement for this purpose. A11 ayes o Carried. 16. Request for Rating on Proposed Bond Issue. Motion by Jacobsen, seconded by Anderson, that the council authorize the adminis4 tration, together with our bond consultant, to solicit ratings from the firms of Moody's Investors Service Tnc., and Standard and Poor's Corporation, on our proposed forthcoming special assessment bond issue. A11 ayes - Carried. 17. Request for change in Street Lighting Policy. Mayor Law requested discussion for the purpose of making a change in the es~isting street lighting policy previously adopted by the city council, and that a more fleacible policy be considered whereby it would be possible for the administration to provide as~ditional street lighting where such lighting is warranted. ~7~ March 27, 1972 Motion by Law, seconded by Jacobsen, that the administration be directed to prepare new criteria for levels of street lighting illumination and to provide in= formation on costs for various alternatives of additional lighting throughout the city, and that the report be submitted as soon as possibleo A11 ayes .. Alternate Ways of Providing Subsidized Senior Gitizen$s_Housing, Robert Worthington, Planning Director, reported on Senior CitizenAS Housing Program in Richfield, and mentioned opportunities for the elderly in which they may have their housing needs met in a way which is not currently being satisfied by the conventional private housing market, Ken Kunz9 2920 Wa 78th Street, spoke against the use of any federal funds. Camillo G. DeSantis, 6508 Newton Avenue, spoke in favor of HUD money being returned to the City.. Lawrence Wozniczka, 6744 Wentworth Avenue, questioned the need for such housing in Richfield. Mrs. Lois DeSantis, 6508 Newton Avenue,. related an incident of a low income citizen, age 62, having to leave Richfield because of high taxes, and she inquired as to what age housing benefits should be made available for the elderly. Motion by Luettinger, seconded by Jacobsen, that the council change their request to the League of Minnesota Municipal Tax Committee, as established at the March 13th council meeting, to give consideration to relieve property taxes for those 62 years of age and over.o,instead of age 65 as previously recorded. Motion by Jacobsen, seconded Tay Luettinger, that the administration notify the League of Women Voters that the council would like assistance in conducting a survey of the city to determine the number of elderly persons in Richfield eligible for tax relief.
