1 1 CI7Y OF RICHFIELD Regular Meeting August 28, 1967 The city council of the City of Richf ie ld met in regular session in the council chambers of the City Hall, 6700 Portland Ave., Monday, August 28, 1967, at 7 :00 P.M. Mayor Olson called the meeting to order. Pastor Glen Bettenhausen, Church of Christ, gave the invocation. Present: Anderson, Jacobsen, Luettinger, Randall and Olson. Absent: None. to Minutes Motion by Anderson, seconded by Jacobsen, that the minutes of the meeting of August 14, 1967 be approved, corrected as follows-. Page 6, Item 14 --jim Little is not an attorney and appeared on behalf of the applicants. All ayes ® carried. 2. Reports Motion by Jacobsen, seconded by Randall, that the following reports be accepted and filed-. Liquor Stores report m June 1967 C -7278 Nursing report m July 1967 C-7279 All ayes ® carried. 30 Presentation of Safety Citation Mr, Blenis and Mr, Platt from A.A.A. presented the Minnesota Safety Council's Pedestrian Safety Citation Award for the City of Richfield. Nays - none, Absent - none. Carried. 6. Hearing -,Special Use Permit - 6529 Penn Ave, it being 7:15 P.M. Mayor Olson called for the hearing on the application of Ray M. Tharp, 3727 Hilltop Rd,, Hopkins, for a special use permit at 6529 Penn Ave'. and read the notice of hearing. Ray Tharp, 3727 Hilltop Road, Hopkins, appeared as applicant and explained his request. John Ryan appeared representing ParTake Corp., builder of the project. The mayor read the stipulations of the previous permit approved April 259 1966 and building permit approved May 9, 1966, including painted block on the building facing east; hours of operation to be same as Burger -King; prime tenant would be Top -Boy International. The council was of the opinion that this was a major change from the permits granted on McDonald °s and thereby required council approval on the modifications. The prime tenant will be Arby's International, parent corporation. George Nadler family will have the franchise. All exposed block will have a permanent finish. Lloyd Jensen, 6511 Oliver Ave., presented a remonstrance petition con- taining approximately 30 signatures._ C-7280 Bernie Slater, 6525 Oliver Ave,, appeared in opposition. Mrs. Strandberg, 6532 Oliver Ave,, was concerned with the traffic lights shining in apartment windows as well as the location of garbage containers. Motion by Luettinger, seconded by Randall, that the hearing be closed. All ayes - carried. _4 Aug, 25,. 1967 Motion by Randall, seconded by Luettinger, that the application for a special use permit for Ray M. Tharp, 3727 Hilltop Road, Hopkins, for a drive-in restaurant at 6529 Penn Ave. be denied because the changes are radically dif- ferent and the proposed business is not the highest and best use of the land. Discussion of Rich Acre Storm Water Problem A discussion was held on a possible alternate to Rich Acre storm water problem, The contributary property and city negligence was discussed, Mrs.. Sundem spore in interest. The situation of the sump pump at 64th and Irving Ave. was discussede The administration is to look into additional contributing storm sewer area for next council meeting. Motion by Randall, seconded by Anderson, that the following resolution be adopted; that it be spread in the resolution book and that it be made a part of these minutes: RESOLUTION NO.. 3838 RESOLUTION ORDERING PREPARATION OF REVISED REPORT ON S70RM SEVER CONSTRUCTION VICINITY 19Ti AVE., -68th M 69th ST., CITY PROJECT NO. 561 Poll of votes: Ayes -.Anderson, Jacobsen, Luettinger, Randall and Olson,. Nays - none. Absent ® none. Carried. This resolution appears as resolution #3838 in resolution book #24. The engineer is to restudy the benefited area. Don Peterson appeared in interest. 8. Temporary Outdoor Adv© Sign John S. Nelson appeared representing Murphy Oil Corporation. Applications for signs cover two locations: 77th & Lyndale Ave. and 63rd & Lyndale Ave.. with -5- Aug. 28, 1967 pennants to be included in the approval for Sept. 7, 8, 9 and 10th. Motion by Jacobsen, seconded by Luettinger, that the council grant the permits for outdoor advertising signs and pennants at 77th & Lyndale Ave. and'63rd & Lyndale for the Murphy Oil Corp., 612 I4, Lilac Drive, the pennants are to be removed until Sept. 7, 1967. All ayes - carried. 9, Commercial Bldg. Permit - 6600 15th Ave. & 1300 Ea 66th St. Mr. Ringrose appeared as applicant for the Minneapolis Star & Tribune. Motion by Jacobsen, seconded by Anderson, that the council grant the com- mercial building permit to Minneapolis Star & Tribune, 425 Portland Ave., for the moving of distribution center from 6600 15th Ave. to 1300 B. 66th St, All ayes - carried. C -7281 10. Report on Storm Sewer Construction - New Ford Town The engineer read the memorandum regarding storm sewer solutions dated August 9, 1967. Motion by Luettinger, seconded by Randall, that the administration make a study and report on the over-all storm drainage cost for the storm sewer and financial plan early in 1968. All ayes - carried. Motion by Luettinger, seconded by Jacobsen, that the administration look into the correcting of Mr, Oberg's problem. All ayes - carried. 11. Bids - 2" Water Meters Motion by Anderson, seconded by Jacobsen, that the minutes of the bid- opening on 2" water meters, Aug. 23, 1967, be approved. All ayes - carried. C -7282 The manager presented a tabulation of bids together with his re w mmendation for award, Motion by Anderson, seconded by Jacobsen, that the council accept the low bid of Power Process for $4299.00.
