09-25-1967CITY 41P RYCHF EID Regular Meeting Sept. 25, 1967 The city council of the City of Richfield met in regular session in the council chambers of the City Hall, 6700 Portland Ave,, Monday, Sept. 25, 1967, at 7:00 P.M, Mayor Olson called the meeting to order. Father William Dire, St, Richard's Catholic Church, gave the invocation. Presents Anderson, Jacobsen, Lue ttinger and Olson. Absent: Randall (arrived later) 1. Minutes Motion by Luettinger, seconded by Jacobsen, that the minutes of the meet- ing of Sept. 119 1967 be approved. All ayes - carried. 2, Set Date of Hearing.- Spec. Use Permit - 6529 Penn Ave. Ray Tharp appeared in explanation of his request for the permit. Motion by Anderson, seconded by Jacobsen, that the council authorize the clerk to advertise a hearing on the application of Ray M. Tharp, 3727 Hilltop Roads Hopkins, for a special use permit at 6529 Penn Ave.; hearing to be Oct, 9th._ Poll of votes: Ayes - Anderson, Jacobsen,'Luettinger. Nays - Olson. Absent - Randall, Carried, 3, Temporary Adv. Signs - 7301 Penn Ave. Mr, McCabe appeared in answer to questions as request is for month of October. Councilman Randall joined the meeting. Motion by Anderson, seconded by Iuettinger, that the council approve the application of William R. McCabe, 7301 Penn Ave., for five wall signs and one pedestal sign at 7301 Penn Ave. for month of October. Tack, 10121 Chicago Ave., for a zoning variation at 7608 -10 Logan Ave. and read the - notice of hearing. No one appeared in opposition* Motion by Randall, seconded by Luettinger, that the hearing be closed, All ayes ® carried. Mayor Olson called for the hearing on the proposed assessment on City Project No, 546 (storm sewer) and read the notice of hearing; The mayor presented a remonstrance petition containing 27 signatures of property owners in the area. C -7694 The attorney explained that the Edina property had a legal right to improve their property and did not have to contain the water, Mrs. Arthur Klein, 69 01 Washburn Ave., asked if she wasn't being assessed for the same thing twice. She questioned the drainage of the corner lot, Mrs. Gillen, 6932 Washburn Ave., objected. Robert- Bayerle, 69 08 Washburn Ave., objected to whether Edina had a right to drain to Richf field. Mrs. Weed, 6933 Xerxes Ave., appeared in opposition, Mr. Weeds 6933 Xerxes Ave,, appeared in opposition. Mr. D. V. Garner, 6940 Washburn Ave., felt there was an error in the assess- ment on his property and on 6944 Washburn Ave. Mr,, B. O@ Sjolseth, 6924 Washburn Ave., asked why Edina shouldn't adept the responsibility to pay, Nicholas Gillen, 6932 Washburn Ave., stated that a. corporation gave rise to the project need here. Mr. Bayerle asked about whether the delinquent lots can be assessed. Mr. Ennenga, 6920 Washburn Ave., stated that his property was being washed into the hole. Mrs. Gillen questioned whether the city could legally assess this,. A discussion was held on the relative merits of a 10 -year lease for parking. RelatiM to Control of Plant bests. in City A report from the city engineer (forester) dated Sept, 14, 1967 was pre- seated listing evidence of positive oak wilt on private and on public properties and suggesting removal of trees in the spring in accordance with Ordinance No, 11,11 relating to control. C ®7695 It was agreed that this should be handled in much the same manner as a special assessment project with notices, hearings, etc. Motion by Randall, seconded by Anderson, that a detailed report from the engineer (forester) be prepared on work involved in the abatement of oak wilt.
