03-14-1972CITY OF RTCHFTELD HEARING ON COMPREHENSIVE DEVELOPMENT PLAN (Area No. 4) MINUTES March 14, 1972 The Council of the City of Richfield met in special session at Assumption School, 77th Street and 3rd Avenue, at 7:30 p.m., March 14, 1972. Mayor Law called the meeting to order. Present: Anderson, Jacobsen, Kenealey, Luettinger and Law. Absent: None. 1. Introduction. Mayor Law reviewed the information covered in hearings to date, and city manager, Wayne Burggraaff, reviewed the history of the Comprehensive Plan. Planning Director, Robert Worthington, discussed the application of proposals contained in the Compre- hensive Plan to the area under consideration at tonights hearing. (That area between Nicollet and Cedar Avenue, Im494 and 76th Street). He also explained why the planning commission felt changes were going to take place in this area and what effect they would have on adjusting the present land use pattern of this area. 3. General Discussions. Councilman Kenealey spoke in favor of having residential zoning from Dupont to Cedar Avenue,. from 77th Street to Highway ~~494. Currently property located north of 77th Street from about Dupont to Cedar Avenue is zoned multiple residential, This multiple residential zoning extends about two or three lots north of 77th Street. Mr. Kenealey felt that the city made an error in 1954 when this zoning classification was originally placed. on this land. He felt it should be rezoned to single family residential. - 2 v March 14, 1972 Wesley Borgeson, 6401 5th Avenue, a former Planning Commission member, in response to Mr. Renealey's comments, stated that he believed it was the general consensus of opinion that the present property owners located in this multiple family residential area preferred to have the zoning remain as it is now. K. Gillick, 7638 Bloomington Ave., reported that in 1953 or thereabouts, there was a petition circulated against-zoning the property 2 to 3 lots north of 77th Street multiple residential. Q. Councilman Keanealy - "Is a formal petition needed for a rezoning to residential"? A. Mr. Burggraaff - "Yes". Q. Gordon McKenna, 7308 Upton Ave. - "Tf the council adopts this or a revision of it, does it have to be submitted to Metro Council for approval?" A. Mr. Burggraaff - "We must submit it for review and comment. However, the Metro- politan Council does not have the power to approve or deny comprehensive plans of municipalities.!' Q. "Will that tie us in with HUD and their restrictions?" A. Mr. Burggraaff: "Not that I know ofo'.' Q. Mr. McKenna: "Ts there anyway we can accept a plan without having another agency approve it?" A. Mr. Burggraaff: "We are required to file it now and that works to our advantage.': Q. Mr. Gillick: 763$ Bloomington Ave. - "If my property was wiped out, could I then rebuild a single dwelling within a multiple family residential zoning district?" A. R. Worthington - "Yes. The current zoning allows single family homes to be con- structed in every zone in the city-" Q. If a private developer wanted two lots and one-half of a third, and one party didn°t want to se11, would he be forced to se11?" A. R. Worthington; "No, the city can only doncemn for public purposes". m 3 0 March 14, 1972 Q. Melvin M, Olson, 7609 Portland "What do we plan to do with zoning...do we follow or do we plan? Why can°t we draw a line and say 'no more°?" A. R. Worthingtons "Zoning is most effective in regulating new land use activities. Zoning is least effective in regulating existing uses. As long as private developers control land there is going to be desire to change existing uses. This makes it necessary to develop plans which guide decisions of private developers in redevelop ing or reusing existing land." B. Tdstrom, 7621 Bloomington Avenue, spoke in favor of the existing. multiple family residential buffer zone north of 77th Street and commented that he did not understand the necessity of extending it further north to 76th Street, Mrs, A. J. Dennis, 7621 Stevens Ave,, feared that property left residentiaa1 in this area would lose value if part is developed in multiple residence. Q. "Are you tying 76th Street into Highway ~~36?" Aa R. Worthington v "The map shows a cross over to area beyond Highway ~~36 into airport property, However, the Planning Commission had not considered the issue of whether 76th Street should tie into Highway 36 or extend across 36 into airport property. The council will have to provide an answer to this question." Edwin Z. Doty, 7601 Nicollet Avenue, said that it was his observation that houses in the vicinity of 76th and Nicollet were put in a lower value category because of the traffic volume. He also questioned the buffer area, Curtis D. Spencer, 7615 14th Avenue, suggested that boundary for single family homes be placed at 77th Street. Mrs. A. M. Her11, 7620 Chicago Avenue, inquired as to whether it would be necessary to circulate a petition for rezoning the property north of 77th Street from. multiple family to single family. 7'kae answer was o "Yes". a 4 e March 14, 1972 4a Ac~3®urYmnent.
