01-25-1971CITY OF RICHFIELD REGULAR MEETING January 25, 1971 The Council of the City of Richfield met in regular session in the council chambers of the City Hall, 6700 Portland Avenue, Monday, January 25, 1971, at 7:00 P. M. Rev. Alf Romstad, Woodlake Lutheran Church, gave the invocation. The meeting was called to order by Mayor Olson. Present: Anderson, Jacobsen, Luettinger, Law and Olson. Absent: None. 1. Minutes. Motion by Anderson, secondedT by Jacobsen, that the minutes of the regular meeting. of January 11, 1971, be approved with the following correction: Page 3 - Item 4. Po11 of votes: Ayes - Anderson, Jacobsen, Law, and Olson. Nayes - Luettinger. All ayes - Carried. 2. Hearing. on Re oast for Variance, Li°1 General Store, 7529 Lyndale Av_e. The following persons appeared in interest regarding the request for a variance for the property located at 7529 Lyndale Avenue: Ed Mika, division manager, representing Li'1 General Store, Charles Eland, contractor, from Country Builders Don Houlding, 7145 13th Avenue So. Motion by Jacobsen, seconded by Anderson, that the hearing be closed. All ayes - Carried. Motion by Luettinger, seconded by Jacobsen, that the Council grant the variance for Li°1 General Store at 7529 Lyndale Avenue, as described in Council Letter No. 8, with the following stipulations: 1. That the variance be granted in accordance with the Planning Commission°s recommendations. - 2 - January 25, 1971 2. That the site and building plans as presented in Exhibit B be approved. Cl 3. That the city enter into the normal agreement with the applicant to permit landscaping of approximately 17 feet of public right-of-way. 4. 'T'hat the applicant meet all requirements of Section 4.05 of the municipal code regulating. off-street parking contracts and that the contract be granted as shown in Exhibit D with the following stipulations. a. That the detailed plant material and landscaping schedule be approved by the city planner. b. That the applicant comply with all provisions of Section 4.05 as the project is constructed. c. Work with property owner to the-north on the location and construction of fence. All ayes - Carried. Motion by Anderson, seconded by Jacobsen, that the off-street parking contract be granted and that the off-street parking contract contain a written provision that there be a single drive for the south Li°1 General Store°s drive and the north Dairy Queen drive, and that the off-street parking contract not be issued until the city receives written confirmation of the single drive arrangement from both property owners and__that-the o#~_streetgarking_sketch be revised to reflect the single drive and additional landscaping for Li°1 General Store. All ayes - Carried. Request from Heidelberg Dining Lounge - to permit granting of a dance license ~~~ to holders of on-sale liquor license. Jim Rush, 4512 Cedar Avenue, appeared in behalf of the Heidelberg Dining Lounge, to request council consideration for an ordinance amendment that would allow the council to issue dance license in on-sale liquor establishments. Motion by Luettinger, seconded by Jacobsen, that the administration draft an ordinance amendment for first reading which would permit the granting. of dance licenses in on-sale liquor establishments. Motion by Jacobsen, seconded by Luettinger, that the following resolution be adopted; that it be spread in the resolution book and that it be made a part of these minutes: RESOLUTION No. 4501 RESOLUTION RELATING TO METROPOLITAN SPORTS AREA FACILITIES Poll of votes: Ayes - Anderson, Jacobsen, Luettinger, Law and Olson. Ordinance Amendment - Residence Requirement for Managers of Restaurants with 3.2 beer on-sale licenses, Bill No. 1970-34, "AMENDMENT TO SECTION 11.02, SUBDIVISION 9, PARAGRAPH (4) OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD, MINNESOTA", was read by the city attorney, the same being on file in the office of the city clerk. Bi11 No. 1970-35, "AMENDMENT TO SECTIONS 2.29, 2.33, 2.34 and 2.35 OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD, MINNESOTA", was read by the city attorney, the same being on file in the office of the city clerk. Bill No. 1971-2, "AMENDMENT TO CHAPTER XII, PART III, OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD", was read by the city attorney, the same being on file in the office of the city clerk. (C-9302). Motion by Luettinger, seconded by Jacobsen, that this constitute a first reading of Bi11 No. 71-2, and that it be published in the official newspaper in accordance with the city charter, and that second reading and public hearing be held on February 8, 1971.
