REGULAR MEETING November 23, 1970 The Council of the City of Richfield met in regular sessipn in the council chambers of the City Ha11, 6700 Portland Avenue, Monday, November 23, 1970, at 7:00 p.m. Rev. John H. Longley, Emerson Avenue Congregational Church, gave the invocation. The meeting was called to order by Mayor Olson. Present: Anderson, Jacobsen, Luettinger, Law, and Olson. Absent: None. 1, Minutes. Motion by Anderson, seconded by Luettinger, that the minutes of the regular meeting of November :9:;., 1970 be approved as read, but that the following wording be added to Item 15, Page 6: "...and that the administration recheck thei~c policy on minimum plantings and the conformance of this project thereto„" All ayes - Carried. 2. Reports. Motion by Anderson, seconded by Law, that the inspection report for the month of October, 1970, be accepted and filed, C-8285. A11~ ayes - Carried, 3. Bill No. 1970-30 -,(License for keeping of pigeons). - Bill Nom 1970-30entitled:-!=AMENDMENT TO SECTION 10.05 OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD, MINNESOTA" was read by the city attorney, the same being on file in the office of the city clerk. C-8286. Motion by Olson, seconded by Luettinger, that Subdivision 5, paragraph (5) of the ordina~.ce code be amended to read: "Not more than twenty-five pigeons shall be kept at any one time on any licensed premises,"..:,,etc. Poll of votes: Ayes - Olson, Law, Luettinger. Nayes - Jacobsen and Anderson. Absent - none. Carried. - 2 - November 23, 1970 Motion by Jacobsen,. seconded '6y Luettinger, that this constitute the second reading of Bi11 No. 1970-30, and that the council adopt Bill No. 1970-30; that it be spread in the ordinance book; that it be published in the official newspaper and that it be made a part of these minutes. Bi11 No. 1970-28 (Establish minimum age for operation of inball machines) William Brooks, General Council for Music Operators, and Arthur Gleason of the Blue Cue Bowling Lanes,. appeared in opposition of the proposed ordinance. Motion by Luettinger that the ordinance be amended to include tY~e following wording...."unless accompanied by a guardian or parent". Motion lost for lack of a second. Motion by Luettinger that this constitute the second reading of Bi11 No. 1970-28, Seconded by Jacobsen -only to place motion on table. Poll of votes: Ayes - Luettinger. Nayes - Anderson, Jacobsen, Law and Olson. Ab_sent_-_none. Motion failed. Ordinance re3ected. 5. Bill No. 1970-29. (Establishing a uniform minimum age for employment relating to the sale of intoxicating liquors and non-intoxicating liquor). Motion by Anderson, seconded by Jacobsen, that this constitute the second reading of Bi11 No. 19.70-29, and that the council adopt Bi11 Noo 19.70-29; that it be spread in the ordinance book; that it be published in the official newspaper and that it be made a part of these minutes. The city clerk was instructed to send a letter, with copy of amended ordinance, .] to all establishments where intoxicating liquors are sold at retail on-sale. 6, Rsport on Proposed Regulations for Storage of Rental,Trucks and Trailers. In accordance with a previous request by the council, the city staff made a - 3 - November 23, 19.70 study and report on the regulations that should be adopted to control the storage of rental trucks and trailers at service stations within the City of Richfield. The city planner and attorney conducted research on this subject and established some proposed suggestions. Mr. Gerald C. Rummel, attorney for U-Haul, and Mr. Lawrence Swandby, attorney for Easy=Haul, appeared in interest, and discussed the regulations that were offered. Motion by Jacobsen,, seconded by Law, that the city attorney and administration be directed to draft the proposed ordinance and to stipulate the regulations that should be adopted to control the storage of rental trucks and trailers within the city. Po11 of votes Anderson, Jacobsen, Luettinger, Law and Olson. Naves - none. Absent - none, Carried. 7, Fee Waived Christmas Tree License~1970. John W, Jenne, 7040 Lyndale Avenue, and Craig Olson, 7240 Pleasant Avenue, representing Boy Scout Explorer Post 262, appeared in interest. Motion by Anderson, seconded by Luettinger, that the fee waived Christmas tree license be granted to Boy Scout Explorer Post 262,. with the stipulation that the parking. lot at Oak Grove Lutheran Church be free for use on Sunday and any other time when off-street parking is required. All ayes - Carried. 8. Licensing and bonding of building construction contractors. Mr. Orville J. Evenson, Secretary~Treasv.rer of the Cement Masons' Local No..557, discussed the need and presented a request for licensing and bonding of building con- struction contractors in Richfield, Motion by Jacobsen, seconded by Law, that the administration study this request and report back to the council, A11 ayes - Carried. 4 - November 23, 1970 9. Fee Waived License a Christmas Trees-1970-Hub Shopping Area -,Southdale Y's Mens Club, Mr. John Hamilton, 7229 Harriet Avenue, appeared represQ~tl~~ the Southdale Y's Men's Club, for a Christmas tree license at the Hub Shopping Qe~ter, 65th and Pillsbury Avenue, and indicated they were requesting the use of the Kor~er Plaza fenced in area or the 65th and Pillsbury off-street parking area, whichever they could arrange with Hub representatives. Motion by Luettinger, seconded by Jacobsen, that in yew of the fact the appli- cant had expected to use one of these locations; and in v~~W of the fact that sufficient t3.me was not available to find a suitable alternate locat~~~; and in view of the fact that this. is a charitable activity that the license be grg~ted, but in so doing the council indicates that this is designated off-street paring space and that in future years it will be necessary for the Southdale Y°s Men's Club to find another location. All ayes - Carried. 10. Fee Waived License - 16th Avenue. stmas Trees-1970 - Mount Qalvary Lutheran School, 6541 Mr; Richard Schmidt, 7128 Stevens Avenue, appeared, representing the Mount Calvary Lutheran School at 6541 16th Avenue So. Motion by Luettinger, seconded by Anderson, that this Christmas tree license be granted as long as the parking. lot is free for off-street parking needs, and that the deadline for cleanup be extended to January 2, 1971. A11 ayes - Carried. 11. Christmas Tree License - Dairy Queen, 3001 W. 66th Street. (19.70). Mr. Wilbur Fester, 701 Pillsbury Avenue, applicant, appeared in behalf of his request for a Christmas tree license at the Dairy Queen location, 3001 W. 66th Street. Motion by Jacobsen, seconded by Law, that this license be granted in accordance with the standard stipulations. All ayes - Carried. - 5 - November 23, 1970 12, Christmas Tree License 0 Ranger Flying Association, 66th & Vincent Ave. (19.70). Mr.. Merius Boggenstoos, Ranger Flying Association, appeared in behalf. of a re- quest for a Christmas tree license at 66th and Vincent Avenue So. (East side). Motion by Jacobsen, seconded by Anderson, that this license be granted in accordance with the standard stipulations. A11 ayes - Carried. 1.3. Christmas Tree License (19.70) - Elmo E. Erickson, 7701 Lyndale Avenue, Motion by Jacobsen, seconded by Olson, that the Christmas tree application of Elm® E. Erickson, 7.701 Lyndale Avenue, be denied because of the limited space avail- able near the gas station that is needed for off-street parking. A11 ayes - Carried. 14. Christmas Tree License (19.70) - Lyndale Fruit & Vegetable Market, 6412 Lyndale Ave. Motion by Anderson, seconded by Luettinger, that the Christmas tree license for Lyndale Fruit & Vegetable Market, 6412 Lyndale Avenue, be granted in accordance with the standard stipulations.
