Mayor Olson called the meeting to order,. Councilman Ao,P, Anderson gave the invocatipn, Present-, Anderson, Jacobsen, Luettinger, Randall and Olson,. A petition favor» ing the rezoning was accepted,, C -7681 Motion by Anderson, seconded by Jacobsen, that the council authorize the clerk to advertise a hearing on the application of James A, Tack, 10121 Chicago Avem for the rezoning of 7608 -10 Logan Ave., and that the application be referred to the Planning Commission; hearing to be Sept. 25, 1967. All ayes- carried, 5, Set Date of Hearing - Special Use Permit - 6401 Lyndale Ave. The applicant stated that since the station at this address had been shut down, the application was presented for council consideration, Gust Failden ap- peared as owner as well as Ralph Overlie and Mr, Campbell who represented Conti- nental Oil Co, as applicants, Mr. Blomberg, 5921 Emerson Ave,, proposed lessee, appeared in interest and explained his position, Mr, Marshall, attorney, appeared. Stucco on the exposed plywood was discussed, The city attorney stated that this was not a special use permit but is a building permit that does not fully conform to the code, -3- Aug. 14, 1967 Notion by Andersong seconded by iuettinger, that the council grant the commercial buil-Ung permit and off - street parking layout approval subject to the stipulation that in addition to the proposed improvements (plus one tank) by the Continental Oil Co., (.y 319 1967) that exposed plywood be stuccoed and lighting be approved by the engineer. All ayes - carried. 6. Set Date of Fearing..- Adjustment & Appear_ ®7608 -10 Logan Ave. Motion by Randall, s -econded by Jacobsen, that the council authorize the clerk to advertise a hearing on the application of James A. Tack for an adjust- ment and appeals on 7608-10 Logan Ave.; hearing to be Sept. 259 1967, All ayes - carried. 7© Set Date of Bearing - Vacation of Portion of Street Joe Nelson represented the applicant. Motion by Anderson, seconded by Randall, that the council authorize the clerk to advertise a hearing on the application of G. A. Pat Rooney, 7410 T531ffard Ave., to vacate a portion of the street adjacent to Parcel 724, Plat 44826; hearing to be Sept. 11, 1967. All ayes - carried. 8. Authorize Call for Bids - Sealcoating Motion by Anderson, seconded by Jacobsen, that the council authorize the clerk to call for bids on sealcoating; bids to be opened August 28, 1967. All ayes m carried. 9. Consideration of Change of Name Ray Tharp appeared in explanation of his request to change the name for his operation from McDonald's to "Top Boy International" or "Arby's" Drive -In, The attorney ruled that change of name does not need council action. The off - street parking could be a significant change in plans, The attorney stated that if the building or off - street parking would be significantly modified, a new hearing would need be held. -4- Aug. 14, 1967 Notion by Undall, seconded by Luettinger, that the council authorize the clerk to adver,�lme a hearing on a special use permit for Ray Tharp at 6529 Penn Ave *; hearing to be August 28, 1967. We Blair appeared stating he was interested in building two. double bungalows on the three lots* A petition concurring in the proposed zoning containing 80% of signatures in the area was presented. C -7682 No one appeared in opposition. Motion by Randall, seconded by Jacobsen, that the hearing_ be closed.
