The city council of the City of Richfield met in regular session in the
council chambers 'of the City Hail, 6700 Poxtland Ave.,. Monday, July .24, 1967,
at 7 :00 P.M.
Mayor Olson called the meeting to order,
Rev. James F. Riley, St, Nicholas Episcopal Church, gave the invocation,
Present: Jacobsen, Luettinger, Randall and Olson.
Absent: Anderson (on vacation and attending National League of Cities
conference in Boston).
1. Minutes
Page 10 of the July 10, 1967 minutes, the poll of votes on Resolution #3819
did not carry as it requires a 415 vote instead of 2/30 Motion by Luettinger,
seconded by Jacobsen, that the minutes of the regular meeting of July 10, 1967
be approved as corrected. All ayes - carriedg
Motion by Jacobsen, seconded by Luettinger, that the minutes of the Board
of Review, July 11, 1967, be approved. All ayes - carried.

The feasibility of adopting an ordinance that has reference to a law that
hasn't been tested was discussed„
Motion by Jacobsen, seconded by Luettinger, that this.constitute the second
reading of Bill No, 1967 -13.
Poll of votes: Ayes - Jacobsen, Luettinger, Randall and Olson. Nays - none.
Absent -Anderson. Carried.
Motion by Jacobsen, seconded by Luettinger, that the council adopt Bill No.
1967 -13; that it be spread in the ordinance book; that it be published in the
official newspaper and that it be made a part of these minutes.

Absent - Anderson. Carried.
4.; Bill No. 1967 -14 (Sunday Closing --Ord. #11.10)
Bill No. 1967-14 entitled:. "AN ORDINANCE PROHIBITING CERTAIN COMMERCIAL ACTIVI-

was read by the city attorney, the same being on file in the office of the city

reading of Bill No. 1967 -14.

Ray Tharp, 3727 Hilltop Road,. Hopkins, appeared in request of having
this item removed from the agenda No action was taken by the council,

Clayt Oswald appeared representing the applicant*.
Motion by Jacobsen, seconded by Randall, that the council authorize the
clerk to advertise a hearing on the application of St* Nicholas Episcopal Church,
for a special use permit at 7227 Penn Ave.; hearing to be August 14, 1967* All
ayes ® carried.
7. Set Date of Hearing ® Adjustment & Appeals 1401 E. 66th St.
Dr. Swenson, applicant, appeared. Mr* Dick, architect, also appeared. A
letter from adjoining property owners was suggested.
Motion by Luettinger, seconded by Jacobsen, that the council authorize the
clerk to advertise a hearing on the application of Dr. James A. Swenson, 1305 S*
66th St., for an adjustment & appeals at 1401 E. 66th St.; hearing to be August
14g 1967. All ayes @'carried.
8. Hearing m City Project No. 562 (Street Grading)
It being 7 :15 P.M. Mayor Olson called for the hearing on City Project No.
562 (Street Grading) and read the notice of hearing*
Duane Joseph, attorney, represented Lund °s Food Market, applicants. He
stated he had withdrawn the application for cutting into the service road as
per letter sent to Mr. Gordon of the Land Use Committee, Planning Commission.
The present.standing water situation is to be reviewed by the city sanitar-
ian. Mr. Joseph stated that the Queen Ave. outlet would relieve congestion on
Penn Ave.

The benefits of sanitary sewer and water were discussed,
Charles Bizon represented the Canteen Co, in objection to assessment of
water, sewer and street improvement,
Gordon Lundberg spoke in opposition to the proposed improvements on be-
half of Louise Whitbeck School and for himself, He did not object to the Queen
Ave,. development for the lots to the west of Lund"s market,
Clarence Hedlund, 6229 Russell Ave,, presented a remonstrance petition re-
garding Queen Ave, opening, C-7669
William Hallan, 6220 Washburn Ave,, appeared in opposition to creating ad-
ditional traffic,
Mrs, Nutt, 6245 Thomas Ave,, appeared,
Jim Duresky, 6210 Upton Ave,, was opposed,
Charles Pallas, 6344 Penn Ave,, was opposed,
Stipulations in the minutes of the commercial building permit for Lund °s
Market were read by the attorney,
Dick Guth, 6224 Russell Ave,, opposed the opening of Queen Ave,
Ted Lund, owner, stated that the restricted parking on Penn Ave, helped
his traffic situation,
Motion by Jacobsen, seconded by Randall, that the hearing be closed. All
ayes m carried.
A further wait to see persistent traffic pattern was suggested by Council-
man Luettinger. The assessing of both sides of Queen Ave, was discussed. Load
limits could restrict truck traffic on Queen Ave,
Motion by Luettinger, seconded by Jacobsen, that the council, deny the
resolution ordering improvement of street grading (C,P, x'562) based upon need
for true traffic flow, All ayes m carried,

9. Hearing - City Proj. #563 (San. ,Sewer)
It being 7015 Po'M. Mayor Olson called for the hearing on City Project No.
563 (sanitary sewer) and read the notice of hearing.
Canteen Co. is opposed to the installation of sanitary sewer in this area.
No one spoke.
Motion by Randall, seconded by Jacobsen, that the hearing be closed. All
ayes m carried.
Motion by Randall, seconded by Jacobsen, that City Project No. 563 for the
improvement of sanitary sewer for the west 308 of Queen Ave. from 64th St. to
frontage road of Hwy. #62 not be made at this time. All ayes ® carried.
10. Hearing - City Project #564 (dater Main)
It being 7015 P.M. Mayor Olson called for the hearing on City Project
No. 564 (water main) and read the notice of hearing.
No one appeared.
Motion by Jacobsen, seconded by Luettinger, that the hearing be closed.
All ayes - carried.
Motion by Jacobsen, seconded by Luettinger, that City Project No. 564
(water main) at Queen Ave. from 64th St. to frontage road of Hwy. #62 is not
to be made at this time. All ayes m carried.
11. Heari!X - City Project #540 (Oiling)--Proposed Assessment
It being 7:15 P.M. Mayor Olson called for the hearing on the proposed
assessment of City Project #540 (annual street improvement and oiling program)
and read the notice of hearing.
No one appeared.
Motion by Jacobsen, seconded by Luettinger, that the hearing be closed.
All ayes - carried.

12. Hearing - Land Division - 6529 Penn Ave.
It being 7:15 P.M. Mayor Olson called for the hearing on the application
of Ray M. Tharp, 3727 Hilltop Road, Hopkins, for a land division and read the
ndtice of hearing.
Ray Tharp appeared as applicant and explained his request, No one ap-
peared in opposition.
Motion by Jacobsen, seconded by Randall, that the hearing be closed. All
ayes m carded.
Motion by Jacobsen, seconded by Luettinger, that the council grant the land
division-permit to Ray W. Tharp, 3727 Hilltop Road, Hopkins, to divide Parcel
#13409 Plat 44828 (6529 Penn Ave.) All ayes m carried. C -7670
The council recessed for 5 minutes and then reconvened with all members
present except Councilman Anderson,
13, Noise Problem - 68th & Columbus
Captain LaMettry reported orally on a possible problem at 6821 Columbus
Ave.
G. A. Eisen, 6809 Columbus Ave. related objections and interest in a
noise abatement ordinance.

N. Gulden, 6824 Columbus Ave., related experiences on parking problem.
Mist Nordmeyer, 6833 Columbus Ave., appeared in interest of parking problem.
Mrs. Stromberg, 6838 Columbus Ave., appeared in interest.
Motion by Randall, seconded by Luettinger, that the attorney draw -up a pro-
posed ordinance restricting number of persons renting single family residences,
which draft is to be considered at the August 14th meeting. All ayes ® carried.
14. Richfield Fire Kept. Act
Representative Cook appeared in explanation of points.
Motion by Jacobsen, seconded by Luettinger, that the matter of the presenta-
tion of the act passed by the state legislature relative to the Richfield Fire
Dept, Relief Assen be deferred to August 14th for drawing cost figures projected
five years. All ayes o carried.
15. Resignation from Fire Civil Service Commission
Motion by Jacobsen, seconded by Randall, that the council accept the resig-
nation of S. C. Matula, as a member of the Richfield Fire Civil Service Commission
and that he be given a recognition award. The attorney ruled that Mr. Matula's
moving to Minneapolis created a vacancy in the Fire Civil Service Commission.
All ayes o carried.
16. Donation to Fire Department
Motion by Jacobsen, seconded by Randall, that the donation of two chairs
to the Fire Department from the Women's Auxiliary of the Fire Dept. be accepted
with thanks. All ayes m carried.
17. Storm Sewer Easements
Motion by Luettinger, seconded by Jacobsen., that the following storm sewer
easements be accepted at no cost to the city: (400 W. 65th St.)

The council agreed that the word "substantially4° be deleted from the resolu-
